Adds farming tools and implements to tax-exempt personal property and adds preparing farm crops for shipping as tax-exempt use of personal property. Modifies juvenile court dependency procedure to require any party issuing summons to bear financial responsibility for certain costs arising out of issuance of summons.
Establishes Early Childhood Equity Fund. Authorizes Early Learning Division to make grants from fund for purpose of supporting culturally specific early learning, early childhood and parent support programs in this state and to promote capacity of culturally specific organizations to deliver programs . Permits former ] adopted former foster children to have amount of tuition and all fees waived if attending defined institutions of higher education for purposes of pursuing initial undergraduate degree. Defines " former ] adopted former foster child." Permits former ] adopted former foster children previously ineligible for waiver of tuition due to being adopted to be eligible for waiver if adoption occurred on or after January 1, 2012. Declares emergency, effective on passage.
Establishes tax rate for taxable income from partnerships, S corporations and sole proprietorships. Applies to tax years beginning on or after January 1, 2020. Takes effect on 91st day following adjournment sine die.
Requires health care practitioner to exercise proper degree of care to preserve health and life of child born alive after abortion or attempted abortion. Requires health care practitioner to ensure child born alive is transported to hospital. Creates crime for failure to exercise proper standard of care, punishable by maximum of five years' imprisonment, $125,000 fine, or both. Allows specified person to bring civil action for damages and equitable relief against health care practitioner for failure to exercise proper standard of care. Directs court to award attorney fees to prevailing plaintiff. Allows court to order identity or personally identifiable information of specified person protected from disclosure.
Requires Department of Environmental Quality to contract with independent third-party entity to provide technical assistance to municipalities on matters related to state and federal wastewater permitting requirements. Appropriates moneys to department to carry out purposes of Act. Declares emergency, effective July 1, 2019.
Requires eight percent of electricity sold in this state by each electric company that makes sales to 25,000 or more retail electricity consumers to be generated by small-scale renewable energy facilities or certain biomass facilities. Increases, to 100 average megawatts of electricity per year, amount of electricity generated by certified low-impact hydroelectric facilities that may be used to comply with renewable portfolio standards. Allows renewable energy certificates issued at any time for electricity generated by certified low-impact hydroelectric facility to be banked and carried forward indefinitely. Establishes, for purposes of public utilities that provide electric power to consumers in this state, additional standards for purchase of energy or energy and capacity from qualifying facilities. Allows person injured by certain violations by public utility related to purchase and sale of energy or energy and capacity to recover treble damages from public utility. Declares jurisdiction of Public Utility Commission over certain matters related to qualifying facilities. ].
