AN ACT TO AMEND TITLE 11 OF THE DELAWARE CODE RELATING TO RELEASE OF PERSONS ACCUSED OF CRIMES.

In 2018, the General Assembly enacted House Bill No. 204 of the 149th General Assembly, Chapter 200, Volume 81 of the Laws of Delaware, ("HB 204"), with "the goal of modernizing the pretrial process, reducing reliance on monetary conditions, improving the efficiency and outcomes for the criminal justice system, and ensuring the safety of the community." HB 204 has resulted in the release of violent offenders into our communities, leading to more Delawareans being victimized. Therefore, this Act repeals HB 204, replacing HB 204's provisions with the law in effect before the enactment of HB 204 and bringing back greater safety for law abiding Delawareans and accountability for defendants. This Act also makes technical corrections to conform existing law, and previous law being returned to the Delaware Code, to the standards of the Delaware Legislative Drafting Manual.

AN ACT TO AMEND TITLE 16 OF THE DELAWARE CODE RELATING TO AUTHORIZING A PILOT PROGRAM TO ISSUE GRANTS FOR THE INSTALLATION OF RESIDENTIAL DRINKING WATER PURIFICATION SYSTEMS.

This bill establishes a 2-year residential drinking water purification system pilot program to be administered through the Department of Health and Social Services with funding through the Drinking Water State Revolving Fund.

REQUESTING THE DIVISION OF RESEARCH, THE OFFICE OF MANAGEMENT AND BUDGET, AND THE DELAWARE DEPARTMENT OF TECHNOLOGY AND INFORMATION COOPERATE IN CREATING AN IMPLEMENTABLE PLAN TO STREAM LIVE AUDIO AND VIDEO OF ALL FLOOR AND COMMITTEE ACTION OF THE DELAWARE HOUSE OF REPRESENTATIVES AND SENATE; RECORD ALL SUCH MATERIAL; AND MAKE THESE RECORDINGS AVAILABLE TO THE PUBLIC VIA AN ONLINE ARCHIVE

Requesting the Division of Research, the Office of Management and Budget, and the Delaware Department of Technology & Information to cooperate in creating a detailed and implementable plan to stream audio and video of all floor and committee action of the House of Representatives and Senate; record all such material; and make these recordings available to the public via an online archive. The resolution further requests the 151st General Assembly and the governor to approve and act on the finished plan and authorize the funding needed to implement it.

AN ACT TO AMEND TITLE 19 OF THE DELAWARE CODE RELATING TO POLICE OFFICERS’ AND FIREFIGHTERS’ EMPLOYMENT RELATIONS ACT.

The bill makes any "police officer" employed by the State and its political subdivisions not currently under the jurisdiction of the Police Officers' and Firefighters' Employment Relations Act subject to it. The purpose of this bill is to render all police and firefighters employed by the State not currently subject to the Police Officers' and Firefighters' Employment Relations Act subject to it. Nothing set forth in this bill is intended nor shall be construed to effect the rights of police officers and firefighters currently subject to the Police Officers' and Firefighters Employment Relations Act. In addition, employees classified in bargaining units pursuant to §1311A(b)(10) and (11) are not covered by this Act.

AN ACT TO AMEND TITLE 21 OF THE DELAWARE CODE RELATING TO DISQUALIFICATION FROM DRIVING A COMMERCIAL MOTOR VEHICLE.

This Act brings Delaware into compliance with the federal No Human Trafficking on Our Roads Act by creating a lifetime disqualification for a commercial diver license if the individual engages in human trafficking while using a motor vehicle. This Act also makes technical corrections to conform existing law to the standards of the Delaware Legislative Drafting Manual.
