This Bill would allow all on-premises licensees who sell a bottle of alcohol (other than beer) to place a cap on the bottle and allow patrons to take it home with them for consumption later. Delaware was one of the first states to recognize that it was important that patrons who purchase a bottle of wine have the opportunity to take the remainder of the bottle home with them rather than face the choice of drinking more than they should and driving, or leaving part of the bottle they had paid for at the premise.

This legislation, the Angel Investor Job Creation and Innovation Act for Small Technology Companies, creates an incentive for qualified angel investors to invest capital in qualified Delaware small technology companies..

This bill allows ground-based and hand-held sparklers and certain other nonexplosive, nonairborne novelty items regulated by the federal government to be sold and used in the State. The bill does not legalize firecrackers, bottle rockets, aerials, or any other device that explodes or shoots into the air. The use of those items that may be sold only to persons 18 years of age and older is limited to July 4th and December 31st of each year and sales are limited to the 30 days prior to the allowable use day. This bill allows paper caps used in toy guns contain 16 milligrams or less of pyrotechnic mixture. The sale of sparklers and most other items permitted under this bill is limited to persons 18 and older. The penalty section of 16 Del. C. §6905 applies to this bill. At least forty-three states allow the sale and use of sparklers and other nonexplosive, nonairborne novelty items that are regulated by the U.S. Consumer Product Safety Commission.

Designating February 6, 2018 as "Ronald Reagan Day" in Delaware

Recognizing the beneficial value of being in nature and fishing, this bill expands the list of fishing license exceptions to include residents of long term care facilities who are accompanied by the facility's controlling person.

This Act allows the various at-large members of the Domestic Violence Coordinating Council to be appointed for 3-year terms and be eligible for reappointment. This change is requested by the Council.

The Act amends Section 916 of Title 11 of the Code so that the statutory penalties for the crime of home improvement fraud increase as the amount of the loss to the victim increases, using the same scale applicable to Theft under Section 841 of Title 11 and New Home Construction Fraud under Section 917 of Title 11. Like Theft under Section 841 of Title 11, the amendment also provides for an increase in the level of the offense for amounts under $50,000 where the victim is 62 years of age or older or an "adult who is impaired" or a "person with a disability" as defined in the Code. The Act also amends the definition of "home improvement contract" to provide that a victim's payment can be in any form, not just money, and to clarify that a "home improvement contract" includes all agreements for labor, services and materials to be furnished and performed under the home improvement contract.

This bill removes the expiration date and designates Maypole dancing as the official dance of Delaware.

This bill addresses how a vacancy in the office of New Castle County Executive will be filled. Initially the County Chief Administrative Officer will fill the position. Thereafter a special election shall be held to fill the vacancy for the balance of the term of office. This is the same special election process as applicable to a vacancy in a County Council district.

This Act replaces House Bill No. 285 and, in so doing, removes provisions of House Bill No. 285 related to creating an order of relinquishment process for removing firearms or ammunition from an individual subject to a report from a mental health provider under § 5402 of Title 16 as these provisions are now exclusively contained in House Substitute No. 1 for House Bill No. 302. This Act retains provisions of House Bill No. 285 that do the following: (1) Improve the structure and process related to the Relief from Disabilities Board. (2) Require that information regarding individuals who are declared guilty but mentally ill is reported to the Federal Bureau of Investigation’s National Instant Criminal Background Checks System (NICS). (3) Require that an individual who is voluntarily admitted for inpatient treatment at a psychiatric treatment facility be informed of the individual’s rights and options as a voluntary patient. (4) Clarify that an individual who is emergently detained must be treated the same as an individual who is subject to a provisional admission and may not be considered involuntarily committed for any legal purpose. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.
