Environment (Hazardous Materials)

Amends the Environmental Protection Act. In provisions concerning the regulation of air pollution, water pollution, drinking water, hazardous waste, and landfills, provides that the Illinois Pollution Control Board shall not adopt any standards that are less stringent than those existing in Board regulations. Provides that various provisions of the Act shall not be construed to limit the right of a person to submit to the Board, or for the Board to adopt, regulations more stringent than the regulations promulgated by the Administrator of the United States Environmental Protection Agency.

Amends the Environmental Protection Act. Provides that no person shall use, or cause or allow the use of, any site on which a former waste disposal operation is located in a manner that is inconsistent with the closure of the waste disposal operation. Lists prohibited uses.

Amends the Illinois Enterprise Zone Act. In provisions concerning High Impact Businesses, adds utility-scale brownfield site photovoltaic projects and over 5,000 kilowatts and utility-scale solar projects to High Impact Businesses that may be located, at the time of designation, in an enterprise zone. Amends the Illinois Power Agency Act. Provides that "brownfield site photovoltaic project" includes photovoltaics that are interconnected to an electric utility, a municipal utility, a public utility, or an electric cooperative, where at least 50% of the acreage occupied by the photovoltaics is located on the property regulated under specified United States Environmental Protection Agency or Illinois Environmental Protection Agency programs. Makes other changes

Creates the Climate Change Superfund Act. Creates the Illinois Climate Change Superfund as a special fund in the State treasury. Requires at least 40% of the Fund to be spent on projects that directly benefit disadvantaged communities facing climate change impacts. Directs the Environmental Protection Agency to adopt rules within one year, including regarding the apportionment of liability for climate change for payments into the Fund by responsible parties, regarding qualifying expenditures from the Fund, and regarding an Illinois Climate Change Superfund Program. Requires the Agency to establish procedures to challenge its determinations of liability for climate change and provides for judicial review under the Administrative Review Law. Makes findings. Defines terms. Provides that the Act is severable. Makes conforming changes to the State Finance Act.

In provisions concerning High Impact Businesses, adds utility-scale brownfield site photovoltaic projects and over 5,000 kilowatts and utility-scale solar projects to High Impact Businesses that may be located, at the time of designation, in an enterprise zone. Creates the Household Hazardous Waste Stewardship Act. Requires that manufacturers implement a stewardship plan, beginning January 1, 2028, and establishes related prohibitions. Requires a manufacturer to establish, fund, and implement a stewardship program individually or collectively as part of a stewardship organization, with certain funding requirements. Lists other manufacturer and stewardship organization obligations and requirements. Requires each manufacturer who sells covered products in the State to register with a stewardship organization by April 1, 2027, and annually thereafter, and subsequently also with the Environmental Protection Agency. Requires stewardship organizations to post certain information on a website by January 1, 2028. Prohibits a manufacturer from selling a covered product, beginning in program year 2028, unless the manufacturer is registered and operates a stewardship program or is part of a stewardship organization. Requires stewardship organizations to jointly prepare, no later than January 1, 2027, a household hazardous waste needs assessment. Prohibits a retailer from selling a covered product unless the manufacturer is identified as a participant in a stewardship organization with an approved stewardship plan. Requires collection sites to keep certain records and provide certain data. Lists requirements and procedures for stewardship plans. Lists collection convenience standard requirements. Requires each stewardship organization to jointly submit, by June 1, 2029, and annually thereafter, a report to the Agency. Requires a stewardship organization to pay an annual fee to the Agency and lists responsibilities of the Agency. Exempts activities under the Act from antitrust laws. Allows the Agency to adopt rules. Provides civil penalties for violations. Specifies that it is a Class 4 or Class 3 felony to make a fraudulent material statement to the Agency under the Act. Allows for collection of covered products using a premium collection service. Makes findings. Defines terms. Effective immediately.

Provides that a municipality or county may, to the same extent as an owner or operator, conduct tank removal, abandonment, site investigation, and corrective action with respect to a petroleum orphan underground storage tank in accordance with the requirements of the Leaking Underground Storage Tank Program, except that a municipality or county does not have to elect to proceed as an owner and the costs shall be eligible for payment from the Underground Storage Tank Fund. Defines "orphan underground storage tank". Makes conforming and other changes in provisions regarding the Underground Storage Tank Fund.
