Renewal of licenses; persons serving in the armed services on active duty outside the Commonwealth. Authorizes any person serving in the armed services of the United States on active duty who will be serving outside the Commonwealth at the time of the expiration of his valid driver's license to request the Department of Motor Vehicles (the Department) to send the notice of renewal required under current law, that includes information regarding whether he must be reexamined and when he may be reexamined, more than one year prior to his driver's license's expiration. The bill requires the Department to (i) send such notice of renewal within two business days of receipt of such request and (ii) if such person provides the date of his departure from the Commonwealth in such request, ensure that the time when he may be reexamined, if applicable, occurs prior to his departure from the Commonwealth, such that he may renew his driver's license prior to his departure.
Managed care organizations; pharmacy benefits manager; data collection and reporting requirements; civil penalty. Requires the Department of Medical Assistance Services to develop, and managed care organizations and pharmacy benefits managers to comply with, standardized methodologies for the collection and reporting of data related to expenditures, rebates, and the source of all cost components to the Department and the Centers for Medicare and Medicaid Services. The bill requires managed care organizations to solicit and undergo an independent audit of their reporting practices every two years and directs the Department to establish a compliance unit that may impose penalties on noncompliant managed care organizations and pharmacy benefits managers.
Inspection of certified nursing facilities; compliance with federal reporting requirements; civil penalty. Directs the Department of Health to include validation of compliance with federal reporting requirements in its inspection process for certified nursing facilities. The bill requires certified nursing facilities to submit a quarterly report detailing (i) all self-reported incidents and compliance issues submitted to the Centers for Medicare and Medicaid Services during the preceding quarter; (ii) any corrective actions taken in response to self-reported incidents; and (iii) updates on ongoing investigations related to reported incidents. The Department may impose a penalty on a certified nursing facility that fails to comply with the reporting requirements imposed by the bill, which may include a civil penalty not to exceed $1,000, increased frequency of inspections, and suspension or revocation of the certified nursing facility's license.
A BILL to amend the Code of Virginia by adding in Article 1 of Chapter 5 of Title 18.2 a section numbered 18.2-138.1, relating to approaching a first responder with specified intent after a warning; penalty.
Charter; City of Virginia Beach; certain land use approvals. Amends the charter for the City of Virginia Beach by providing that no application to rezone property to a higher density or a more intense zoning district south of the blue line, as defined in the bill, shall be approved except by a recorded affirmative vote of three-fourths of all of the members elected to the city council. The bill further provides that no extension of public water and sanitary sewer shall extend south of the blue line absent a public hearing and specific findings by the city council.
State Trails Office; Statewide Trails Plan; Potomac Heritage National Scenic Trail. Directs the State Trails Office within the Department of Transportation to include the Potomac Heritage National Scenic Trail in the Statewide Trails Plan.
Unpaved secondary highway funds; maximum annual allocation. Increases the maximum total annual allocation made by the Commonwealth Transportation Board for certain unpaved secondary highways from $25 million to $50 million.
Alcoholic beverage control; designated outdoor refreshment areas. Allows up to two permitted breweries or wineries to sell alcoholic beverages for consumption in an area designated for the designated outdoor refreshment area during an event held by the designated outdoor refreshment area licensee. The bill allows designated outdoor refreshment area licensees that are nonprofit organizations to sell tickets or charge for wristbands for an event to cover expenses of the event and also only requires such licensee to provide adequate security for an event as deemed appropriate by the local law-enforcement agency. The bill also provides that a designated outdoor refreshment area licensee that is a nonprofit organization shall be permitted to receive in-kind and financial sponsorships and donations from a manufacturer and may collect participation fees from breweries, wineries, and retail licensees for events held under a designated outdoor refreshment area license. Lastly, the bill allows (i) a designated outdoor refreshment area licensee that is a nonprofit organization to obtain a banquet special event license or a mixed beverage special event license and (ii) a brewery, winery, cidery, or distillery to obtain a manufacturer's beer or wine event license for an event to be held within the boundaries of the designated outdoor refreshment area, including an event hosted by the designated outdoor area licensee that is a nonprofit organization, as long as any such event held pursuant to clause (i) or (ii) is not held at the same time as an event utilizing the designated outdoor refreshment area license. The bill provides that any such event held pursuant to clause (i) or (ii) shall not count toward the 16 events per-year limit for designated outdoor refreshment area licenses.
Department of Behavioral Health and Development Services; group homes; oversight and accountability; report. Directs the Department of Behavioral Health and Developmental Services to analyze and make recommendations on the oversight and accountability of group homes and to submit a report of its findings and recommendations to the Chairs of the House Committee on Health and Human Services and the Senate Committee on Education and Health by November 1, 2026.
Electric utilities; renewable energy portfolio standard eligible sources; zero-carbon electricity generating nuclear facilities. Provides that, for the purposes of the renewable energy portfolio standard, eligible sources include zero-carbon electricity generating nuclear facilities located in the Commonwealth.
Bicycle riders; traffic control device exceptions; liability. Authorizes a bicycle rider to proceed through an intersection controlled by a stop sign, "Yield Right-of-Way" sign, or red light if such rider (i) is at least 16 years of age or is accompanied by a person who is at least 16 years of age who is also riding a bicycle and who precedes him through such intersection with no more than 10 feet of distance separating the bicycles and (ii) yields the right-of-way to the driver of any vehicle lawfully within such intersection or approaching or entering such intersection from another direction. The bill provides that proceeding through such an intersection without yielding as required by the bill constitutes negligence per se if such action is the proximate cause of a collision or vehicular accident.
Individual income tax; subtractions; military benefits. Incrementally increases the current cap of $40,000 of military benefits that may be subtracted from Virginia taxable income such that by taxable year 2030 and for all taxable years thereafter, the total amount of military benefits may be subtracted from such income.
