Directs the Department of Taxation to apply the state corporate income tax to advertising revenue earned by major social media platforms if the revenue is derived from content created within the State or from audiences located in the State. Establishes the class C felony offense of criminal property damage to critical infrastructure facilities. Expands the term "critical infrastructure" to include broadband, wireless, and cable networks. Effective 7/1/3000. (HD1)
Codifies net neutrality principles by prohibiting fixed and mobile internet service providers that provide broadband internet access service from engaging in certain practices concerning the treatment of internet traffic. Among other things, prohibits internet service providers from blocking internet traffic on the basis of internet content, application, or service, engaging in paid prioritization or zero-rating internet traffic in exchange for consideration, monetary or otherwise.
Requires a provider of broadband internet access services to be transparent with network management practices, performance, and commercial terms of its broadband internet access services. Prohibits a provider of broadband internet access services from blocking lawful websites, impairing or degrading lawful internet traffic, engaging in paid prioritization or application-specific differential pricing, or interfering with or disadvantaging users of broadband internet access services. Requires an applicant of a broadband-related permit seeking a state-granted or county-granted right to attach small cell or other broadband wireless communication devices to utility poles to comply with certain practices.
Transfers the Hawaii Broadband and Digital Equity Office from the Department of Business, Economic Development, and Tourism to the Department of Accounting and General Services. Transfers the broadband duties of the Director of Commerce and Consumer Affairs to the Hawaii Broadband and Digital Equity Office. Creates a Hawaii Broadband Infrastructure Special Fund. Disbands the Hawaii Broadband Assistance Advisory Council. Requires the Information Technology Steering Committee to oversee and manage public advanced communications technology infrastructure. Appropriates moneys.
Transfers the Hawaii Broadband and Digital Equity Office from the Department of Business, Economic Development, and Tourism to the Office of Enterprise Technology Services in the Department of Accounting and General Services.
