Amends the Illinois Municipal Code. Provides that notwithstanding any provision of law to the contrary, on and after July 1, 2014, no home rule unit may impose any tax increase, or levy any new or additional tax, without prior referendum approval.
Amends the Code of Criminal Procedure of 1963. Provides that if the defendant pleads guilty the plea shall not be accepted until the court shall have fully explained to the defendant the following: (1) the maximum and minimum penalty provided by law for the offense which may be imposed by the court (rather than the consequences of the plea and the maximum penalty provided by law for the offense which may be imposed by the court); (2) any possible increased sentence by reason of the fact of a prior conviction or future conviction and any possibility of the imposition of consecutive sentences; (3) any registration requirement that accompanies the plea and the restrictions associated with the registration; and (4) the consequences of the plea on a defendant's ability to: (A) retain or obtain housing in the public or private market; (B) acquire loans for educational or other purposes; (C) enroll in certain degree programs; (D) retain or obtain employment; (E) retain or obtain an occupational or driver's license; (F) possess a firearm; and (G) retain or obtain custody of a child.
Amends the General Assembly Article of the Illinois Pension Code. Provides that upon a participant being charged with any felony relating to or arising out of or in connection with his or her service as a member, the participant's active participation in this System is suspended, and no additional contributions shall be accepted from that person or service credits granted to that person by the System during that suspension. Directs that any such contribution inadvertently accepted by the System during the period of suspension shall be promptly refunded. Provides that if the charge is dropped or the person so charged is found not guilty or otherwise not convicted of the felony, his or her rights to active participation in the System and to make contributions and establish service credit under the System shall thereupon be restored, retroactive to the beginning of the suspension. Provides that none of the benefits under the System shall be paid to any person who is found guilty (rather than convicted) of any felony relating to or arising out of or in connection with his or her service as a member. Provides that if such a person is later not convicted of the felony or his or her conviction is reversed, then his or her rights to benefits under this System shall be restored, including interest on any benefit payment that was delayed under the Section. Effective immediately.
Amends the Illinois Income Tax Act. Makes a technical change in a Section concerning the short title.
Amends the Unified Code of Corrections. Provides that the supervising officer shall request the Department of Corrections to issue a parole violation warrant, and the Department shall issue a parole violation warrant, under the following circumstances: (1) if the parolee or releasee commits an act that constitutes a Class A misdemeanor or a felony, (2) if applicable, fails to comply with the requirements of the Sex Offender Registration Act, or (3) if the parolee or releasee is charged with violation of an order of protection (rather than specified offenses).
Amends the Counties Code. Modifies the format of the referendum question for counties seeking to impose a school facility occupation tax to include a brief description of the project for which the revenue from the tax will be used and a definite period of time during which the tax will be imposed.
Amends the Illinois Municipal Code. Provides that if a property owner is cited with a code violation and the remedy renders the property uninhabitable, the hearing department shall provide the owner with an emergency hearing in front of a hearing officer within 7 days of when the building inspector reported the violation. Requires a hearing officer to immediately lift the order condemning the property after the hearing unless he or she finds the alleged code violation to exist and pose an immediate safety hazard to the occupants of the property. Provides that a municipality may impose remedies for sanctions other than prohibition of occupancy.
Amends the Election Code. Provides that no building or part of a building shall be designated or used as a polling place if spirituous or intoxicating liquor is sold anywhere on the premises.
Amends the Illinois Public Aid Code. Provides that any person who possesses for an unlawful purpose another person's Electronic Benefit Transfer card (EBT) or LINK card in order to use or transfer in any manner not authorized by law or the rules and regulations of the Department of Human Services the cash assistance benefits held on that EBT or LINK card is guilty of a violation and shall be subject to certain penalties established under the Code. Effective immediately.
Amends the Illinois Municipal Code. Provides non-home rule municipalities the power to exercise all power provided to home rule units under Section 6 of Article VII of the Illinois Constitution, except for the powers to tax and to incur debt. Effective immediately.
