Relating to determination of eligibility for public benefits of higher education savings account owner; and prescribing an effective date.

Specifies that amount in account established for higher education expenses is disregarded for purposes of determining account owner's financial eligibility to receive assistance or benefit authorized by law, other than means-tested state financial aid for higher education, to extent permitted under federal law. Directs Higher Education Coordinating Commission to study potential effects on financial aid programs of excluding amounts in accounts established for higher education expenses from determination of expected family contributions and to study policies to incentivize saving for higher education expenses among families at or below median income. Applies to eligibility determinations made on or after January 1, 2019. Takes effect on 91st day following adjournment sine die.

Relating to strangulation.

Provides that person commits crime of strangulation if person knowingly impedes normal breathing or circulation of another person by applying pressure to chest of other person. Increases penalty for crime of strangulation when victim is family or household member. Punishes by maximum of five years' imprisonment, $125,000 fine, or both. Directs Oregon Criminal Justice Commission to classify felony strangulation as crime category 5 if committed against family or household member .

Relating to a small business expansion loan fund.

Establishes Small Business Expansion Loan Fund to be administered by Oregon Business Development Department for purpose of making loans of early stage growth capital to individuals and business entities with 50 or fewer employees that may not be able to obtain adequate traditional commercial or private financing to meet operational and growth needs. Provides that no individual loan may be made for amount greater than $2 million. Authorizes Oregon Business Development Commission to transfer moneys in Oregon Business Development Fund to Small Business Expansion Loan Fund when reasonable and financially appropriate for purpose of making loans under Act.

Relating to residential care facilities; and declaring an emergency.

Allows Health Licensing Office to issue residential care facility administrator license to qualified applicant. Renames Nursing Home Administrators Board as Long Term Care Administrators Board. Prohibits board from carrying out disciplinary action against licensee unless at least one board member who represents type of license held by licensee is present at board meetings related to disciplinary action. Requires individual currently employed as residential care facility administrator in Oregon , or individual seeking employment as residential care facility administrator in Oregon prior to January 1, 2022, to apply for residential care facility administrator license by July 1, 2019. Allows Health Licensing Office to issue provisional residential care facility administrator license to qualified individual. Requires individual who holds provisional residential care facility administrator license to obtain residential care facility administrator license not later than January 1, 2022. Declares emergency, effective on passage.

Relating to Maternal Mortality and Morbidity Review Committee; and declaring an emergency.

Establishes Maternal Mortality and Morbidity Review Committee to conduct studies and reviews of incidence of maternal mortality and severe maternal morbidity. Provides that information obtained, created or maintained by committee is confidential and exempt from disclosure as public record and inadmissible as evidence in judicial, administrative, arbitration or mediation proceeding. Requires committee to submit biennial report relating to maternal mortality to interim committees related to health care. Requires committee to submit first biennial report no later than January 1, 2021. Requires each biennial report submitted after January 2, 2021, to include information relating to severe maternal morbidity. Requires committee to submit progress report to interim committees related to health care no later than January 1, 2019. Requires committee to perform studies and reviews of incidence of maternal mortality no later than July 1, 2019. Requires committee to commence studies and reviews of incidence of severe maternal morbidity no later than July 1, 2021. Declares emergency, effective on passage.

Relating to the price of prescription drugs; and declaring an emergency.

Requires prescription drug manufacturer to report annually information to Department of Consumer and Business Services regarding prices of prescription drugs and costs associated with developing and marketing prescription drugs. Authorizes department to impose civil penalties on manufacturer for failing to comply with reporting requirements. Requires health insurers that offer prescription drug benefit to report to department specified information about prescription drug prices and impact of prescription drug prices on premium rates. Authorizes department to adopt by rule fees on manufacturers. Requires department to conduct annual public hearing on prescription drug prices and related information reported by manufacturers. Establishes Task Force on the Fair Pricing of Prescription Drugs. Specifies membership and duties. Requires task force to submit report to Legislative Assembly by November 1, 2018. Declares emergency, effective on passage.

Relating to damages for civil causes of action that take into account race or ethnicity of plaintiff.

Prohibits fact finder from determining plaintiff's damages for civil cause of action using calculation for projected future earning potential of plaintiff that takes into account race or ethnicity of plaintiff. ] Makes calculation of projected future earning potential of plaintiff that takes into account race or ethnicity of plaintiff inadmissible in civil action. Directs court to instruct jury in civil action involving claim for projected future earnings that jury may not consider race or ethnicity of plaintiff.

Relating to transient lodging taxes; and prescribing an effective date.

Expands definition of "transient lodging intermediary" to include person that collects consideration for occupancy of transient lodging and person that receives fee or commission and requires transient lodging provider to use specified third-party entity to collect consideration for occupancy of transient lodging. Provides joint and several liability for state transient lodging tax for each and every owner of transient lodging. Provides rules governing filing of local transient lodging tax returns. Authorizes unit of local government to subpoena and examine witnesses, administer oaths and order production of evidence in hands of any person as necessary and proper in prosecution of inquiries related to local transient lodging tax. ] Takes effect on later of 91st day following adjournment sine die or July 1, 2018.

Relating to requirements for labor contractors; and declaring an emergency.

Removes requirement that nonprofit corporation meet certain requirements for at least five years before filing application for issuance of labor contractor license. ] Exempts property services contractors from requirement to submit payroll records to Commissioner of the Bureau of Labor and Industries. ] Modifies definition of "property services contractor" for purposes of employment law. Allows Commissioner of the Bureau of Labor and Industries to issue license to business entity or private nonprofit corporation provided that certain requirements are met. Exempts labor contractor subject to employee indorsement who is employee of property services contractor from providing personal information to Bureau of Labor and Industries. Clarifies requirements for satisfactory proof of insurance for property services contractors. Permits bureau to establish process for administering examination for property services contractor license online. Specifies time frame in which property services contractor shall provide training to certain employees. Requires property services contractor to provide time and pay records to commissioner or employee of property services contractor within 45 days of request for records. Permits person to bring civil action against property services contractor on or after July 1, 2018. Declares emergency, effective on passage.
