HB 4803: ELECTRIC TRANSMISSION SITING

Creates the Electric Transmission Colocation and Siting Priority Act. Defines terms. Requires that, in the siting of new electric transmission facilities, available corridors be used in the following order of priority: (1) existing public utility corridors; (2) State highway corridors; and (3) new corridors. Provides that a public utility or transmission developer may construct, place, or maintain a high-voltage transmission line on a public right-of-way or along a highway if (i) the public utility or transmission developer submits a colocation request for the high-voltage transmission line to the Secretary of Transportation and (ii) the Secretary reviews and approves the colocation request. Provides that the Secretary may deny a colocation request if the Secretary determines that the construction, placement, or maintenance of a high-voltage transmission line on a public right-of-way or along a highway would endanger public safety or would interfere with the proper function of the highway. Provides that a public utility or transmission developer may submit a written request to the Department of Transportation for an evaluation of certain corridors for possible locations for a high-voltage transmission line. Provides that, within 30 days after receipt of a written request, the Secretary shall assign a project coordinator to the request. Provides that a project coordinator, upon assignment to a request, shall begin the evaluation in coordination with the applicable public utility or transmission developer. Requires a public utility or transmission developer to develop a constructability report in consultation with the Department and requires the public utility or transmission developer and the Department to follow the terms and conditions of the constructability report during the planning and approval process for the siting of a high-voltage transmission line. Sets forth requirements for the content of the constructability report. Provides that, if the Department requires that a high-voltage transmission line on a public right-of-way be relocated by a specific date, the Department shall give the applicable public utility or transmission developer notice of the required relocation no less than 10 years before the date of the required relocation. Makes other changes. Effective January 1, 2027.

In provisions concerning distributed generation rebates, provides that the owner or operator of distributed generation that, before January 1, 2025 (rather than before the threshold date), is eligible for net metering under the Act may apply for a base rebate for an associated energy storage device behind the same retail customer meter as the distributed generation, regardless of whether the distributed generation applies for a rebate for the distributed generation device. Provides that, after the threshold date, a stand-alone energy storage system that is neither paired with distributed generation nor with any electric load beyond the electric load that is used by the energy storage system itself (rather than a stand-alone energy storage system) shall be compensated with a rebate of $250 per kilowatt-hour of nameplate capacity. Amends the Environmental Protection Act. In provisions concerning greenhouse gases, provides that the Environmental Protection Agency and the Illinois Power Agency shall file a plan to reduce or delay certain emissions reductions requirements with the Illinois Commerce Commission for review in conjunction with the integrated resource plan under certain provisions of the Public Utilities Act. Makes other changes. Effective immediately.

HB 3464: RUST BELT TO GREEN BELT PILOT

Creates the Illinois Rust Belt to Green Belt Pilot Program Act. Creates the Illinois Rust Belt to Green Belt Fund as a special fund in the State treasury and makes a conforming change in the State Finance Act. Provides that the Fund shall be used by the Department of Commerce and Economic Opportunity to encourage and facilitate the employment of construction workforces located in underrepresented populations. Provides that applicants that are applying for a new utility-scale offshore wind project with the Illinois Power Agency shall file with the Department, as part of the applicant's application, an equity and inclusion plan. Amends the Illinois Power Agency Act. In provisions concerning the procurement of renewable energy credits, provides that in addition to the amount of renewable energy credits to be procured from wind projects, the Illinois Power Agency shall procure at least 700,000 renewable energy credits, delivered annually for at least 20 years, from one new utility-scale offshore wind project. In provisions concerning the development of a long-term renewable resources procurement plan, provides that the total of renewable energy resources procured under the procurement plan shall be reduced for all retail customers based on the amount necessary to limit the annual estimated average net increase due to the costs of these resources included in the amounts paid by eligible retail customers in connection with electric service to no more than 4.25% of the amount paid per kilowatthour by those customers during the year ending May 31, 2009, and to no more than 4.5% of that amount as of the billing month following the expected date that a new utility-scale offshore wind project commences commercial operations and is expected to begin delivering power to the PJM Interconnection, LLC transmission grid. Provides that the Agency shall conduct at least one new utility-scale offshore wind procurement within 360 days after the effective date of the amendatory Act. Defines terms. Makes other changes. Effective immediately.

SB 2489: VIRTUAL POWER PLANT PROGRAM

Amends the Public Utilities Act. Creates the virtual power plant program. Defines terms. Provides that, within 60 days after the effective date of the amendatory provisions, each electric utility serving more than 300,000 customers as of January 1, 2025 shall propose one or more tariffs applicable to demand response technologies. Sets forth requirements for the content of the tariffs. Provides that the Illinois Commerce Commission shall approve or approve with modifications the tariffs filed by each utility within 240 days of filing. Provides that, not more than 6 months after 2 full delivery years of operation of the tariffs, the Commission shall issue a report to the General Assembly assessing the value and efficacy of the demand response virtual power plant program, including proposals for expansions or modifications. Provides that the Commission shall implement the amendatory provisions in a complementary manner with other virtual power plant programs under the Commission's jurisdiction in order to make the programs available to utility customers compatible for the benefit of the electric grid and to enhance electric service reliability. Makes other changes.
