Light pollution education and dark sky preservation. Provides that the Department of Environmental Quality (DEQ) shall serve as the lead agency for public education and outreach related to light pollution. The bill requires DEQ, in coordination with the Department of Energy, the Department of Wildlife Resources, and the Department of Conservation and Recreation (DCR), to develop and implement an education and outreach program to (i) inform the public about the impacts of light pollution on public health, safety, wildlife, and the environment; (ii) promote best practices for outdoor lighting, including energy-efficient and properly shielded outdoor lighting fixtures; and (iii) encourage voluntary adoption of lighting practices that reduce light pollution and energy waste. The bill further provides that DCR may designate qualifying areas within the Commonwealth as Dark Sky Preserves, as defined in the bill, and that a Dark Sky Preserve designation shall be voluntary and advisory and shall not create additional land use or lighting restrictions beyond those established by local ordinance. The bill has a delayed effective date of January 1, 2027.
Department of Military Affairs; biennial training; Virginia National Guard; report. Requires the Department of Military Affairs (the Department) to conduct a biennial training among all officers of the Virginia National Guard, the curriculum for which shall be established by the Adjutant General in consultation with the Secretary of Veterans and Defense Affairs, the Attorney General, and the Governor. Such training shall (a) remind officers of their oath to upholding the Constitution; (b) inform officers on the process for identifying and responding to suspected unlawful order; and (c) remind officers of their obligation to remain nonpartisan in the execution of their duties. The bill requires the Department to conduct the training among all officers of the Virginia National Guard by November 1, 2026. The bill directs the Adjutant General to require officers holding command and company and flight commanders to inform their Guard members on the processes for addressing any suspected unlawful order. The bill additionally directs the Adjutant General to establish a standard operating procedure by which officers can report the issuance of an unlawful order to the Office of the Attorney General, the Inspector General of the Virginia National Guard, and the United States Department of War and Military Services Offices of Inspector General.
Board of Wildlife Resources; prescribing seasons and bag limits for taking wild birds, animals, and fish. Provides that when an investigation of the Board of Wildlife Resources shows, for any species of wild bird, animal, or fish within the jurisdiction of the Board, that there is an unusual scarcity of such wild bird, animal, or fish or a risk that the population of such wild bird, animal, or fish in any city or county could be eliminated, the Board shall prescribe the seasons and bag limits for such wild bird, animal, or fish in such city or county accordingly to promote the recovery and stabilization of such wild bird, animal, or fish population.
Virginia Law Officers' Retirement System; membership. Extends membership in the Virginia Law Officers' Retirement System to full-time sworn unit investigators appointed by the Attorney General. The bill has a delayed effective date of July 1, 2027, and provides that such membership applies only to service earned on or after July 1, 2027.
Electric utilities; RPS requirements; Air Pollution Control Board; regulations. Delays for 20 years the timeline by which Appalachian Power and Dominion Energy Virginia are required to produce 100 percent of their electric energy from 100 percent renewable resources. Under the bill, the annual percentage requirements are paused after the 2023 compliance year and do not resume until 2044. The bill provides that Appalachian Power and Dominion Energy Virginia are required to meet the 100 percent requirement by 2070 and 2065, respectively. Additionally, the bill provides that the Air Pollution Control Board is required to adopt regulations for the period of 2051 to 2070 to reduce carbon emissions from electric power generating facilities. Under current law, the Board is required to adopt regulations to reduce emissions for the period of 2031 through 2050.
Department of Conservation and Recreation; federal National Flood Insurance Program; guidance document. Requires the Department of Conservation and Recreation, in collaboration with the Department of Health, Department of Environmental Quality, Department of Transportation, Marine Resources Commission, Virginia Institute of Marine Science, representatives from localities, and any other state agency issuing permits in a floodplain, to develop and maintain a comprehensive guidance document to assist localities in complying with federal floodplain management requirements under the National Flood Insurance Program. The bill requires such guidance document to provide the proper implementation of enforcement provisions regulating development in floodplain management areas, including floodplain permitting requirements for all man-made development, within localities that participate in the National Flood Insurance Program. The bill requires the Department to review and revise the guidance document, with input from other state agencies and representatives of localities, at least every five years.
Virginia Human Rights Act; unlawful discrimination. Prohibits any state agency or political subdivision in the Commonwealth from supporting, implementing, recognizing, or utilizing any program, process, or procedure that conveys or denies a benefit, advantage, or privilege to an individual based solely on such individual's race, sex, or ethnicity.
Income tax; real property tax relief credit. Provides a refundable income tax credit in taxable years 2026 through 2030 to eligible taxpayers, defined in the bill, who incur real property taxes in an amount equal to or greater than four percent of their federal adjusted gross income for up to $500 for single individuals and $1000 for married persons filing jointly.
Virginia Youth Empowerment and Mentoring Grant Fund and Program; established. Establishes the Virginia Youth Empowerment and Mentoring Grant Fund and Program, to be administered by the Department of Criminal Justice Services, for the purpose of awarding grants to community-based organizations for the purpose of placing mentors with high-risk youth in an effort to transition such youth into careers in certified high-wage trades.
Department of Housing and Community Development; Virginia Rural Housing Infrastructure Fund and Program. Establishes the Virginia Rural Housing Infrastructure Fund and Program, to be administered by the Department of Housing and Community Development, for the purpose of financing infrastructure projects in rural communities associated with increased housing development within such communities. The bill directs the Department to develop criteria and guidelines for awarding grants under the Program.
Middle Peninsula Chesapeake Bay Public Access Authority; powers; commercial fishing pier. Expands the powers of the Middle Peninsula Chesapeake Bay Public Access Authority to allow the Authority to construct, maintain, and operate a commercial fishing pier, defined in the bill, whose primary purpose is to allow fishing by the public. The bill exempts such a pier from certain licensing and reporting requirements for commercial fishing piers.
Zoning for Housing Production Pilot Program created; affordable dwelling unit policy incentives; report. Creates the Zoning for Housing Production Pilot Program to be administered by the Department of Housing and Community Development. To be eligible for a grant from the Program, an eligible locality, as named in the bill, is required to make a change to its zoning policies to allow for by-right development that is expected to further the goal of creating and maintaining mixed-income communities, affordable housing, and moderately priced housing, as those terms are defined in the bill. The Department is required to establish certain guidelines for the Program and to notify eligible localities of the existence and purpose of the Program no later than February 1, 2027. The bill has an expiration date of July 1, 2029.
