Budget & Taxes (Appropriations)

Requires the legislative services agency to perform a fiscal impact analysis for all executive orders issued by the governor within seven days of an order's issuance. (Under current law, this requirement only applies to a governor's declaration of a disaster emergency by executive order.) Provides that if the implementation and compliance costs of a proposed rule are expected to exceed $500,000 (instead of $1,000,000) over a two year period, the publisher may not publish the proposed rule until the budget committee has reviewed the rule. Amends the Pokagon Indiana Education Fund to allow payments to be made to both public and private Indiana institutions of higher learning for the purposes of the fund. Makes the following changes (effective July 1, 2028) regarding community mental health centers (CMHC): (1) Allows a county to meet CMHC funding requirements from any funding source in lieu of or in combination with property taxes but excluding federal funds. (2) Adds provisions concerning the location where certain CMHC services may be provided. (3) Specifies additional items that are required to be reported by a CMHC in its annual report. Urges the legislative council to assign to the interim study committee on courts and the judiciary the task of undertaking a comprehensive study of all court fees and fines. Allows the budget agency, subject to budget committee review, to use the appropriation to the financial responsibility and opportunity growth fund (fund) in HEA 1001-2025 or augment the fund for the purpose of providing funding to the Child Care and Development Fund voucher program in addition to the uses for the appropriation as authorized in HEA 1001-2025.

Amends the definition of "eligible child" for purposes of the prekindergarten program (program). Removes provisions regarding the program that require: (1) the office of the secretary of family and social services to determine the number of eligible children who will participate in the program; and (2) a percentage of matching funds from other sources. Establishes the prekindergarten expansion grant fund to provide grants to potential eligible providers and existing eligible providers. Makes a continuous appropriation to the prekindergarten program fund from the state general fund in an amount sufficient to carry out the purposes of the fund. Makes an appropriation to the prekindergarten expansion grant fund from the state general fund. Repeals certain provisions regarding the definitions of "eligible child", "extended enrollment period", "limited eligibility child", "priority enrollment period", "child care employee", and "child of a child care employee". Repeals or removes provisions regarding prekindergarten vouchers for limited eligibility children and children of child care employees. Makes conforming changes.

HB 1401 establishes a state-funded program pairing employers with childcare providers to offer subsidized childcare assistance to working parents. It directly affects eligible employers who partner with the program and working parents seeking affordable childcare options. The bill creates a partnership mechanism where the state provides funding (via an appropriation) to help employers cover childcare costs for their employees. The bill was recently introduced and referred to the Committee on Employment, Labor and Pensions for review.

Establishes the division of historic sites (division) in the department of natural resources. Transfers management of historic sites from the Indiana state museum and historic sites corporation to the division. Makes conforming changes. Makes an appropriation.

Requires the office of the secretary of family and social services (office) to apply to the United States Department of Health and Human Services to amend the state plan for the federal Child Care and Development Fund (CCDF) voucher program to increase the maximum initial eligibility limit for purposes of initial eligibility to 150% of the federal poverty level. Requires the office to fully fund: (1) each eligible applicant for a CCDF voucher payment; and (2) eligible CCDF provider reimbursement rates at a specified rate. Provides that the office may not place an eligible CCDF applicant on a waiting list. Provides that an eligible child for the prekindergarten program is an individual who, among other conditions, is a member of a household with an annual income that does not exceed 150% of the federal poverty level (instead of 135% for individuals enrolled on or after May 1, 2025, under current law). Removes the limitation on state money that may be used for a prekindergarten voucher during a state fiscal year. Requires the office of family and social services to establish reimbursement rates for prekindergarten providers that are equal to or greater than the rates established that were in effect on January 1, 2025. Makes an appropriation to the prekindergarten program fund.

Requires the state police department (department) to use part of an appropriation from House Enrolled Act 1001 (2025) to process rape kits and to eliminate the backlog of untested rape kits. Permits the department to issue grants to law enforcement agencies and testing labs to eliminate the backlog of untested rape kits. Requires the department to make a report to the general assembly by October 1, 2027, concerning the status of untested rape kits.

Establishes the hunger-free campus grant program (grant program) to provide grants to state educational institutions for purposes of addressing food insecurity among students enrolled in state educational institutions. Provides that the commission for higher education (commission) shall provide a grant under the grant program to a state educational institution if at least one campus is designated by the commission as a hunger-free campus. Establishes criteria that a campus of a state educational institution must meet in order to be designated as a hunger-free campus. Makes an appropriation.

Requires the Indiana department of transportation to take action necessary to construct one or more additional lanes of traffic across Indiana for: (1) eastbound; and (2) westbound; Interstate Highway 70 in areas of Interstate Highway 70 where there are four lanes of traffic. Makes an appropriation.

Amends the appropriation from the financial responsibility and opportunity growth fund (fund) for the state budget biennium in HEA 1001-2025 to require the total amount appropriated from the fund to be used for funding the Child Care and Development Fund voucher program and On My Way Pre-K programmatic funding and for no other purpose.
