SB 3529: MAKE-READY INFRASTRUCTURE ACT

Creates the Make-Ready Infrastructure Rules Act. Sets forth findings. Defines terms. Provides that an electric utility shall propose a new rule, before the electric utility submits its next Multi-Year Integrated Rate Plan, that authorizes the electric utility to design and deploy all electrical distribution infrastructure on the utility side of the meter for all customers who have installed separately metered or submetered infrastructure to support electric vehicle charging stations, other than charging stations in single-family residences. Provides that an electric utility shall recover its revenue requirement for the design and deployment of such electrical distribution infrastructure through periodic Multi-Year Integrated Rate Plan proceedings or through other methods determined by the Commission by rule. Provides that the Commission shall require an electric utility to provide an accurate and full accounting of all the electric utility's expenses related to electrical distribution infrastructure and shall apply appropriate penalties to an electric utility that is not accurately tracking all expenses. Provides that the new proposed rule, once effective, shall be offered to customers as an alternative to the transmission line extension rules in place as of the effective date of the Act for electric vehicle infrastructure and any customer allowances established under the rule shall be based on the full useful life of the electrical distribution infrastructure. Makes other changes.

SB 3273: UTILITIES-INTERCONNECTIONS

Amends the Public Utilities Act. Sets forth procedures for the processing of interconnection requests from applicants for distributed renewable generation projects on public school land. Provides that, for all net metering credits or other credits owed to a customer who has elected to install a distributed renewable generation project on public school land, all credits intended for the benefit of the consumer must be credited by the public utility or retail energy supplier within 90 days after the public utility or retail energy supplier determines that the criteria for the credit have been met. Provides that the Illinois Commerce Commission shall adopt revisions to its standards for the interconnection of eligible renewable generating equipment and net metering credit rules to conform with the requirements of the provisions of the amendatory Act. In provisions concerning customer self-generation of electricity, provides that, for distributed renewable generation projects on public school land, any fees for interconnection applications charged by the electric cooperative or municipal system must be substantially similar to the fees charged by public utilities for the interconnection of the same or similar projects and must not exceed 150% of the cost of the base interconnection fees of the other public utilities. Effective immediately.

HB 4803: ELECTRIC TRANSMISSION SITING

Creates the Electric Transmission Colocation and Siting Priority Act. Defines terms. Requires that, in the siting of new electric transmission facilities, available corridors be used in the following order of priority: (1) existing public utility corridors; (2) State highway corridors; and (3) new corridors. Provides that a public utility or transmission developer may construct, place, or maintain a high-voltage transmission line on a public right-of-way or along a highway if (i) the public utility or transmission developer submits a colocation request for the high-voltage transmission line to the Secretary of Transportation and (ii) the Secretary reviews and approves the colocation request. Provides that the Secretary may deny a colocation request if the Secretary determines that the construction, placement, or maintenance of a high-voltage transmission line on a public right-of-way or along a highway would endanger public safety or would interfere with the proper function of the highway. Provides that a public utility or transmission developer may submit a written request to the Department of Transportation for an evaluation of certain corridors for possible locations for a high-voltage transmission line. Provides that, within 30 days after receipt of a written request, the Secretary shall assign a project coordinator to the request. Provides that a project coordinator, upon assignment to a request, shall begin the evaluation in coordination with the applicable public utility or transmission developer. Requires a public utility or transmission developer to develop a constructability report in consultation with the Department and requires the public utility or transmission developer and the Department to follow the terms and conditions of the constructability report during the planning and approval process for the siting of a high-voltage transmission line. Sets forth requirements for the content of the constructability report. Provides that, if the Department requires that a high-voltage transmission line on a public right-of-way be relocated by a specific date, the Department shall give the applicable public utility or transmission developer notice of the required relocation no less than 10 years before the date of the required relocation. Makes other changes. Effective January 1, 2027.

SB 3970: UTILITY-COST-BENEFIT ANALYSIS

Amends the Public Utilities Act. Provides that, prior to approving or directing any decarbonization pathway, pilot program, infrastructure investment, or regulatory mandate related to the natural gas distribution system, the Commission shall conduct a comprehensive, independent cost-benefit analysis that evaluates: (i) life-cycle greenhouse gas emissions reductions; (ii) cumulative energy system costs, including any stranded asset risks estimated at no less than $80,000,000,000 by 2050 under high-electrification scenarios; (iii) ratepayer bill impacts for all customer classes, with a focus on low-income and non-migrating customers; (iv) system reliability and safety under State standards; (v) equity impacts, including cost shifts to vulnerable populations; (vi) workforce and job impacts; and (vii) the extent to which competitive market mechanisms, such as private investment, third-party financing, and supplier competition, can achieve equivalent or superior outcomes at lower costs. Provides that the Commission shall not approve a decarbonization pathway, pilot program, infrastructure investment, or regulatory mandate unless the pathway, program, investment, or mandate demonstrates net benefits under the cost-benefit analysis without prioritizing an approach where regulated solutions increase costs without proportional benefits. Provides that the Commission shall use transparent, market-based data from sources such as PJM Interconnection, LLC (PJM), Midcontinent Independent System Operator, Inc. (MISO), and Chicago Citygate and coordinate with applicable biennial long-term gas infrastructure plans.

SB 4028: UTILITY-INTERCONNECTION RULES

Amends the Public Utilities Act. In provisions concerning the recovery of costs associated with the provision of delivery and other services, provide that the Illinois Commerce Commission shall, within 180 days after the effective date of the amendatory Act, initiate and complete a rulemaking proceeding to revise 83 Ill. Adm. Code 466 and 83 Ill. Adm. Code 467 to address barriers to timely and cost-effective interconnections for distributed generation facilities with a nameplate capacity of at least 40 kilowatts but no greater than 2 megawatts, including stand-alone solar photovoltaic systems, battery energy storage, hybrid gas-electric systems, and renewable natural gas integrations. Requires the revisions to include certain factors. Provides that the Commission shall coordinate the revisions with a Future of Gas proceeding pursuant to the final Order of the Commission in Docket No. 24-0158 to ensure compatibility with gas decarbonization pathways and to prioritize market-driven distributed resources that enhance reliability and affordability. Provides that the revised rules shall take effect no later than July 1, 2026. Effective immediately.

In provisions concerning distributed generation rebates, provides that the owner or operator of distributed generation that, before January 1, 2025 (rather than before the threshold date), is eligible for net metering under the Act may apply for a base rebate for an associated energy storage device behind the same retail customer meter as the distributed generation, regardless of whether the distributed generation applies for a rebate for the distributed generation device. Provides that, after the threshold date, a stand-alone energy storage system that is neither paired with distributed generation nor with any electric load beyond the electric load that is used by the energy storage system itself (rather than a stand-alone energy storage system) shall be compensated with a rebate of $250 per kilowatt-hour of nameplate capacity. Amends the Environmental Protection Act. In provisions concerning greenhouse gases, provides that the Environmental Protection Agency and the Illinois Power Agency shall file a plan to reduce or delay certain emissions reductions requirements with the Illinois Commerce Commission for review in conjunction with the integrated resource plan under certain provisions of the Public Utilities Act. Makes other changes. Effective immediately.

SB 3104: PLUG-IN SOLAR ENERGY SYSTEMS

Amends the Public Utilities Act. Defines "plug-in solar energy system". Provides that an electricity provider shall not require an eligible customer who uses, or intends to install and use, a plug-in solar energy system to do certain actions. Provides that an eligible customer may, but shall not be required to, conform the eligible customer's plug-in solar energy system to the interconnection requirements under provisions concerning net metering and any rules adopted pursuant to those provisions. Provides that a plug-in solar energy system that does not interconnect to the electrical system in a manner that is consistent with the applicable rules adopted by the Illinois Commerce Commission shall not be eligible for net electricity metering. Provides that a plug-in solar energy system shall not qualify for any distributed generation rebate. Provides that an electricity provider shall not be liable for any damage or injury caused by an eligible customer's plug-in solar energy system. Provides that homeowners' associations, common interest community associations, and condominium unit owners' associations shall not adopt or enforce any covenant, bylaw, regulation, or other rule that unreasonably restricts or prohibits, or has the effect of prohibiting, the installation or use of a plug-in solar energy system that has a maximum power output to a receptacle outlet of 391 watts or less. Provides that landlords shall not adopt or enforce any lease or contract that unreasonably restricts or prohibits, or has the effect of prohibiting, the installation or use of a plug-in solar energy system that has a maximum power output to a receptacle outlet of 391 watts or less.

SB 2789: HIGH VOLTAGE TRANSMISSION LINE

Amends the Illinois Highway Code. Provides that a high voltage transmission line may be constructed, placed, or maintained across any public right-of-way or along any highway, federally aided State highway, controlled access highway, interstate highway, or roadway, except as deemed necessary by the Secretary of Transportation to protect public safety or ensure the proper function of the highway. Provides that in the case of the co-location of a high voltage transmission line with Department of Transportation highway right-of-way, the Secretary of Transportation shall engage in coordination activities with a utility or developer to review requested highway corridors for a possible permitted location of a high voltage transmission line. Provides that when a permissible route along a highway corridor has been identified by the Department and the utility or developer, the Department must engage in consultation with the utility or developer to develop a constructability report to be used by both parties when co-location projects are being planned and approved. Amends the Public Utilities Act. Establishes an order of priority when siting a location for a new electric transmission facility.

HB 4516: PORTABLE SOLAR GENERATION

Amends the Public Utilities Act. Provides that a portable solar generation device shall be exempt from (i) net metering program and interconnection requirements under provisions concerning net electricity metering and (ii) any rules adopted pursuant to those provisions. Provides that a portable solar generation device shall include a device or feature that prevents the portable solar generation device from energizing a building's electrical system during a power outage. Provides that an electricity provider shall not require an eligible customer who uses, or intends to install and use, a portable solar generation device to do any of the following: (1) obtain the electricity provider's approval before installing or using the portable solar generation device; (2) pay a fee or charge related to the installation or use of the portable solar generation device; or (3) install additional controls or equipment beyond what is integrated into the portable solar generation device. Provides that an electricity provider shall not be liable for any damage or injury caused by an eligible customer's portable solar generation device. Effective June 1, 2026.
