Cottage Food Operations; Citing this act as the "Home Sweet Home Act"; revising the definition of the term “cottage food operation”; increasing the annual gross sales limitation for exempting cottage food operations from certain food and building permitting requirements; authorizing the sale, offer for sale, acceptance of payment, and delivery of cottage food products by mail; preempting the regulation of cottage food operations to the state; prohibiting local governments from prohibiting cottage food operations or regulating cottage food products by cottage food operations, etc.
Agency Contracts for Commodities and Contractual Services; Abrogating the scheduled expiration of provisions relating to certain public agency contracts for services; providing that an agency must issue a request for quote to certain approved vendors when it issues certain requests for quote for contractual services; revising the maximum value of certain contracts that may not be renewed or amended by a state agency before submitting a written report to the Governor and the Legislature; prohibiting certain vendors from submitting bids, proposals, or replies to, or entering into or renewing any contract with, an agency, etc.
Public Records; Citing this law as "Serena's Law"; requiring each county recorder or clerk of the court to make publicly available on an Internet website the identity of a defendant or respondent against whom a protective injunction is entered, as well as the fact that the injunction has been entered; providing for certain persons to request that such information be made available on the public website; requiring county recorders or clerks of the court to post such notices on the website and in the office of each county recorder or clerk of the court; specifying what must be included in notices; requiring that final judgments for injunctions for protection be recorded in official records, etc.
Home-based Businesses; Specifying conditions under which a business is considered a home-based business; providing requirements for home-based businesses; authorizing a home-based business to operate in an area zoned for residential use; specifying that home-based businesses are subject to certain business taxes; providing prohibitions and authorizations for local governmental actions relating to home-based businesses, etc.
Community Association Assessment Notices; Revises provisions relating to condominium, cooperative, & homeowner's associations, including requiring affirmative acknowledgments for certain actions, specified notices to unit & parcel owners, delivery of certain invoices & account statements, & timeframes for foreclosure judgments and liens.
Consumer Protection; Removes provision requiring department to automatically convert registrations of approved registered insurance agencies to insurance agency licenses; prohibits entity from unlicensed activity as adjusting firm unless entity complies with specified requirement; authorizes department to disapprove use of insurance agency names containing words "Medicare" or "Medicaid"; revises timeframe in which insured or claimant may cancel public adjuster's contract to adjust claim without penalty or obligation; specifies requirements for written estimates of loss provided by public adjusters to claimants or insureds; revises timeframe in which insurer must begin investigation after receipt of proof of loss statements; requires insurer to keep records of adjusters interacting with policyholders; requires insurer to include specified notices when providing damage estimates or claim payments.
Dispensing Medicinal Drugs; Authorizes hospitals to dispense limited supply of medicinal drugs to patient of emergency department of hospital or patient discharged from hospital; provides drug supply requirements for prescribing or dispensing of such drugs; authorizes prescriber to provide patient with prescription for medicinal drugs for use beyond initial prescription period.
Doorstep Waste Containers; Removes scheduled repeal of certain provisions regulating use of containers in exit access corridors.
Department of Business and Professional Regulation; Revises & provides requirements relating to electronic reporting, application fee schedules, weight of boxing gloves, fingerprint processing procedures, proof of occupancy of premises, food service establishment audit schedules, delinquency of payment conditions, rules related to submission of certain complaints, & location of Office of the Condominium Ombudsman.
Education; Revises provisions relating to school board term limits, charter schools, lab schools, high-performing charter schools, persistently low-performing schools, schools of hope, virtual schools, personnel qualifications, & capital outlay funding.
Special District Accountability; Requiring certain independent special districts to contract with an independent entity to conduct performance audits; requiring the Office of Program Policy Analysis and Government Accountability to conduct performance audits of certain classifications of independent special districts; requiring the performance audits to be reported by a time certain; requiring that certain data be included in financial audits of special districts, etc.
Rare Disease Advisory Council; Creates Rare Disease Advisory Council; specifies purpose of council; provides for staff & administrative support; prescribes composition of council; provides for initial appointments to council; provides organizational & other meeting requirements for council; prescribes duties & responsibilities of council.
