Amends the Grocery Initiative Act. Provides that the Act also includes grants and financial assistance for mobile farmers markets and online farmers markets. Provides that, in addition to other purposes, the Department of Commerce and Economic Opportunity may award grants under the Act for technology upgrades, including software and point-of-sale systems.
Creates the Data Broker Registration and Accessible Deletion Mechanism Act. Provides that, annually, on or before January 31, a data broker operating in the State shall register with the Attorney General. Provides that, in registering with the Attorney General, a data broker shall pay a registration fee in an amount determined by the Attorney General and shall also provide specified information. Provides that the Attorney General shall create a page on its website where the registration information shall be made accessible to the public. Provides for civil penalties. Provides that all moneys received by the Attorney General under the provisions shall be deposited into the Data Broker Registry Fund. Provides that, no later than January 1, 2028, the Attorney General shall establish an accessible deletion mechanism that allows a consumer, through a single verifiable consumer request, to request that every data broker that maintains any personal information delete any personal information related to that consumer held by the data broker. Amends the State Finance Act and the Consumer Fraud and Deceptive Business Practices Act to make conforming changes.
Creates the Artificial Intelligence Safety Measures Act. Defines "frontier model", "frontier developer", and "large frontier developer". Requires large frontier developers to adopt and publish a frontier AI framework addressing catastrophic risk management, transparency, and cybersecurity. Mandates reporting of critical safety incidents to the Illinois Emergency Management Agency and Office of Homeland Security and establishes civil penalties for noncompliance. Directs the Department of Innovation and Technology to review and recommend updates to definitions and standards. Creates a consortium to develop ILCompute, a public cloud computing resource. Exempts specified information under the Freedom of Information Act. Makes conforming changes to the Freedom of Information Act.
Amends the Nurse Practice Act. In provisions concerning registered professional nurses, adds provisions concerning: the use of artificial intelligence in recorded or transcribed encounters; prohibition on substituting artificial intelligence for nursing services; use of artificial intelligence as clinical decision support under the control of a registered professional nurse; patient notice and transparency; confidentiality protections; exceptions for nonclinical activity; and defined terms. Amends the grounds for discipline to add violations of the artificial intelligence provisions by a registered professional nurse. Requires a health care entity that employs registered professional nurses and deploys artificial intelligence in direct patient care to maintain validation and bias monitoring records for each system and make such records available to the Department of Financial and Professional Regulation upon request; provide registered professional nurses with training on intended use, data limits, and known failure modes; ensure registered professional nurses have access to data inputs and key factors that produced any recommendation used in direct patient care; and prohibit staffing, triage, admission, discharge, or transfer decisions that rely solely on artificial intelligence. Allows the Department to investigate any health care entity that employs registered professional nurses for a violation of the artificial intelligence provisions. Effective immediately.
Creates the Mental Health Warning for Social Media Act. Provides that the operator of a social media platform shall ensure that a clear and conspicuous mental health warning label that complies with specified requirements: (1) appears each time a user accesses the social media platform; and (2) remains visible until the user takes specified actions. Provides that the Department of Public Health shall develop guidelines establishing requirements for the warning labels. Provides that the operator of a social media platform shall display a clear and conspicuous pop-up notification at least once every 30 minutes that a user has actively used the platform that informs the user of specified information. Provides that a violation of any of the provisions of the Act is an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change.
Creates the Automated License Plate Recognition System Act. Sets forth provisions regarding authorized uses of an automated license plate recognition system, data retention, prohibited uses of an automated license plate recognition system, restrictions, requirements for use, preservation and disclosure, required data collection, reporting requirements, admissibility, privacy, penalties, and a private right of action. Makes a conforming change in the Freedom of Information Act. Effective immediately.
HB 5276 amends Illinois' Public Official Safety and Privacy Act (5 ILCS 347/10) by adding law enforcement officers to the legal definition of "public official." This change directly extends privacy protections to law enforcement officers, requiring governmental agencies to remove their personal information - including home addresses, phone numbers, and email - from publicly available records upon written request. The bill updates Section 10 of the Act to include law enforcement officers under the same privacy safeguards already provided to legislators, constitutional officers, and other public officials. This policy change ensures officers can request the removal of their personal data from public databases maintained by government agencies.
Amends the School Code. Provides that a school board shall require a school that operates a library to place the library's catalog of library materials in a searchable database accessible over the Internet to a parent or guardian of a student at the school. Provides that a school board shall require a school that operates a library to allow a parent or guardian of a student at the school to prohibit the student from accessing any library materials that the parent or guardian designates. Provides that the school shall require the parent or guardian to designate in writing which library materials the parent or guardian is prohibiting the student from accessing, shall keep the written designation on file in the library, and shall prevent the student from accessing that material.
Amends the Illinois Public Aid Code. Provides that, to the extent permitted under federal law and regulations, the Department of Human Services shall, as soon as practical after the effective date of the amendatory Act but not later than March 1, 2027, implement an electronic benefits transfer system that uses industry-standard commercial electronic funds transfer technology, including, at a minimum, the use of cards with EMV chips.
Creates the Social Media Data Clean Slate Act. A social media platform shall provide a clear and conspicuous button that enables a user to delete the user's account that satisfies specified requirements. Provides that the social media platform shall, when the button is clicked, provide a user with the steps necessary to complete an account deletion request, which shall include deletion of the user's personal information. Sets forth additional provisions concerning the account and personal information deletion process. Provides that any waiver of the rights provided under the Act shall be void and unenforceable. Provides that the Attorney General shall adopt rules necessary to implement and enforce the Act. Effective January 1, 2027.
