Rep. André Carson

This resolution urges the United States to protect the human rights of unhoused individuals, to establish regulations and enforcement tools to protect unhoused individuals from violations of civil and human rights, and to establish blanket legal protections for third parties providing goods or services to unhoused individuals. The resolution also urges the United States to establish a process to award appropriate damages, attorney's fees, and costs to a prevailing plaintiff in an action alleging a violation of the human and civil rights of unhoused individuals. Relatedly, the resolution urges the United States to allow the court in such an action to consider housing status and apply leniency in compiling records, receipts, and documentation from those plaintiffs. The resolution also expresses the intention of the House of Representatives to address the unhoused crisis in the United States by providing funding and imposing requirements on the Department of Housing and Urban Development and the Department of Health and Human Services.

This bill directs Congress to present a Congressional Gold Medal to Mahatma Gandhi in recognition of his promotion of nonviolence. The Department of the Treasury must design and produce the medal and is authorized to sell bronze duplicates. The Smithsonian Institution shall display the medal and make it available for research.

Fiscal Analysis by Income and Race Scoring Act or the FAIR Scoring Act This bill requires the Congressional Budget Office's (CBO's) cost estimates for legislation to include a distributional analysis by race and income if the legislation will have a gross budgetary effect of at least 0.1% of gross domestic product in any fiscal year during the 10-year budget window. CBO's analysis must show the transfers that would result by race and income level, and the effects must be shown both in dollars and as a percent change in after-tax-and-transfer-income. The bill also requires CBO to report to Congress on methods for conducting such a distributional analysis by gender.

Shift Back to Society Act of 2021 This bill directs the Department of Education to establish a pilot program that awards matching grants to historically Black colleges and universities to provide educational programs for eligible offenders to facilitate reentry into the community. An eligible offender is a convicted criminal offender who has been released from incarceration for not longer than one year or who is scheduled to be released from incarceration within one year. The Government Accountability Office must report to Congress on the results of the pilot program.

Parental Bereavement Act of 2021 or the Sarah Grace-Farley-Kluger Act This bill entitles an eligible employee to up to 12 workweeks of leave during any 12-month period because of the death of a son or daughter. Such an employee may substitute any available paid leave for any leave without pay. The bill applies the same leave entitlement to federal employees.

Open App Markets Act This bill establishes rules related to the operation of an app store by a covered company (i.e., the owner or controller of an app store with more than 50 million U.S. users). An app is a software application or electronic service that may be run or directed by a user on a computer or mobile device. An app store is a publicly available website, software application, or other electronic service that distributes apps from third-party developers to users. The bill prohibits a covered company from (1) requiring developers to use an in-app payment system owned or controlled by the company as a condition of distribution or accessibility, (2) requiring that pricing or conditions of sale be equal to or more favorable on its app store than another app store, or (3) taking punitive action against a developer for using or offering different pricing terms or conditions of sale through another in-app payment system or on another app store. A covered company may not interfere with legitimate business communications between developers and users, use non-public business information from a third-party app to compete with the app, or unreasonably prefer or rank its own apps (or those of its business partners) over other apps. The bill provides for enforcement of its provisions by the Federal Trade Commission and the Department of Justice, as well as through suits brought by developers that are injured by reason of anything forbidden under the bill.

Twenty-First Century Dams Act This bill addresses dam infrastructure and safety. First, the bill provides resources for programs related to state dam safety, the rehabilitation of high hazard potential dams, and the inspection of dams. In particular, the bill reauthorizes through FY2026 the National Dam Safety Program. In addition, the bill reauthorizes through FY2026 a program related to the rehabilitation of structural measures and a program related to water infrastructure. Next, the bill allows a new tax credit for maintaining and enhancing hydroelectric dams that is equal to 30% of the basis of any qualified dam safety, environmental, and grid resilience enhancement property placed in service in a taxable year. It also allows a 30% credit for qualified obsolete river obstruction removal expenditures for demolishing and removing certain nonpowered or hydroelectric dams. The bill directs the Department of the Army to establish a program to carry out dam removal projects. Further, the bill establishes the Dam Removal Council to (1) coordinate with participating federal agencies to annually notify all known dam owners of the availability of dam removal funding and provide guidance on the existing programs of participating agencies; (2) evaluate and submit to Army recommendations for dam removal projects, technical assistance programs, and funding allocations; and (3) develop a dam removal strategy. The bill requires certain dam assessments, including a joint assessment by the U.S. Geological Survey and the Department of Energy. The bill also authorizes specified federal agencies to undertake certain activities related to federal dam infrastructure.

Bringing Enhanced Treatments and Therapies to ESRD Recipients Kidney Care Act or the BETTER Kidney Care Act This bill requires the Centers for Medicare & Medicaid Services (CMS) to establish a demonstration program for Medicare beneficiaries with end-stage renal disease (ESRD). Under the program, renal dialysis facilities, kidney disease specialists, physician practices, and other health care practitioners may form an organization that partners with certain health care entities to provide integrated care to beneficiaries with ESRD. Such care must include all covered Medicare benefits as well as transition services for transplantations, palliative care, and hospice. Each organization must have a minimum number or percentage of participating beneficiaries (350 or 60% of beneficiaries served at the organization's facilities) and must also comply with certain fiscal, governance, and quality of care requirements. Additionally, the Government Accountability Office must study certain data that is reported to the CMS regarding pediatric dialysis care, as well as the effects of race-based corrections to a specified kidney function test on referrals of ESRD patients for transplant evaluations.

Real Emergency Access for Aging and Disability Inclusion for Disasters Act or the REAADI for Disasters Act This bill establishes programs and requirements to assist individuals with disabilities and older adults (age 50 or older) with disaster preparedness. Among other provisions, the bill requires the establishment of an advisory committee that includes disabled individuals and older adults to oversee the use of funds made available by this bill; allows states to contract with Centers for Independent Living to provide services and support to disabled individuals in preparing for hazards; requires the Department of Health and Human Services to award grants to carry out projects of national significance that, among other things, create opportunities for disabled individuals and older adults to directly contribute to disaster preparedness, recovery, and mitigation; modifies and expands the membership of the National Advisory Committee on Individuals with Disabilities and Disasters to ensure that it represents the diversity of the disabled and older adult communities; and establishes the Disability and Disaster Preparedness Advisory Commission to review settlement agreements involving potential violations of the Rehabilitation Act of 1973 and the Americans with Disabilities Act of 1990. The Government Accountability Office must study the compliance of federal agencies with such enactments in expending funds to support disabled individuals and older adults in responding to, recovering from, and mitigating disasters.

This resolution supports the designation of Hip Hop Celebration Day, Hip Hop Recognition Month, and Hip Hop History Month. The resolution recognizes the contributions of Hip Hop to art and culture. Finally, the resolution encourages local governments to build partnerships with local Hip Hop entities and other members of the creative arts and music communities.
