FIREWORKS-CONSUMER PERMIT

Amends the Pyrotechnic Use Act. Repeals provisions requiring that a consumer fireworks display be handled by a person who has received training and providing for a consumer fireworks display permit. Eliminates cross-references to the repealed provisions in certain definitions and in provisions concerning the sale of consumer fireworks. Effective immediately.

MUNI CD-LEASES

Amends the Illinois Municipal Code. Provides that the corporate authorities of any municipality may license and regulate landlords, as defined by the corporate authorities of the municipality, within that municipality. Specifies that the corporate authorities of any municipality may require that landlords include in any and all leases prohibitions of criminal activity. Effective immediately.

HORSE RACING EQUITY FUND-TRUST

Amends the Illinois Horse Racing Act of 1975 and the State Finance Act. Provides that the Horse Racing Equity Fund is a non-appropriated trust fund (rather than a special fund in the State treasury). Effective immediately.

USE/OCC-FIREWORKS

Amends the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, and the Retailers' Occupation Tax Act. Provides that 80% of the proceeds attributable to the sale of fireworks shall be deposited into the Common School Fund. Provides that the remainder shall be deposited into the State and Local Sales Tax Reform Fund (in the case of proceeds collected under the Use Tax Act and the Service Use Tax Act) or the County and Mass Transit District Fund and the Local Government Tax Fund (in the case of the Service Occupation Tax Act and the Retailers' Occupation Tax Act).

CRIM CD-RECKLESS HOMICIDE

Amends the Criminal Code of 1961. Provides that the penalty for reckless homicide when the defendant was involved in a motor vehicle, snowmobile, all-terrain vehicle, or watercraft accident that resulted in the death of another person, when the driving under the influence of alcohol or drugs was a proximate cause of the death is a Class 2 felony, for which the defendant, unless the court determines that extraordinary circumstances exist and require probation, shall be sentenced to: (i) a term of imprisonment of not less than 3 years and not more than 14 years if the violation resulted in the death of one person; or (ii) a term of imprisonment of not less than 6 years and not more than 28 years if the violation resulted in the deaths of 2 or more persons. Provides that in such cases, the trier of fact may infer that the defendant's actions were performed recklessly. Effective immediately.
