Recognizing a fundamental economic change toward businesses that require innovation, The Honorable John C. Carney, Governor of the State of Delaware, issued Executive Order One on January 18, 2017 creating a Working Group of business and government leaders to study methods to improve coordination between the public and private sectors, attract growing businesses and foster economic development throughout the State. The Governor appointed members of the Working Group representing government, business leaders and the community. The Working Group conducted public meetings in the State to receive input from the public on issues related to business development and retention in the changing economy. The Working Group considered research and input from experts in the area of public/private partnerships as well as statutes and data from other states. The Working Group issued a report to the Governor on April 7, 2017 recommending the establishment of a public/private partnership in Delaware to focus on investment attraction, entrepreneurship and innovation, talent development and retention, and research and analysis. Upon consideration of the Working Group report, the General Assembly intends to appropriate funding for the Public/Private Partnership, a nonprofit public/private partnership comprised of leaders in the public, business and the community to build a stronger entrepreneurial environment in the State. The Public/Private Partnership will focus on leveraging private resources to improve business recruitment, retention and expansion, identify and develop a talented workforce, connecting with the global economy and building a stronger entrepreneurial environment. To ensure public accountability the Partnership will submit to the Governor and the General Assembly tax returns, financial statements, organizational polices and will make available for inspection meeting minutes. To make the most efficient use of available resources, this legislation eliminates the Delaware Economic Development Office because the public/private partnership will be conducting business attraction and development functions formerly performed by that Office. This legislation transfers tourism, the Delaware Motion Picture and Television Commission and duties related to administration and the financial analysis of proposed economic development projects to the Department of State. The transfer will improve efficiency, eliminate redundancy and foster business attraction, innovation, tourism, small business development, business retention, minority, women, disadvantaged and veteran owned businesses. Sections 3 through 21 of this Act simply make conforming changes throughout Title 29 and other titles of the Delaware Code where references to the Delaware Economic Development Office appear. The Division of Small Business, Development and Tourism is referenced in its place. The bill also removes some Code Sections that reference funds and functions that no longer exist.

This Act provides supplementary appropriations to certain Grants-in-Aid for Fiscal Year 2018. Section 1 – Government Units and Senior Center $18,582,949 Section 2 – One-Times and Community Agencies $12,886,495 Section 3 – Fire Companies $4,711,925 Section 4 – Veterans Organizations $244,230 GRAND TOTAL $36,425,599 This Act also amends Title 30 of the Delaware Code relating to taxes on personal income.

This resolution honors USO Delaware for their important and inspiring work supporting military members and their families.

This bill sets forth the framework by which a homeowner will pay the disputed rent increase amount to the community owner until final resolution of the rent increase dispute. The community owner must keep each payment of the disputed rent increase amount in an escrow account in a federally-insured banking institution and provide in writing the location of the account to the Delaware Manufactured Home Relocation Authority (Authority) and the Consumer Protection Unit of the Attorney General’s Office and the account number within 30 days of the first dispute rent increase payment. This bill prohibits the community owner from using the escrowed funds for any purpose not expressly permitted by this subsection. This bill requires the community owner to maintain a separate escrow account for each community owned and financial records such that the Consumer Protection Unit can audit such records. This bill provides penalties if the community owner fails to provide the location of the escrow account or place the rent increase dispute payments into an escrow account at a federally-insured banking institution. The bill provides that upon final resolution, if the rent increase dispute resolves in favor of the home owner, then the community owner must return the disputed rent increase held in the escrow account including any interest. If the community owner prevails, then the community owner is entitled to the dispute rent increase amount held in the escrow account plus any accrued interest.

This Act is modeled after American Laws for American Courts legislation that has passed in Tennessee, Louisiana, Arizona, Kansas, South Dakota, Alabama, and North Carolina. The Declaration of Independence announced the formation of a new country that would no longer find itself in the clutches of a foreign power. For more than two centuries, hundreds of thousands of men and women have given their lives to protect America’s sovereignty and freedom. America has unique values of liberty which do not exist in all foreign legal systems such as freedom of religion, speech, and press, due process, and the right to privacy. Unfortunately, because state legislatures have generally not been explicit about what their public policy is relative to foreign laws, the courts and the parties litigating in those courts are left to their own devices. State legislatures play a vital role in preserving fundamental constitutional rights and American values of liberty and freedom. No United States citizen or resident should be denied these guaranteed liberties, rights, and freedom.

This Act builds on some of the legislation passed by the 148th General Assembly that addressed the wage gap between men and women. When employers ask prospective employees for their wage or salary history, it perpetuates disparities in pay based on gender from one job into another. This Act prohibits employers from inquiring into an applicant's compensation history. An applicant may voluntarily disclose the information if he or she wishes to do so, and the bill explicitly permits discussion and negation of compensation expectations between an employer and applicants, so long as the employer does not affirmatively seek compensation history in the course of discussion and negotiation. An employer is permitted to seek and confirm such information after an offer, including compensation, has been negotiated, made, and accepted. The effective date of the bill is delayed by 6 months to allow employers to update their policies.

This Act updates the requirements for Courts-Martial to ensure that all members of the Delaware National Guard receive due process through the military justice system. This legislation amends Title 20 to correct a constitutional defect in the current statute, which fails to provide sufficient appellate process. It further codifies longstanding tradition of giving the Attorney General right of first refusal on all prosecutions to avoid double jeopardy. Provides for misdemeanor courts-martial jurisdiction in any military prosecution with appeal rights to the Superior Court of Delaware. Further, the act reconciles Title 20 with applicable federal law.

This Act more effectively and efficiently clarifies the enforcement authority of the Department of Agriculture regarding livestock at large. The offenses will now be civil penalties rather than criminal fines, expenses for impoundment will be reimbursed by the violator, and other sources of media can be used to give public notice of impoundment or sale of any livestock at large. This Act is intended to penalize repeat offenders that knowingly let their livestock run at large.

This bill vests the authority for regulating seed in Delaware with the Delaware Department of Agriculture and repeals any inconsistent act or parts of acts.

This bill creates a special license plate for emergency medical services professionals.
