Requires the department of corrections and community supervision to establish discharge plans and reentry services for wrongfully convicted individuals upon their discharge which includes housing needs, educational needs, employment needs, medical needs, and specific social service needs.
Designates an individual found to have been convicted of certain crimes where the complainant or victim is an amateur or professional athlete, coach, official or other participant in a sports event, or a jockey, driver, trainer, owner, official or other participant in a horse race, or to have been convicted of certain offenses involving sports contests, horse races, or wagering thereon, as a prohibited sports bettor; requires the commission to notify the individual; allows for the individual to contest such designation; requires account wagering licensees to prohibit any individual designated as a prohibited sports bettor from establishing or maintaining a wagering account.
Prohibits the use of restraints on and the use of force against incarcerated individuals during labor and incarcerated individuals who have experienced different pregnancy outcomes, absent extraordinary circumstances, and on pregnant and post-pregnancy persons during a custodial interrogation; provides for certain exceptions for restraints to be used and in such case limits the use to wrist restraints.
Requires the office of addiction services and supports to collect certain demographic data for incarcerated individuals in medication assisted treatment programs.
Prohibits the use of intoxication of the victim as a defense in sex crimes where the victim is under the influence of any drug, intoxicant, or other substance to a degree which rendered the victim temporarily incapable of appraising or controlling such person's conduct and such condition was known or reasonably should have been known to a person in the actor's situation.
Establishes a competency restoration workgroup to evaluate and improve the efficiency and effectiveness of the competency restoration process as it relates to defendants who are being evaluated and receiving restoration under article seven hundred thirty of the criminal procedure law to permit legal proceedings to resume without undue delay.
