Rep. John Cabello

Amends the Illinois Vehicle Code. Provides that 100% of the additional administrative fee levied on violations of the prohibition on driving under the influence shall be distributed to the law enforcement agency making the arrest (rather than a portion being deposited into the General Revenue Fund) for the purpose of enforcing and preventing driving under the influence.

Amends the Property Tax Code. Provides that, beginning in taxable year 2013 and concluding in taxable year 2017, the county clerk shall reduce the property taxes levied by each taxing district to a level that is not greater than that taxing district's levy in the previous taxable year. Provides that the county clerk may increase or decrease the portion of a total tax levy paid by any individual taxpayer, provided that the increase or decrease in the individual taxpayer's tax bill is based solely on a change in the equalized assessed value of the taxpayer's property. Effective immediately.

Amends the Illinois Public Aid Code. Provides that the Department of Human Services shall enter into an agreement with the Illinois State Police (ISP) to allow the Department's database of public aid recipients to cross-reference with ISP's database of outstanding criminal warrants. Further provides that public aid recipients who are found to have an outstanding criminal warrant shall be subject to an immediate suspension of their public aid benefits, including the immediate deactivation of their electronic benefits card or LINK card provided under the food stamp program.

Amends the Criminal Code of 2012. Increases various penalties for aggravated battery. Provides that aggravated battery by causing great bodily harm or permanent disability or disfigurement to any child under the age of 13 years, or to any severely or profoundly intellectually disabled person is a Class X felony for which a person shall be sentenced to a term of imprisonment of a minimum of 20 years and a maximum of 60 years. Provides that aggravated battery by causing great bodily harm or permanent disability or disfigurement is a Class X (rather than a Class 1) felony when the aggravated battery was intentional and involved the infliction of torture. Increases other penalties for aggravated battery.

Amends the Criminal Code of 2012. Creates the offense of making a false statement to obtain an order of protection or civil no contact order. Provides that a person commits the offense when he or she knowingly makes or causes to be made any false statement intending the statement to be relied upon in issuing or enforcing an order of protection or civil no contact order. Provides that a violation is a Class 3 felony. Amends the Civil No Contact Order Act and the Illinois Domestic Violence Act of 1986. Provides that whenever any person is found guilty of making a false statement to obtain an order of protection or civil no contact order and the issuing court materially relied on the false statement when it issued the order, then the issuing court shall vacate that order. Provides that in that case, all records relating to the petition filed under the respective Act shall be expunged. Provides that if the statement was not material to the issuance of the order, then the court shall modify the order to the extent justice requires. Effective immediately.

Amends the Home Inspector Licensing Act. Deletes a provision that exempts any person acting within the scope of his or her employment as a code enforcement official for a unit of local government from the licensing requirements of the Act.

Amends the Unified Code of Corrections. Provides that as a condition of parole or mandatory supervised release, a person placed on parole or mandatory supervised release must reside within the county where the subject resided immediately prior to his or her commitment to the Department of Corrections. Provides that upon release of a person on parole or mandatory supervised release, the Department of Corrections shall release the person only to an address located in the county where the subject resided immediately prior to his or her commitment to the Department.

Amends the Illinois Vehicle Code. Makes a technical change in a Section regarding special license plates.

Amends the Public Community College Act. Provides that if a student enrolled in a community college is not a resident of the community college district but he or she is a resident of a county in this State that has a 10% or higher unemployment rate, then the student is eligible for the in-district tuition rate even though he or she is not a district resident.

Amends the Illinois Income Tax Act. Makes changes to a credit awarded for wages paid to qualified veterans. Provides that the credit shall be: (1) $5,000 (instead of 20% of the gross wages, but not to exceed $5,000) for certain veterans who were unemployed at the time of hire; and (2) $1,200 (instead of 10% of the gross wages, but not to exceed $1,200) for other qualified veterans. Changes the definition of "qualified veteran" to include all Illinois residents who are members of the National Guard, reserve, or regular component of the Armed Forces of the United States. Allows the credit to be prorated. Provides that the credit is exempt from the Act's automatic sunset provision. Effective immediately.
