Rep. John Lively

Requires a person that proposes to construct a building or structure located within 1,000 feet of an interstate pipeline to notify the Oregon Utility Notification Center. Prohibits a state agency or municipality from issuing a building permit for a building or structure unless the agency or municipality receives a copy of the notice and a copy of a reply from the owner or operator of the interstate pipeline. Requires an owner or operator of an interstate pipeline each year to provide contact information to the Oregon Utility Notification Center. Takes effect on the 91st day following adjournment sine die.

Prohibits a public utility from increasing the public utility's rates or schedules of rates if the public utility has, for a period of three or more years, outstanding or contingent liabilities arising out of wildfire-related litigation. Takes effect on the 91st day following adjournment sine die.

Requires the Housing and Community Services Department to guarantee a housing developer's payment of system development charges that the local government has agreed to defer until after occupancy. Allows the department to assess a civil penalty and interest against defaulting developers. Allows the Department of Revenue to pursue collections against developers. Becomes operative on January 1, 2026. Establishes the Municipal Development Protection Fund for such purposes. Appropriates moneys to the fund. Declares an emergency, effective on passage.

Appropriates moneys to the Oregon Watershed Enhancement Board, out of the General Fund, for deposit in the Oregon Agricultural Heritage Fund. Establishes a maximum limit for payment of expenses by the board from the Oregon Agricultural Heritage Fund. Declares an emergency, effective on passage.

Expands the rural health care income tax credit to include pharmacist services performed in rural communities. Directs the Office of Rural Health to establish criteria for certifying pharmacists as eligible for the credit. Applies to tax years beginning on or after January 1, 2026. Takes effect on the 91st day following adjournment sine die.

] Directs the Public Utility Commission to establish a pilot program that allows each natural gas company to develop a utility-scale thermal energy network pilot project to provide heating and cooling services to customers. Requires each natural gas company to file a proposal and plan to develop a pilot project or an explanation for why the natural gas company is not submitting a proposal. Identifies criteria the commission shall take into consideration in evaluating a proposal. Establishes labor standards and reporting requirements for certain thermal energy network projects. Takes effect on the 91st day following adjournment sine die.

Directs the Higher Education Coordinating Commission to administer a grant program to fund basic needs programming. Appropriates moneys to the commission to establish the program and award grants for basic needs programming. Sunsets the grant program on January 2, 2027. Establishes the Task Force on Student Housing to review and make recommendations on policy changes regarding barriers that students in higher education face in accessing affordable housing. Sunsets the task force on January 2, 2027. Directs the Higher Education Coordinating Commission to award grants to nonprofit organizations that provide affordable housing support to low-income students in higher education in this state. Appropriates moneys to the commission for purposes of awarding the grants. Declares an emergency, effective on passage.

Provides that an operator may require a person who engages in a sport, fitness or recreational activity in various ways to release the operator from claims for ordinary negligence. Directs the Oregon Business Development Department, with the assistance of the Department of Consumer and Business Services, to study issues facing the recreation industry and report to a committee of the Legislative Assembly related to the environment no later than September 15, 2026. Appropriates moneys for study. Declares an emergency, effective on passage.

Requires all candidates for partisan office and nonpartisan office, regardless of political party affiliation or nonaffiliation, to appear on the same unified primary election ballot, with the five candidates receiving the most votes advancing to the general election ballot. Exempts candidates for President and Vice President of the United States.

] [ Removes the requirement that the amount of net proceeds from the Oregon State Lottery allocated to the County Fair Account not exceed $1.53 million annually. ] Allocates eight-tenths of one percent of net proceeds from the Oregon State Lottery to the County Fair Account and two-tenths of one percent of net proceeds from the lottery to the Horse Racing Account. [ Requires the Oregon Business Development Department to prepare and report a master plan for county fairground capital construction. Specifies content and procedural requirements for the report. ] [ Appropriates moneys to the department out of the General Fund for consultant services related to the report. ] Establishes the Horse Racing Account separate and distinct from the General Fund.
