HB 1183: Motor vehicles; operating with accumulated snow or ice, penalty.

Operating motor vehicle with accumulated snowor ice; penalty. Provides that it is a traffic infraction punishableby a fine of $100 for a person to operate a moving motor vehiclewith any amount of accumulated snow or ice on its exposed surfaceswhere, were the snow or ice to become dislodged from such vehicle,such accumulated snow or ice could interfere with the operation ofanother motor vehicle or cause injury to persons or property. Thebill exempts from the infraction a person operating an emergencyvehicle, a vehicle engaged in snow or ice removal and control operations,or a vehicle operated during adverse weather conditions arising afteroperation of the vehicle began that result in the accumulation ofsnow or ice on such vehicle.

HB 908: Correctional facilities; prohibited acts, use of canines by officers.

Use of canines in correctional facilities; prohibitedacts. Makes it unlawful for any correctional officer, jail officer,or other employee of a state, local, or juvenile correctional facilityto use a canine, except where there is an imminent threat of deathor serious bodily injury to any prisoner or detained juvenile orany officer or employee of the facility, to extract a prisoner ordetained juvenile from his cell or to intervene in an altercation,fight, or other incident between prisoners or detained juveniles.The bill requires that all incidents involving the use of a caninebe reported to a database established by the Department of Correctionsor the Department of Juvenile Justice, as applicable, and that suchreports be made available to the public and include the name of thefacility, the name of the canine, and the name of the canine's handler.The bill also requires that the Department of Corrections or the Departmentof Juvenile Justice, as applicable, make public any policies relatingto the use of canines, training requirements for both canines andhandlers, and the supervision of the officers or employees who arepermitted to handle such canines.

HB 310: Absentee voting; application requirements, absentee ballot requirements.

Absentee voting; application requirements; absenteeballot requirements. Requires an applicant for an absentee ballotto provide the last four digits of his social security number onthe application regardless of whether he is completing the applicationin person and makes the failure of the absentee voter to have a witnesssign his absentee ballot envelope a material omission that rendersthe ballot void. The bill removes the permanent absentee voter listand reinstates the special annual application for voters with a disabilityor illness. The bill also removes the requirement that the absenteevoter return envelope be sent to absentee voters with prepaid postage.

Provides thatin any case where a person was convicted of involuntary manslaughteras a result of driving a motor vehicle or operating a watercraft under the influence where the victim was the parent or legal guardianof a child, the person who has custody of such child may petitionthe sentencing court to order that the defendant pay child support.

HB 503: Bail; subsequent proceeding arising out of initial arrest.

Bail in subsequent proceeding arising out ofinitial arrest. Provides that any person who was previously admittedto bail shall be granted bail and have the terms of bond or recognizancefixed in the amount or manner consistent with the prior admissionto bail, but if the court having jurisdiction of the subsequent proceedingbelieves bail is inappropriate, or the amount of bond or securityinadequate or excessive, it may deny bail, or change the amount ofsuch bond or security, require new and additional sureties, or setother terms of bail as are appropriate to the case. Under currentlaw, any person who was previously admitted to bail is not requiredto be admitted to bail in any subsequent proceeding arising out ofthe initial arrest unless the court having jurisdiction of such subsequentproceeding deems the initial amount of bond or security taken inadequate.This bill is a recommendation of the Virginia Criminal Justice Conference.

HB 334: Sexually explicit visual material to another; unlawful dissemination, penalty.

Unlawful dissemination of sexually explicit visual material to another; penalty. Provides that any person 18 years of age or older who knowingly transmits sexually explicit visual material by computer or other electronic means to another person 18 years of age or older when such other person has not requested or consented to the transmittal of such material or has expressly forbidden the transmittal of such material is subject to a civil penalty of not more than $250 for a first offense and not more than $500 for a second or subsequent offense.
