Upholding the Law at Our Border Act This bill requires the Office of Inspector General of the Department of Homeland Security (DHS) to periodically investigate and report on certain issues until there have been fewer than 35,000 apprehensions at the southwest border for three consecutive months. When required, the reports must address certain issues, including (1) the vetting procedures applicable to aliens seeking entry into the United States who were apprehended along the southwest border, (2) the total number of individuals not lawfully present who have been processed and released into the United States, (3) the number of such individuals who have received parole, and (4) an audit of the parole applications. The office must submit such reports (and provide briefings on the reports) to the President, Congress, DHS, and the Department of Justice.

Halt All Lethal Trafficking of Fentanyl Act or the HALT Fentanyl Act This bill places fentanyl-related substances as a class into schedule I of the Controlled Substances Act. A schedule I controlled substance is a drug, substance, or chemical that has a high potential for abuse; has no currently accepted medical value; and is subject to regulatory controls and administrative, civil, and criminal penalties under the Controlled Substances Act. Additionally, the bill establishes a new, alternative registration process for schedule I research that is funded by the Department of Health and Human Services or the Department of Veterans Affairs or that is conducted under an investigative new drug exemption from the Food and Drug Administration. The bill also makes several other changes to registration requirements for conducting research with controlled substances, including permitting a single registration for related research sites in certain circumstances, waiving the requirement for a new inspection in certain situations, and allowing a registered researcher to perform certain manufacturing activities with small quantities of a substance without obtaining a manufacturing registration.
Illegal Immigrant Payoff Prohibition Act This bill prohibits the payment of a settlement to an alien for a civil action brought against the United States in connection with the alien's inadmissibility to, or unlawful presence in, the United States.
Protect Communities from a Porous Border Act of 2021 This bill requires the Department of Homeland Security (DHS) to notify a state before placing an alien in that state and gives the state final authority to prohibit such a placement. At least 10 business days before placing (e.g., detaining or housing) such an individual in a state, DHS must provide certain information to that state, including (1) the individual's biographic and biometric information, including DNA; and (2) a certification that the biometric and biographic information has been checked in various law enforcement and counterterrorism databases. No federal court shall have jurisdiction to review (1) the requirements and procedures established under this bill, or (2) a decision by a state to prohibit the placement of such an individual in the state. The bill also prohibits any federal official from waiving any of the bill's requirements.
Smarter Pretrial Detention for Drug Charges Act of 2021 This bill removes the presumption of pretrial detention for an individual who is charged with a federal drug offense for which the maximum term of imprisonment is 10 years or more.
Preventing Unjust Red Flag Laws Act of 2021 This bill prohibits the use of federal funds to implement or enforce red flag laws. The term red flag laws means a risk-based, temporary, and preemptive protective order that authorizes the removal of firearms without due process.
Make the Migrant Protection Protocols Mandatory Act of 2021 This bill requires the Department of Justice (DOJ) to remove certain aliens from the United States while such an alien's application for admission is pending. Specifically, if an alien arrived by land from a foreign country bordering the United States and the alien is not clearly and beyond a doubt entitled to admission into the United States, DOJ must return that alien to that bordering foreign country while the alien's application for admission is pending. (Currently, DOJ may choose to detain such an alien or return the alien to the bordering foreign country while the application for admission is pending.)
Customs Business Fairness Act of 2021 This bill modifies the treatment of claims by customs brokers for unpaid customs duties in chapter 11 (reorganization) bankruptcy proceedings.
Revealing and Explaining Visa Exclusions for Accountability and Legitimacy Act or the REVEAL Act This bill authorizes the Department of State to publicly disclose the identity of an alien who has been denied admission into the United States because that alien's entry would pose potentially serious adverse foreign policy consequences. The State Department may also reveal the grounds that it relied on to make such a determination. The President must annually report to Congress a list of individuals denied a visa on such foreign policy grounds and another list of the instances when the State Department chose to not publicly disclose the identity of such an individual.
Combating Global Corruption Act of 2021 This bill requires the Department of State to address corruption, including related to the Nord Stream 2 pipeline (a national gas pipeline expected to increase Russia's natural gas export capacity). The State Department must annually publish a ranking of foreign countries based on their government's efforts to eliminate corruption. The bill outlines the minimum standards that the State Department must consider when creating the ranking. These considerations include, for example, whether a country has criminalized corruption, adopted measures to prevent corruption, and complied with the United Nations Convention Against Corruption and other relevant international agreements. Tier one countries meet the standards; tier two countries make some efforts to meet the standards; tier three countries make de minimis or no efforts to meet the standards. If a country is ranked in the second or third tier, the State Department must designate an anti-corruption contact at the U.S. diplomatic post in that country to promote good governance and combat corruption. The bill also requires the State Department, in coordination with the Department of the Treasury, to evaluate whether to impose asset- and visa-blocking sanctions against foreign persons engaged in significant corruption (1) in tier three countries, or (2) related to the Nord Stream 2 pipeline. The State Department must report to Congress about any sanctions imposed under this bill. The evaluation and reporting requirements concerning the Nord Stream 2 pipeline terminate after five years.
