Technical Correction to the Shoshone-Paiute Tribes of the Duck Valley Reservation Water Rights Settlement Act of 2021 This bill authorizes deposit of specified interest payments into the Shoshone-Paiute Tribes Water Rights Development Fund and the Shoshone-Paiute Tribes Operation and Maintenance Fund. These funds were established under the water rights settlement agreement for the Shoshone-Paiute Tribes of the Duck Valley Reservation.

Minor League Baseball Relief Act This bill establishes a program for the relief of certain minor league baseball clubs and independent professional baseball clubs that experienced large business losses. The bill provides funding for the Small Business Administration to make grants to such clubs that experienced decreases in gross revenue in 2020 of at least 75%, as measured against revenues in 2019 (or, if revenues were negatively affected by a natural disaster or weather disruption in 2019, by the average of revenues over the prior three-year period). The source of funding for the grants shall be funds appropriated under enacted COVID-19 relief legislation that have not been obligated and are no longer being used to carry out activities authorized under those laws. Grant amounts provided to any club may not exceed $10 million.

Reducing Hereditary Cancer Act of 2021 This bill provides for Medicare coverage of germline mutation testing for individuals with a personal or family history of a hereditary cancer gene mutation or suspected history of hereditary cancer, as well as for associated coverage of risk-reducing surgeries and screenings.

Ending Platform Monopolies Act This bill prohibits large online platforms, as designated by the Department of Justice or Federal Trade Commission, from offering certain products or services from another line of business that is owned or controlled by the platform. Specifically, such platforms are prohibited from owning or controlling another line of business that (1) uses the platform to sell products or services, (2) offers a product or service that the platform requires a business user to purchase or use as a condition for access to the platform, or (3) gives rise to a conflict of interest. Under the bill, a conflict of interest occurs when a platform operator's ownership or control of another line of business creates an incentive and the ability for the platform to provide an advantage to the platform's own products or services over those of a competitor on the platform, or exclude or disadvantage the products or services of a competitor on the platform. For example, under the bill, Amazon.com, Inc. may be prohibited from offering for sale on Amazon.com privately labeled products or services (e.g., Amazon Essentials, AmazonBasics, etc.) if designated as a large online platform. Finally, the bill prohibits a director, officer, employee, or agent of a platform from simultaneously serving in the same or a similar role with a formerly affiliated entity.

Augmenting Compatibility and Competition by Enabling Service Switching Act of 2021 or the ACCESS Act of 2021 This bill requires large online platforms (e.g., YouTube, Salesforce) to facilitate consumers and businesses switching from one platform to another. Specifically, the platforms must maintain interfaces that (1) securely transfer user data to other platforms (i.e., portability), and (2) allow other platforms to connect and communicate with their systems (i.e., interoperability). The bill provides the Federal Trade Commission (FTC) and the Department of Justice with the authority to designate specific platforms to which these requirements apply. After a platform is designated, the FTC must issue standards of interoperability specific to the platform. A platform may not change its interoperability interface without petitioning the FTC, and the platform must provide to competing businesses documentation for accessing the interface. Further, the FTC must establish a technical committee to assist with the implementation of these requirements. The bill provides the FTC with authority to enforce these requirements including through recovery of civil penalties and injunctive relief.

Traditional Cigar Manufacturing and Small Business Jobs Preservation Act of 2021 This bill exempts traditional large and premium cigars from Food and Drug Administration (FDA) regulation and FDA-assessed user fees.

National Strategic and Critical Minerals Production Act of 2021 This bill sets forth environmental review requirements for the mine permitting process and limits the review to 30 months. Under the bill, projects that provide minerals vital to job creation, energy infrastructure, coastal resilience and restoration, economic competitiveness, and national security must be considered to be infrastructure projects as described in Executive Order 13807, titled Establishing Discipline and Accountability in the Environmental Review and Permitting Process for Infrastructure Projects and dated August 15, 2017.This order directed agencies to ensure that the environmental review and permitting process for infrastructure is coordinated, predictable, and transparent. The Bureau of Land Management (BLM)or the Forest Service must appoint a project lead for the mine permitting process to coordinate with other agencies to ensure that the agencies minimize delays, set and adhere to timelines for completion of the permitting process, set clear permitting goals, and track progress against goals. The project lead must also determine the amount of financial assurance required for reclamation of a mineral exploration or mining site. The bill considers the requirements of the National Environmental Policy Act of 1969to be satisfied if the BLM or the Forest Service determines that the agency issuing the permit will address specified factors, such as environmental impacts of the permit or alternatives to issuance of the permit. Additionally, the bill exempts projects on National Forest System land from regulations that prohibit timber tree cutting and road construction in areas without roads.

Reopening to address Every COmplete Record request for Devoted Servicemembers Act of 2021 or the RECORDS Act of 2021 This bill directs the Office of the Archivist of the United States to take specified steps to address record request backlogs. Specifically, the office must take actions to ensure that (1) the number of individuals employed by the National Personnel Records Center is equal to or exceeds the number of such individuals employed on March 2, 2020, and (2) the percentage of such individuals regularly reporting to work in person is equal to or exceeds the percentage of such individuals regularly reporting to work in person on that date. The office shall submit to specified congressional committees a report that provides a comprehensive plan to address the record request backlog of the National Personnel Records Center and improve the efficiency and responsiveness of operations at the center, identifies measurable goals with respect to the comprehensive plan and metrics for tracking progress toward such goals, and describes strategies to prevent future record request backlogs.

Trillion Trees Act This bills establishes a variety of requirements and incentives to plant trees and conduct other land management practices for the purposes of capturing and storing carbon in domestic and international trees and forests. Additionally, the bill provides incentives to research or develop other carbon sequestration tools. Specifically, the bill directs the Department of Agriculture (USDA) to set targets to increase forest carbon stock through January 1, 2100, for the purposes of sequestering and storing carbon in U.S. forests. It also establishes and provides funding for the Trillion Trees Challenge Fund to provide grants to nonfederal entities for activities related to reforestation efforts on public or private lands. In addition, it raises the cap on the Reforestation Trust Fund to enhance forest health in the National Forest System and requires the USDA to establish a Tree City USA Grant Program. The bill also allows the U.S. Agency for International Development to enter into an agreement with a nonprofit organization to establish an International Forest Foundation to promote reforestation and prevent deforestation. Additionally, it establishes requirements and incentives to address seedling shortages and support nurseries. Finally, the bill provides market incentives to research or develop other carbon sequestration tools relating to biochar, sustainable building practices, biochemical and bioplastic products, and biomass energy.

This bill authorizes the Department of Education to provide grants for public awareness education programs on the history of the treatment of Italian Americans during World War II. In awarding such grants, priority shall be given to Italian American historical and cultural organizations.
