Establishes the build up New York pilot program to provide grants to eligible municipalities that construct new accessory dwelling unit housing projects built on top of existing buildings that utilize mass timber and serve certain households; establishes the mass timber for affordable housing program to provide tax credits for eligible taxpayers who use mass timber in certain new construction or major retrofits of existing buildings that primarily serve households up to one hundred fifty percent of the area median income; establishes tax credits for mass timber production.
Limits the authority of cities, villages and towns to impose certain zoning regulations, ordinances, or local laws which would have the effect of reducing the number or density of allowable housing units in the area subject to the regulations, ordinances, or local laws.
Provides that a policy of this state should be to increase housing options and opportunities, including but not limited to affordable, workforce and senior housing.
Ensures zoning lot mergers do not create any new non-compliance with applicable, pre-existing zoning regulations for multiple dwellings in a city having a population of five million or more.
This bill expands the residential redevelopment inhibited property exemption to all cities, towns, and villages in the state, removing a current restriction that limited it to one specific city. It allows any municipality to adopt local laws designating properties as "redevelopment inhibited" if they are neglected, abandoned, or have conditions (like long vacancy or zoning violations) preventing private redevelopment. Property owners in designated areas can then receive an exemption from taxes on the increased value of their property after redevelopment, provided they own a one- to four-unit residence, maintain owner-occupancy, and file annual residency affidavits. The exemption covers only the incremental tax increase from redevelopment, not the base property value, and requires compliance with building and zoning codes.
Establishes a demonstration program extending the J-51 tax exemption to the conversion and rehabilitation of commercial and manufacturing space to co-located work space and residential units in certain high density areas in Kings county.
Includes additional community districts in which pilot programs to address the legalization or conversion of certain basement and cellar dwellings can be established by local law.
Provides for a real property tax exemption for certain residential properties with accessory dwelling units occupied by households in need in Suffolk county when the owner of the property resides in the primary building on the property and certain other conditions are met pertaining to the percentage of the total assessment of the property, the income of the tenants of the accessory dwelling unit or units, and the amount of the rent for the accessory dwelling unit.
Directs municipalities to permit the construction and occupation of dwelling units with a density of at least twenty-five dwelling units per acre, on any land wherein residential construction and occupation is otherwise permitted if such land is within one-half mile of any covered transportation facility.
Prohibits the issuance of a permit for the construction of a new multiple dwelling unless the multiple dwelling contains the minimum number of dwelling units required for the lot; defines minimum number of units required.
