The act requires the state treasurer to transfer $1.2 million from the universal high school scholarship cash fund (fund) to the Colorado economic development fund and $2.3 million from the fund to the general fund on June 30, 2026.(Note: This summary applies to this bill as enacted.)

In 2022, the general assembly enacted, and the governor subsequently signed into law, House Bill 22-1358 ('Concerning measures to eliminate the presence of lead in the drinking water of certain facilities where children are present, and, in connection therewith, making an appropriation'), which required child care centers, family child care homes, and each public school that serves any of grades preschool through eighth grade to:Test its drinking water sources by having a state-certified laboratory measure the lead content of water drawn from each drinking water source; andSatisfy other requirements concerning the provision of safe drinking water.     House Bill 22-1358 also created the school and child care clean drinking water fund (fund) to help schools, child care centers, and family child care homes comply with House Bill 22-1358.     House Bill 22-1358 included a repeal date of June 30, 2026, for its provisions. The act extends the provisions, with amendments, until June 30, 2029. The act also adds high schools (i.e., schools that serve grades 9 to 12) to the scope of House Bill 22-1358, which means that high schools may receive grants from the fund and must satisfy certain requirements on or before dates specified in the act.     The act requires the department to adopt rules establishing how a child care center shall demonstrate compliance with the requirements concerning the testing for the presence of lead in drinking water.(Note: This summary applies to this bill as enacted.)

Current law requires 3.5% of the gross retail marijuana sales tax revenue to be distributed to local governments. The act eliminates the distribution to local governments and allocates the gross retail marijuana sales tax revenue as follows, on and after July 1, 2026:73.17% to the marijuana tax cash fund (fund);11.33% to the state public school fund;1.5% to the marijuana cash fund; and14% to the general fund.     The act also directs the state treasurer to transfer from the fund to the state public school fund on June 30, 2027, and on each June 30 thereafter, an amount equal to the difference between the balance of the fund and:15% of the amount that the general assembly appropriated from the fund in that fiscal year; andAny amount of the fund designated to be part of the emergency reserve for that fiscal year.(Note: This summary applies to this bill as enacted.)

The bill requires the state treasurer, on behalf of the state, to execute, no later than December 31, 2026, financed purchase of an asset or certificate of participation agreements (financing agreements) to finance a portion of the capital costs related to the capital renewal of a facility at the Colorado school of mines. The financing agreements are to be issued in an aggregate principal amount not to exceed $13 million plus reasonable and necessary administrative, monitoring, and closing costs and interest, including capitalized interest. The anticipated annual state-funded payments for the principal and interest components due under the financing agreements must not exceed the difference between $17.5 million and the amount of the annual state-funded payments for the agreements entered into pursuant to House Bill 24-1231, with principal amortization not occurring before July 1, 2027. The proceeds from the financing agreements will be used for the renewal of critical building systems of Guggenheim hall at the Colorado school of mines.(Note: This summary applies to the reengrossed version of this bill as introduced in the second house.)

Under current law, as a supplement to the state accountability system in the department of education, a local accountability system may be established by a local education provider to measure the performance of public schools and school districts in achieving student success and system effectiveness. The act repeals the local accountability system law, which includes the local accountability system grant program.     The act reduces the members of the accountability, accreditation, student performance, and resource inequity task force from 26 to 25 by removing the task force member who is a superintendent who represents a rural school district that participates in the repealed local accountability system grant program.(Note: This summary applies to this bill as enacted.)

The act transfers $10 million from the tobacco education programs fund to the preschool programs cash fund on June 30, 2027.     For the 2026-27 state fiscal year, the act reduces the general fund appropriation to the department of early childhood (department) for the universal preschool program by $10 million and makes a corresponding $10 million appropriation to the department from the preschool programs cash fund for the universal preschool program.(Note: This summary applies to this bill as enacted.)

During the 2023-24 and 2024-25 state fiscal years, the general assembly appropriated money from the state education fund for expenditures related to the healthy school meals for all program. The act directs the state treasurer to transfer $31,066,831 from the healthy school meals for all program cash fund (program fund) to the state education fund on July 1, 2026.     Under current law, beginning on July 1, 2026, and on each July 1 thereafter, the state treasurer is required to transfer money from the state education fund to the program fund and to the healthy school meals for all program fund account (account) within the program fund. The act delays that requirement so that the treasurer is required to transfer money from the state education fund to the program fund and to the account beginning on July 1, 2028. In addition, the act repeals reporting requirements related to money in the program fund.(Note: This summary applies to this bill as enacted.)

The act eliminates an annual transfer of $2.1 million from the limited gaming fund to the innovative higher education research fund.(Note: This summary applies to this bill as enacted.)

The act eliminates the requirement that the general assembly annually appropriate money to the department of public health and environment for the comprehensive human sexuality education grant program.(Note: This summary applies to this bill as enacted.)

The act repeals the teacher recruitment education and preparation program (TREP) after the 2026-27 budget year. The act repeals the teacher recruitment and preparation program and pathways in early technology early college high schools working group on July 1, 2027.     On July 1, 2026, the act requires the state treasurer to transfer $799,200 from the electrifying school buses grant program cash fund to the state education fund. The general assembly declares that TREP may receive funding from the state education fund.     For the 2026-27 state fiscal year, the act caps the amount that a district receives for a student participating in TREP under the school finance formulas at $7,104.     The act increases the cash fund appropriation to the department of education for state share of districts' total program funding and decreases the cash fund appropriation for extended high school in the 2026-27 long bill in order to fund TREP for the 2026-27 state fiscal year. The amount of the changes is contingent on whether House Bill 26-1364, concerning the calculation of the consumer price index for the 2025 calendar year, becomes law.(Note: This summary applies to this bill as enacted.)
