Community-based Care Lead Agency and Subcontractor Liability; Defining the term “culpably negligent manner”; providing circumstances under which a community-based care lead agency is not liable in tort for the acts or omissions of its officers or employees; providing that a community-based care lead agency may be held liable in tort for such acts or omissions under certain circumstances; providing that a subcontractor of a community-based care lead agency may be held liable in tort for such acts or omissions under certain circumstances; deleting a provision applying a limitation on certain liability to contracts entered into or renewed after a certain date, etc.

Growth Management; Providing requirements for coordination mechanisms that are required for certain agreements required as part of the intergovernmental coordination element of a comprehensive plan; requiring that certain interlocal agreements use a plan-based methodology for a certain purpose; requiring that certain capacity standards be specified in a certain impact fee study; requiring that a demonstrated-need study be accompanied by a certain declaration; prohibiting local governments, school districts, and special districts from using certain data for a specified purpose, etc.

Land Use and Development Regulations; Requiring that the amount of certain application fees reasonably relate to certain costs; requiring that certain interlocal agreements between school boards and local governments address reasonable access to certain public easements and public rights-of-way; requiring that local government comprehensive plans and land development regulations include factors for assessing the compatibility of certain residential uses; authorizing the placement of certain residential manufactured buildings on any lot in a recreational vehicle park; requiring that an offsite constructed residential dwelling be permitted as of right in certain zoning districts, etc.

Local Government Enforcement Actions; Prohibiting certain enforcement actions by counties, municipalities, and special districts, respectively; defining the term “enforcement action”; requiring counties, municipalities, and special districts, respectively, to establish and maintain rules; authorizing filing of legal action and providing legal remedies in certain circumstances, etc.

Special District Funding; Revising agency agreements that provide state financial assistance to recipients or subrecipients to include specified special districts as an entity to which such agency may provide for the payment of invoices under specified circumstances; requiring state agencies to expedite payment requests from certain counties, municipalities, and special districts for a specified purpose; revising the definition of “rural community” to include specified special districts, etc.

Relief of the Estate of Mark LaGatta by the Department of Transportation; Providing for the relief of the Estate of Mark LaGatta; providing an appropriation to compensate the estate for injuries and damages sustained by Mr. LaGatta as a result of the negligence of the Department of Transportation; providing a limitation on compensation and the payment of attorney fees, etc. CLAIM WITH APPROPRIATION: $2,200,000

Electronic Signatures Associated with Total Loss Vehicles and Vessels; Requiring insurance companies or their authorized agents to implement certain control processes and procedures for certain electronic signatures; deleting a requirement that electronic signatures on odometer disclosures submitted through insurance companies be executed in a specified manner, etc.

Violations of Pretrial Release Conditions for Violent Crimes; Citing this act as the “Victim Safety in Pretrial Release Act”; providing that a person who is on pretrial release for a specified violent crime commits a separate criminal offense if such person willfully violates certain conditions of pretrial release; providing criminal penalties; providing that a law enforcement officer is not liable in a civil action for an arrest of a person based on probable cause to believe that the person has violated a condition of pretrial release in specified circumstances; authorizing a law enforcement officer to arrest a person without a warrant if there is probable cause to believe that the person has willfully violated certain conditions of pretrial release, etc.

Causes of Action Based on Improvements to Real Property; Revising the time in which an action founded on the design, planning, or construction of an improvement to real property shall be commenced; revising the date on which the statute of limitations period for such action begins; revising the latest date by which an action shall be commenced, etc.

Mitigation Banks; Beginning on a specified date, revising the schedule for credit release upon issuance of a mitigation bank credit permit; authorizing a mitigation bank applicant to propose an alternative credit release schedule; prohibiting mitigation credits from being released for freshwater wetland creation until certain conditions are met; requiring the department and water management districts to apply proximity factor multipliers in a specified manner; limiting the timeframe for the permit applicant to rely on a credit availability determination for specified purposes, etc.
