Department of Health; Revising requirements for department approval of qualified physicians and medical directors of medical marijuana treatment centers; prohibiting medical marijuana treatment center cultivating, processing, or dispensing facilities from being located within a specified distance of parks, child care facilities, or facilities providing early learning services; creating the Neurofibromatosis Disease Grant Program within the department; revising duties of the department in administering the Early Steps Program; authorizing a registered nurse to delegate the administration of certain controlled substances to a home health aide for medically fragile children under certain circumstances, etc.
Temporary Certificates for Practice in Areas of Critical Need; Revising the conditions under which the Board of Medicine, the Board of Osteopathic Medicine, and the Board of Nursing, respectively, are authorized to issue temporary certificates for practice in areas of critical need; authorizing certificateholders to continue primary care services after such areas lose their critical need designation under certain circumstances, etc.
Payment Stablecoin; Revising the Florida Control of Money Laundering in Money Services Business Act to include payment stablecoins; prohibiting persons from engaging in the activity of a qualified payment stablecoin issuer without being licensed or exempted from licensure; requiring applicants seeking to be a qualified payment stablecoin issuer to submit a specified application to the office; specifying that licensed qualified payment stablecoin issuers may only engage in certain activities, etc.
Child Care and Early Learning Providers; Exempting public and private preschools from specified special assessments levied by a municipality; revising licensing standards for all licensed child care facilities and minimum standards and training requirements for child care personnel; requiring a county commission to affirm annually certain decisions; expanding the types of providers to be considered when developing and implementing a plan to eliminate duplicative and unnecessary inspections, etc.
Mental Health; Citing this act as the “Tristin Murphy Act”; expanding the programs and diversion initiatives supported by implementation or expansion grants to include training for 911 public safety telecommunicators and emergency medical technicians for certain purposes and to include veterans treatment court programs; encouraging communities to apply for specified grants to establish misdemeanor or ordinance violation mental health diversion programs; encouraging communities to apply for specified grants to establish pretrial felony mental health diversion programs; expanding eligibility for the Forensic Hospital Diversion Pilot Program to include Hillsborough County, etc. APPROPRIATION: $794,880
Invalid Restrictive Covenants in Health Care; Specifying that certain restrictive covenants in employment agreements relating to certain licensed physicians are not supported by a legitimate business interest; declaring that such restrictive covenants are void and unenforceable, etc.
Florida Virtual School; Deleting provisions requiring the Florida Virtual School to give priority to certain students; providing that officers and employees are granted sovereign immunity in addition to the board of trustees; providing that certain expenditures are contingent upon review and approval by the Florida Virtual School president and chief executive officer or authorized designees, rather than the executive director, etc.
Nonopioid Advance Directives; Defining the term “episode of care”; requiring the Agency for Health Care Administration to create and post on its website a voluntary nonopioid patient form; requiring each health care facility to post the form on its website or provide a link to the form on the agency’s website, etc.
International Baccalaureate Bonus Funding; Revising the requirements for the calculation of additional full-time equivalent membership and certain bonuses based on International Baccalaureate examination scores of students to include students who earn a minimum grade in a specified course, etc.
