HB 5070: EPA-FEDERAL BACKSTOP

Amends the Environmental Protection Act. In provisions concerning the regulation of air pollution, water pollution, drinking water, hazardous waste, and landfills, provides that the Illinois Pollution Control Board shall not adopt any standards that are less stringent than those existing in Board regulations. Provides that various provisions of the Act shall not be construed to limit the right of a person to submit to the Board, or for the Board to adopt, regulations more stringent than the regulations promulgated by the Administrator of the United States Environmental Protection Agency.

SB 3245: EPA-AIR POLLUTION SETBACKS

Amends the Environmental Protection Act. Provides that the Environmental Protection Agency shall propose and the Pollution Control Board shall adopt rules to ensure mandatory minimum distances are maintained between sources of air pollution and homes, schools, hospitals, and other similar sites in all applicable Clean Air Act permits to protect the public health, except as prohibited by federal law.

HB 5374: EPA-ENVIRONMENTAL JUSTICE

Amends the Environmental Protection Act. Makes findings about the imposition of disproportionate and adverse effects on communities in areas of environmental justice concern. Defines terms. Applies to the following permits for which an owner or operator applies on or after January 1, 2026: (1) a construction permit for a new source that is to be located in an area of environmental justice concern and that is required to obtain from the Agency a CAAPP permit or a Federally Enforceable State Operating Permit; (2) a construction permit for any existing source that is located in an area of environmental justice concern, that possesses a CAAPP permit or a Federally Enforceable State Operating Permit issued by the Agency, and that seeks an increase in annual permitted emissions; or (3) a construction permit for any existing source that is located in an area of environmental justice concern, that seeks an increase in annual permitted emissions, and that will for the first time require a new CAAPP permit or a Federally Enforceable State Operating Permit issued by the Agency. Requires the Environmental Protection Agency to evaluate the application for affects on environmental justice and may suggest additional testing or changes in the application. Requires that the Agency to conduct an evaluation of the prospective owner's or operator's prior experience in owning and operating sources of air pollution before it may issue a construction permit. Makes other changes. Creates the Office of Environmental Justice within the Environmental Protection Agency. Effective immediately.

SB 3772: EPA-ENVIRONMENTAL JUSTICE

Amends the Environmental Protection Act. Provides that, beginning January 1, 2027, upon receipt of certain air pollution control construction permit applications, the Environmental Protection Agency shall evaluate (i) whether the applicable source falls within an area of environmental justice concern and, if so, notify specified persons; (ii) whether emissions can be reduced or limited; (iii) whether additional air quality modeling is needed; and (iv) whether specified permit enhancements are needed. Requires the Agency's permitting decisions to be informed by the applicant's history of violations of environmental laws and other factors. Allows the Agency to adopt rules. Amends the Environmental Justice Act. Establishes the Office of Environmental Justice within the Environmental Protection Agency to coordinate the integration of environmental justice into Agency programs and for other purposes. Requires the Director of the Environmental Protection Agency to appoint an Environmental Justice Officer to administer the Office of Environmental Justice. Effective immediately.

HB 3349: POWERING UP ILLINOIS ACT

Creates the Powering Up Illinois Act. Defines terms. Sets forth findings. Requires an electric utility that operates within the State to (i) upgrade the State's electrical distribution systems as needed and in time to achieve the State's decarbonization goals, and implement federal, State, regional, and local air quality and decarbonization standards, plans, and regulations, (ii) conduct sufficient advance planning, engineering, and construction of increased distribution of system capacity by advance ordering transformers and other needed equipment so that customers can be energized without substantial delay, (iii) promptly energize new customers, including by ensuring that new housing, new businesses, and new charging for light-duty, medium-duty, and heavy-duty vehicles and off-road vehicles, vessels, trains, and equipment can be used without delay caused by a failure of the utility to implement energization projects, (iv) promptly upgrade service when needed by customers, (v) allow customers seeking energization to choose an optional flexible connection agreement, which shall provide a tariffed, voluntary utility offering that requires customers to agree to specified service levels as a requirement of energization or interconnection through the use of demand response technology that limits the net import and export of electricity at the point of common coupling to remain within the rated capacity limits of a customer's existing service connection or distribution circuit, either on a permanent basis or to allow for immediate project operations before service or distribution system upgrades are completed, and (vi) recruit, train, and retain an adequately sized and qualified workforce to carry out the planning, engineering, and construction of electrical distribution systems needed to promptly serve customers seeking energization and service upgrades without sacrificing other necessary activities of the workforce. Sets forth provisions concerning: the staffing of an electrification team; electric utility requirements; recovery of costs; and safety standards. Effective immediately.

HB 1230: EPA-AIR QUALITY FUND

Amends the Environmental Protection Act. Creates the Air Quality Enforcement and Mitigation Fund. Makes a conforming change to the State Finance Act. Provides that the Environmental Protection Agency shall expend 30% of moneys from the Fund for staffing and other functions of the Agency that benefit environmental protection communities and are related to one or more specified purposes. Directs the Agency to establish an Air Quality Community Impact Grant Program to provide grants to nonprofit entities, local health departments, local environmental departments, and school districts to carry out the purposes of the Act. Requires 70% of moneys from the Fund to be expended for grants under the Program for specified purposes in communities affected by violations of the Act. Requires the Agency to adopt rules to implement the Program. Provides that the Agency, in collaboration with environmental interest groups, shall develop a process to identify environmental protection communities. Requires the Agency to post on its website and make publicly available an annual report on the purposes for which grants were awarded under the Program. Contains other provisions. Effective immediately.

HB 1608: EPA-ENVIRONMENTAL JUSTICE

Amends the Environmental Protection Act. Requires the Environmental Protection Agency to annually review and update the underlying data for, and use of, indicators used to determine whether a community is designated as an environmental justice community and to establish a process by which communities not designated as environmental justice communities may petition for such a designation. Provides that, if the Agency grants a permit to construct, modify, or operate a facility that emits air pollutants and is classified as a minor source, a third party may petition the Pollution Control Board for a hearing to contest the issuance of the permit.
