HB 4456: LOW-INCOME UTILITY RATES

Amends the Public Utilities Act. In provisions concerning nondiscrimination, provides that the Commission is authorized to approve a low-income discount rate for residential electric and natural gas customers that applies to the entirety of a qualifying customer's bill, including, but not limited to, a qualifying customer's delivery service charges and energy supply charges. Provides that an electric or natural gas utility may fund low-income discount rates through a surcharge on customers' electric and natural gas bills. Provides that the changes to the Act apply retroactively on and after January 1, 2023. Amends the Energy Assistance Act. In provisions concerning eligibility under the Act, provides that, in setting the annual eligibility level for the use of State funds from the Supplemental Low-Income Energy Assistance Fund, the Department of Commerce and Economic Opportunity shall consider the amount of available funding and may not set a limit higher than 300% of the federal nonfarm poverty level. In provisions concerning the Supplemental Low-Income Energy Assistance Fund, provides that the yearly administrative expenses of the Fund may not exceed 15% (rather than 13%) of the amount collected during that year, except when unspent funds from the Fund are reallocated from a previous year. Provides that any unspent balance of the 15% administrative allowance may be utilized for administrative expenses in the year they are reallocated. Provides that, of the 15% administrative allowance, no less than 9% (rather than 8%) shall be provided to Local Administrative Agencies for administrative expenses. Provides that, beginning January 1, 2027, the Base Energy Assistance Charge shall be $0.80 per month for each utility that is required by the Illinois Commerce Commission to implement a low-income discount rate and shall be $0.40 per month for each utility that is not required to implement a low-income discount rate and that contributes to the Supplemental Low-Income Energy Assistance Fund. Makes other changes.

HB 4377: PHA-NO WORK REQUIREMENTS

Amends the Housing Authorities Act. Provides that, unless otherwise required by federal law or regulation, a housing authority shall not establish or implement any rules, policies, or procedures that impose time limits or work requirements as a condition of initial or continued eligibility for any rent subsidy or assistance provided to qualifying tenants of the housing authority or to qualifying individuals through any rent subsidy or other housing assistance program administered by the housing authority. Permits a housing authority to establish, implement, or encourage an applicant or recipient of a rent subsidy or assistance to participate in a voluntary employment or job training program if the program: (1) does not impact the applicant's or recipient's initial or continued eligibility for the rent subsidy or assistance; and (2) has one of the specified goals for program participants, including, but not limited to, (i) increasing personal income, (ii) homeownership, or (iii) expanding employment options.

HB 5234: LANDLORD-TENANT FEES

Amends the Landlord and Tenant Act. Requires landlords to disclose all non-optional fees in a clear and conspicuous manner in the listing and on the first page of the lease. Requires landlords to disclose if any utility bills are non-optional fees in the listing and the first page of the lease. Provides that if a landlord failed to comply with this disclosure, the landlord may not collect the non-optional fee. Prohibits a landlord from charging a bundled services fee that combines optional and non-optional fees. Prohibits a landlord from charging a tenant with a fee or fine that includes, but is not limited to, an application fee that includes a background check of more than $50, an after-hours request for maintenance service, or pest abatement or removal in which the tenant has not contributed to the infestation. Prohibits a landlord from charging a tenant more than one of the following: (i) a security deposit, (ii) a move-in fee, or (iii) a move-out fee. Exempts leases in owner-occupied buildings containing 6 or fewer units and to nonresidential tenancies. Defines terms. Creates a civil cause of action for violation of the Act by a landlord. Makes other changes. Limits home rule.

HB 3564: HUMAN RIGHTS ACT-REAL ESTATE

Amends the Landlord and Tenant Act. Prohibits a landlord from imposing a move-in fee. Provides that a landlord may not demand any charge for the processing, reviewing, or accepting of an application, or demand any other payment, fee, or charge before or at the beginning of the tenancy. Exempts entrance fees charged by nursing homes or similar institutions. Prohibits a landlord from renaming a fee or charge to avoid application of these provisions. Limits fees for the late payment of rent in certain situations. Provides that any provision of a lease, rental agreement, contract, or any similar document purporting to waive or limit these provisions is void and unenforceable as against public policy. Amends the Illinois Human Rights Act. Provides that State policy is that access to housing is a fundamental human right in preventing discrimination based on familial status or source of income in real estate transactions. Changes the definition of "source of income"by stating that the definition prohibits a person engaged in a real estate transaction from requiring a credit check before approving another person in the process of renting real property or requiring a move-in fee in lieu of a security deposit or in addition to a security deposit.

HB 5424: IHDA-HOUSING PLANNING

Amends the Comprehensive Housing Planning Act. Requires the State to prepare and be guided by a 3-year Comprehensive Housing Plan, that is consistent with the affirmative fair housing provisions of the Illinois Human Rights Act and specifically addresses specified underserved populations including low-income households, individuals, and older adults with a population-specific need; survivors of gender-based violence; unnecessarily institutionalized persons; veterans; and youth, including those aging out of the foster care system; and any other high need population, as determined by the State Housing Task Force, to be defined in the Comprehensive Housing Plan, and revisited each planning cycle, as needed. Requires the Comprehensive Housing Plan to reflect the State's commitment to an affordable housing approach for priority populations that promotes access to opportunity and resources for low-income households through certain priority initiatives. Expands the membership on the State Housing Task Force to include the Directors or Secretaries of several State departments and agencies. Requires the State Housing Task Force to, in addition to other activities: (i) adopt a mission statement no later than June 30, 2027 that may be updated during each Comprehensive Housing Plan 3-year cycle, as needed; (ii) oversee the implementation of the Comprehensive Housing Plan; and (iii) vote on research questions and affordable housing topics, which will serve as a framework for meetings and activities, and on definitions to ensure they are aligned with State initiatives. Prohibits the Illinois Housing Development Authority from directly or indirectly having a financial interest in an Authority contract. Repeals a provision concerning the Interagency Committee and removes all references to the Interagency Committee.

HB 5198: AFFORDABLE HOUSING-CILAS

Amends the Affordable Housing Planning and Appeal Act. Requires non-exempt local governments to provide residents with notice and the opportunity for comment at a public hearing prior to adopting an affordable housing plan. Requires a non-exempt local government to provide proof of its compliance with the notice and public hearing requirements when it submits a copy of its affordable housing plan to the Illinois Housing Development Authority. Expands the list of information that must be provided in the affordable housing plan to include, (i) an identification of "specific lands" (rather than "lands") within the jurisdiction that are most appropriate for the construction of affordable housing, (ii) proposed timelines to commence "specific actions and deadlines" (rather than "actions") to implement the components of the affordable housing plan, and (iii) incentives, including certain measures to address the need for affordable housing, that the local government may provide for the purpose of attracting affordable housing. In a provision permitting certain persons to appeal a local government's denial of a proposed affordable housing plan, expands the list to include a service provider that is under contract to provide services for potential residents of a proposed supportive housing project or community-integrated living arrangement that is included in the proposed affordable housing plan. Contains provisions concerning final actions or decisions by the governing body of the local government on the proposed affordable housing plans; appeal procedures and timelines; and other matters. Expands the Illinois Housing Development Authority's rulemaking authority to include the adoption of rules and regulations concerning the substance of affordable housing plans consistent with the changes made in the amendatory Act.

HB 1843: MUNI CD-ZONING LIMITS

Amends the Zoning Division of the Illinois Municipal Code. Removes a provision giving the corporate authorities in each municipality the power to classify, to regulate, and to restrict the use of property on the basis of family relationship. Provides that the powers enumerated in provisions relating to zoning powers of a municipality may not be used in any way that violates or otherwise contradicts any other applicable State or federal law, including the federal Fair Housing Act and the Americans with Disabilities Act. Prohibits a municipality from adopting zoning regulations that prohibit 2 or more individuals who are not related by blood from living together in the same residence. Provides that a municipality may not adopt zoning regulations that prohibit the creation of a community-integrated living arrangement or housing for a community-integrated living arrangement. Limits home rule powers.

HB 3566: EVICTION OF MINORS

Amends the Eviction Article of the Code of Civil Procedure. Requires dismissal of a complaint in its entirety against all defendants if the complaint names a defendant who is a minor at the time of filing or was a minor at the time that the lease agreement at issue was entered. Provides that such an action shall be immediately sealed. Provides that, in addition to any other remedies available to the minor, a minor named as a defendant in violation of the Act is entitled to reasonable attorney's fees, actual damages, and liquidated damages in the amount of $1,000. Provides that nothing in the Act prohibits a party from refiling an action against any defendants who otherwise may be properly named. Provides that, upon dismissing the case, the court may not waive any fees associated with refiling the action against defendants otherwise properly named.

HB 3441: CD CORR-RESOURCES-RELEASE

Amends the Unified Code of Corrections. Provides that, upon the release of a committed person on parole, mandatory supervised release, final discharge, or pardon, the Department of Corrections shall provide the person with resources to acclimate the person to life outside the correctional institution or facility, including access to social workers, clinical psychologists, and other counselors. Provides that the counselors shall assist the person in obtaining housing, employment, education, healthcare, State identification, and other resources that the counselors deem necessary to assist in the person's adjustment to society and the prevention of recidivism. Provides that the Department of Human Services, in consultation with the Department of Corrections, shall provide assistance to the person to achieve the goals of this provision without interference from the person's assigned parole officer.
