Lower Costs, More Cures Act of 2021 This bill establishes and modifies several programs and requirements to address prescription drug prices. The bill modifies provisions under Medicare and Medicaid relating to prescription drug coverage and price transparency. Among other changes, the bill requires the Centers for Medicare & Medicaid Services to publish certain information, as reported by pharmacy benefit managers (PBMs), relating to generic dispensing rates, drug discounts and rebates, and payments between PBMs, health plans, and pharmacies; caps annual out-of-pocket spending under the Medicare prescription drug benefit; allows prescription drug plan sponsors under the Medicare prescription drug benefit to offer additional plans in a region; requires pass-through pricing models, and prohibits spread-pricing, for payment arrangements with PBMs under Medicaid; and allows states to include in the Medicaid Drug Rebate Program covered outpatient drugs that are provided as part of physician or outpatient hospital services. The bill also generally modifies other provisions relating to the regulation and costs of generic and brand-name drugs. Among other changes, the bill prohibits the manufacturer of a brand-name, generic, or biosimilar drug from entering into certain agreements to resolve or settle a patent infringement claim in connection with the sale of a drug or biological product; permanently allows high deductible health plans to waive deductibles for insulin and associated products; and establishes the position of Chief Pharmaceutical Negotiator in the Office of the U.S. Trade Representative.

District of Columbia-Maryland Reunion Act This bill cedes the District of Columbia to Maryland after Maryland's acceptance of the retrocession. Furthermore, the bill declares that the National Capital Service Area in the District shall not be ceded and relinquished to Maryland and shall continue to serve as the permanent seat of the federal government. The bill maintains the exclusive legislative authority and control of Congress over the area. Finally, excluding the District Building, the area shall include the principal federal monuments, the White House, the U.S. Capitol, the U.S. Supreme Court Building, the federal executive, legislative, and judicial office buildings located adjacent to the Mall and the U.S. Capitol, including any federal real property affronting or abutting such area, such as the Department of Housing and Urban Development and the Department of Energy buildings.

Camp Lejeune Justice Act of 2021 This bill allows certain individuals to sue and recover damages for harm from exposure to contaminated water at Camp Lejeune in North Carolina between August 1, 1953, and December 31, 1987. This action is available only to individuals who were exposed to contaminated water for at least 30 days. The bill prohibits the U.S. government from asserting specified immunity from litigation in response to such a lawsuit. The bill also prohibits an individual who brings such an action from bringing a separate tort action against the United States based on the same harm.

Natural Immunity Is Real Act This bill requires all federal agencies to acknowledge and consider natural immunity to COVID-19 when promulgating any regulation related to the COVID-19 public health emergency.

Prohibiting IRS Financial Surveillance Act This bill prohibits the Department of the Treasury from requiring a financial institution to report the transfers into and out of a financial account. This prohibition does not apply to laws or regulations in effect on October 1, 2021.

Fishery Resource Disasters Improvement Act This bill revises the Fisheries Resource Disaster Relief Program and repeals or revises certain reporting requirements. The bill revises the procedures and process for determining whether there has been a commercial fishery failure as a result of a fishery resource disaster because of natural, man-made, or undetermined causes. The Department of Commerce shall have the sole authority to determine the existence, extent, and beginning and end dates of a fishery resource disaster. Additionally, Commerce must include in its budget justification materials submitted to Congress in support of the budget of Commerce for each fiscal year, (as submitted with the President's budget) a separate statement of the amount requested to be appropriated for that fiscal year for outstanding unfunded fishery resource disasters. The bill repeals a program that provides disaster relief assistance to fishermen, charter fishing operators, and others affected by a catastrophic regional fishery disaster, known as the regional coastal disaster assistance, transition, and recovery program. With respect to reporting requirements, the bill requires (1) biennial rather than annual reports (under current law, annual reports) relating to the recovery of Klamath River Coho salmon, and (2) inclusion of additional information in the biennial reports on international compliance regarding the conservation of living marine resources. The bill also repeals the requirement for annual reporting to Congress on bycatch reduction agreements.

Renew Effective Protection of Americans' Information Rights Act or the REPAIR Act This bill restricts the use of information reasonably linked to an individual (or the individual's internet-connected device) that is collected, processed, or transferred by certain entities subject to unfair competition laws. Individuals must affirmatively and expressly consent to the use of their information and may withdraw their consent. Entities may only use information as reasonably necessary and for the allowable purposes (e.g., completing transactions at an individual's request, complying with legal obligations, and other purposes specified in the bill) to which the individual consented. The Federal Trade Commission (FTC) may allow additional purposes through rulemaking. Entities must also establish data security practices. Additionally, entities must make their privacy policies publicly available, and individuals must consent to a policy change that weakens privacy protections before the change takes effect. Further, entities must (1) notify individuals in real-time when their information is being used; and (2) provide copies of, delete, mask, or correct information at an individual's request. However, these requirements shall not apply to entities that have revenues, staffing levels, and related indicators below specified limits. The FTC must also develop a downloadable program that allows individuals to opt out of unwanted data harvesting and targeted advertising by public-facing websites, applications, and related operators (e.g., social networks and search engines). Operators must comply with requirements related to the program. Along with existing remedies, the bill provides civil penalties for violations of the bill and allows enforcement by the FTC, states, Indian tribes, and territories.

Health Freedom for All Act This bill prohibits the Department of Labor from issuing an emergency temporary occupational safety or health standard requiring employers to ensure that their employees receive a COVID-19 vaccine or undergo COVID-19 testing.

National POW/MIA Memorial and Museum Act This bill designates the memorial and museum that is being constructed on an approximately 26-acre area on the POW-MIA Memorial Parkway in Jacksonville, Florida, as the National POW/MIA Memorial and Museum. The director of the memorial and museum shall submit a report to Congress that includes a budget for the memorial and museum.

Israel Relations Normalization Act of 2021 This bill requires the Department of State to take certain actions promoting the normalization of relations between Israel, Arab states, and other relevant countries and regions. Specifically, the State Department must develop a strategy on expanding and strengthening the Abraham Accords (the term used to refer collectively to agreements between Israel and the United Arab Emirates and between Israel and Bahrain marking the public normalization of relations between the two Arab countries and Israel). The strategy must include a description of how the U.S. government will encourage further normalization of relations with Israel. In addition, the State Department must report on options for U.S. international efforts to promote the strengthening of ties between Israel, Arab states, and other relevant countries and regions. The State Department must also report on the status of the normalization of relations with Israel, including information on (1) laws that punish individuals for people-to-people relations with Israelis (i.e., anti-normalization laws), and (2) evidence of steps taken by Arab governments toward permitting or encouraging normalized relations between their citizens or residents and Israeli citizens.
