Search Warrants; Authorizes search warrant to be issued to recover deceased body; revises time within which certain search warrants must be returned to court; specifies time period within which search warrant issued for certain devices is considered timely executed; specifies that law enforcement agency may review data or information contained in certain devices after specified periods if devices were timely seized; provides that judge may authorize law enforcement officer applying for search warrant to appear remotely; provides that judge may authorize law enforcement officer applying for search warrant or court order to appear remotely; defines "audio-video communication technology"; authorizes law enforcement agency to obtain search warrant to use drone to conduct search in certain circumstances.
Perfluoroalkyl and Polyfluoroalkyl Substances; Prohibits, beginning on specified date, certain use & sale, purchase, or distribution of aqueous film-forming foam; requires, beginning on specified date, certain entities to submit aqueous film-forming foam inventories & disposal plans to DEP; prohibits, beginning on specified date, possession & use of aqueous film-forming foam; authorizes DEP to administer certain grants or cost share programs; provides penalties & injunctive relief; requires certain public entities disposing of domestic wastewater biosolids and treated effluent to quarterly conduct specified samplings & submit results to DEP; limits purpose such samplings until specified standards are established by EPA & adopted by DEP.
Domestic Violence and Protective Injunctions; Reclassifying penalties for committing a domestic violence offense if a person has a prior conviction for domestic violence; providing that sentencing and incentive gain-time eligibility determinations are made without regard to a penalty enhancement; establishing an electronic monitoring pilot program in a specified county; requiring the sheriff, in consultation with certain persons, to design and implement the pilot program; providing requirements for the pilot program; requiring the Department of Corrections to complete an evaluation and provide specified reports to the Legislature; requiring the Department of Law Enforcement to enter injunctions against dating violence and sexual violence into a statewide verification system, etc.
Faith-based Content in Batterers' Intervention Programs; Specifies that batterers' intervention programs may include faith-based activities, but may not require participation in such activities.
Sexual Offenses; Replaces term "child pornography" with term "child sexual abuse material"; revises criteria related to reclassification of specified offenses; revises mandatory minimum sentences for certain sexual offenses by persons previously convicted of sexual offenses; increases penalty for employing, authorizing, or inducing child of specified age to engage in sexual performance; prohibits person from employing, authorizing, or inducing child younger than 12 years of age to engage in sexual performance; requires mandatory minimum sentences for certain offenses when committed by specified offenders; increases penalty for knowingly soliciting, possessing, controlling, or intentionally viewing certain materials that include child sexual abuse material; provides applicability of specified mandatory minimum sentences; increases penalty for intentionally creating generated child sexual abuse material; prohibits person from transmitting child sexual abuse material to another person; revises punishments for certain sexual activities involving animals; requires certain court order to be effective for certain number of years; increases criminal penalties for possessing child-like sex doll; provides that prosecution for certain acts in connection with obscene, lewd, etc., materials does not prohibit person from prosecution for other specified offenses; requires mandatory minimum sentences for certain offenses when committed by specified offenders; ranks offenses on offense severity ranking chart of Criminal Punishment Code.
Commercial Service Airports; Preempts naming of major commercial service airports to state; provides names for major commercial service airports; provides that renaming specified airport is subject to approval of FAA & execution of certain agreement; provides that such airport names continue to be valid under certain circumstances; requires DOT to annually review provisions naming major commercial service airports for certain purpose; requires DOT to provide certain notice to Legislature; provides requirements for such notice; requires that certain government records created on or after certain date use such airport names; specifies that airport names are branding designations; provides that political subdivision is in compliance with certain provisions under specified circumstances.
Caller Identification Information ; Prohibits transmission of misleading or inaccurate caller identification information; requires telecommunications company to provide telephone number & location from which each telephone call originates; requires telecommunications company to block all telephone calls & text messages that contain manipulated caller identification information; provides exceptions; requires telecommunications companies to implement framework to verify & authenticate caller identification information; requires each telecommunications company to file certification with Federal Communications Commission.
Structure and Legislative Oversight of Executive Agencies; Provides that divisions or offices in executive department may be established only by specific statutory enactment; provides that certain appointments made by Secretary of Business & Professional Regulation are subject to review & approval by Legislature; provides that certain appointments made by Secretary of Transportation are subject to review & approval by Legislature; provides that secretary's restructuring of offices is subject to review & approval by Legislature; provides that certain appointments made by heads of departments are subject to review & approval by Legislature; requires Legislature to dissolve certain divisions, offices, bureaus, sections, & subsections by specified date; removes provisions relating to Office of Minority Health & Health Equity within DOH; provides that state chief information officer shall have all decisionmaking authority with respect to information technology on behalf of all departments & all department divisions, offices, bureaus, sections, & subsections.
Division of State Fire Marshal; Requires Division of State Fire Marshal to accept training & certification of firefighters from another jurisdiction; requires division to make specified finding before denying firefighter certificate; defines "basis certificate"; requires division to adopt certain rules relating to contaminated personal protective equipment & firefighting gear.
