Transportation

Requires the Department of Transportation to administer a statewide program for certification of active intelligent speed assistance systems and select a vendor for the installation and maintenance of systems. Limits the civil liability of motor vehicle manufacturers, distributors, and retailers for active intelligent speed assistance systems. Makes circumventing or tampering with an active intelligent speed assistance system a misdemeanor. Establishes penalties for operating a motor vehicle in violation of a court-ordered active intelligent speed assistance system requirement. Allows the Judiciary to impose the installation of active intelligent speed assistance systems as an additional penalty and as part of a license suspension or revocation for repeat offenders of certain traffic violations. Increases the expenditure ceiling and appropriates funds out of the State Risk Management Revolving Fund to distribute property and liability insurance proceeds related to the 2023 Maui wildfires to be expended by the School Facilities Authority, Department of Transportation, and Department of Land and Natural Resources to rebuild and restore certain state facilities in Lahaina. Requires the Department of Accounting and General Services to submit to the Legislature a master coordinated project plan developed in collaboration with certain state agencies and in consultation with the County of Maui and other relevant entities. Requires the Department of Education to transfer exclusive site control over the new King Kamehameha III Elementary School property to the SFA while the School is under construction. Requires DAGS to transfer to the SFA any materials deemed necessary for the construction of the School and to provide further support as necessary upon request. Requires the SFA to submit monthly progress reports to the Governor and Legislature. Allows the Governor to transfer certain authorities and responsibilities from the SFA to another state agency under certain conditions. Requires full funding for the projects for which funds are appropriated to be available before expenditure. (CD1)

Part I: Requires drivers approaching stationary vehicles displaying warning signals to slow down to a reasonable and prudent speed and make a lane change if possible and safe to do so or come to a complete stop if necessary. Part II: Provides certain exemptions from passenger restrictions related to the operation of a pickup truck with a passenger seated in the bed or load-carrying area of the vehicle. Increases the minimum age to ride in the bed or load-carrying area of a pickup truck while in operation from twelve years of age to sixteen years of age. (CD1)

Amends the prohibition on the use of the far left lane by commercial vehicles on roadways with three or more lanes going in the same direction. Restricts motor vehicles towing a vehicle or trailer from using the far left lane, subject to specified exemptions. Establishes penalties for violations. Applies restrictions and penalties to a county with a population of 500,000 or more. (CD1)

Authorizes the Department of Transportation to assume responsibilities under the National Environmental Policy Act of 1969 for highway projects, as well as railroad, public transportation, or multimodal projects within the State, allowing streamlined environmental reviews. Provides a limited waiver of sovereign immunity to comply with federal requirements. (CD1)

Amends requirements to commercial driver's license qualification standards to meet current federal regulations to allow the State to issue a non-domiciled commercial learner's permit and non‑domiciled commercial driver's license for applicants who are unable to provide proof of citizenship or lawful permanent residency. (CD1)

Requires the design of all new state building construction where parking is to be included to provide that a number of the parking stalls, as determined by the Department of Accounting and General Services, shall be electric vehicle charger-ready. Requires the Hawaii State Energy Office, in consultation with the Department of Accounting and General Services and Department of Transportation, to conduct a survey and identify certain high-priority state facilities. Establishes a goal of the State to retrofit state facilities to be electric vehicle charger-ready. Requires a report to the Legislature. Appropriates funds. Effective 7/1/3000. (SD2)

Requires the Department of Transportation to assess a per passenger head fee against cruise ships docking in the State's commercial harbors in addition to existing port user fees. Establishes the Cruise Ship Special Fund. Repeals existing law imposing the Transient Accommodations Tax on cruise ships, effective retroactive to 1/1/2026. Appropriates funds. Effective 7/1/3000. Establishes the Noise Detection Camera Program in the Department of Transportation for the installation of noise detection cameras for the enforcement of noise control laws. Appropriates moneys. Effective 7/1/2050. (SD1)

Requires the Department of Transportation to conduct a feasibility study on implementing a clean fuel standard for alternative fuels in the State. Requires, no later than 1/1/2028, the Department of Transportation to adopt rules governing a clean fuel standard for alternative fuels in the State. Effective 7/1/3000. (HD1)
