Eliminate Barriers to Innovation Act of 2021 This bill requires the Securities and Exchange Commission and the Commodity Futures Trading Commission to jointly establish a working group on digital assets. The working group must (1) report on the impact of the U.S. legal and regulatory framework on the digital asset market; and (2) provide recommendations regarding digital asset market fairness and integrity, cybersecurity standards, and the reduction of fraud and manipulation.
Improving FHA Support for Small Dollar Mortgages Act of 2021 This bill directs the Department of Housing and Urban Development (HUD) to report on barriers to making Federal Housing Administration (FHA) single-family mortgage insurance available for mortgages under $70,000. Specifically, HUD must report on policies, practices, and products used by the FHA and actions that will be taken to remove such barriers.
Access to Counsel Act of 2021 This bill provides various protections for covered individuals subject to secondary or deferred inspections when seeking admission into the United States. Covered individuals include U.S. nationals, lawful permanent residents, aliens in possession of a visa, returning asylees, and refugees. The Department of Homeland Security shall ensure that a covered individual subject to secondary or deferred inspection has a meaningful opportunity to consult with counsel and certain related parties, such as a relative, within an hour of the start of the secondary inspection and as necessary during the inspection process. The counsel and related party shall be allowed to advocate on behalf of the covered individual, including by providing evidence and information to the examining immigration officer. A lawful permanent resident subject to secondary or deferred inspection may not abandon lawful permanent resident status until the individual has had a meaningful opportunity to seek advice from counsel, unless the individual voluntarily and knowingly waives in writing this opportunity to seek counsel's advice.
National Senior Investor Initiative Act of 2021 or the Senior Security Act of 2021 This bill establishes the Senior Investor Taskforce within the Securities and Exchange Commission. The taskforce must report on topics relating to investors over the age of 65, including industry trends and serious issues impacting such investors, and make recommendations for legislative or regulatory actions to address problems encountered by senior investors. The Government Accountability Office must report on the financial exploitation of senior citizens.
Promoting Transparent Standards for Corporate Insiders Act This bill directs the Securities and Exchange Commission (SEC) to study and report on possible revisions to limit the ability of issuers of securities and issuer insiders to adopt Rule 10b5-1 trading plans. These plans allow certain employees of publicly traded corporations to sell their shares without violating insider trading prohibitions. The SEC must revise regulations consistent with the results of the study.
Fair Debt Collection Practices for Servicemembers Act This bill prohibits a debt collector from representing to service members that failure to cooperate with a debt collector will result in a reduction of rank, a revocation of security clearance, or military prosecution. The Government Accountability Office must report on the impact of this prohibition on the timely delivery of information to service members, military readiness, and national security.
Housing Financial Literacy Act of 2021 This bill modifies the discount given by the Federal Housing Administration (FHA) on single-family mortgage-insurance premium payments for first-time homebuyers who complete a financial-management counseling program. Under current law, the maximum premium amount for such homebuyers is 2.75% of the original insured principal obligation of the mortgage (compared to 3% for other homebuyers). The bill instead requires that the premium amount for such homebuyers be 25 basis points (0.25% of the original insured principal obligation of mortgage) lower than the amount otherwise established by the FHA. The bill also specifies that first-time homebuyers must complete the financial-management counseling program prior to applying for a mortgage or entering into a sales agreement.
Protection of Saudi Dissidents Act of 2021 This bill imposes temporary limits on arms sales to Saudi Arabia and requires various reports and actions related to the death of Saudi Arabian journalist Jamal Khashoggi. The President may not transfer or authorize for export certain defense articles or services to Saudi Arabia for 120 days after this bill's enactment. The prohibition shall remain in effect for up to three years unless the President periodically certifies to Congress that Saudi Arabia has not conducted (1) forced repatriation, intimidation, or killing of dissidents in other countries; (2) unjust imprisonment in Saudi Arabia of U.S. citizens or lawful aliens; or (3) torture of detainees in custody of the government of Saudi Arabia. The President shall certify to Congress that individuals with Saudi diplomatic credentials are not using such credentials to track or harass Saudi nationals in the United States. If the President does not make such a certification, the President shall close at least one Saudi diplomatic or consular facility in the United States until the certification is made. The bill requires reports to Congress on (1) whether any Saudi officials have engaged in a consistent pattern of harassment against any individual in the United States, and (2) whether the intelligence community fulfilled its duty to warn Khashoggi of the threats to his life.
National Origin-Based Antidiscrimination for Nonimmigrants Act or the NO BAN Act This bill imposes limitations on the President's authority to suspend or restrict aliens from entering the United States. It also prohibits religious discrimination in various immigration-related decisions, such as whether to issue an immigrant or nonimmigrant visa, unless there is a statutory basis for such discrimination. The President may temporarily restrict the entry of any aliens or class of aliens after the Department of State determines that the restriction would address specific and credible facts that threaten U.S. interests such as security or public safety. The bill also imposes limitations on such restrictions, such as requiring the President, State Department, and the Department of Homeland Security (DHS) to (1) only issue a restriction when required to address a compelling government interest, and (2) narrowly tailor the suspension to use the least restrictive means to achieve such an interest. Before imposing a restriction, the State Department and DHS shall consult with Congress. The State Department and DHS shall report to Congress about the restriction within 48 hours of the restriction's imposition. If such a report is not made, the restriction shall immediately terminate. Individuals or entities present in the United States and unlawfully harmed by such a restriction may sue in federal court. DHS may suspend the entry of aliens traveling to the United States on a commercial airline that failed to comply with regulations related to detecting fraudulent travel documents.
Cyber Diplomacy Act of 2021 This bill establishes requirements related to diplomatic engagement with foreign countries on matters of U.S. cyberspace policy. Specifically, the bill establishes the Bureau of International Cyberspace Policy within the Department of State to advise the State Department on cyberspace issues and lead diplomatic efforts on issues related to international cybersecurity, internet access and freedom, and international cyber threats. The bureau must undertake specified duties and responsibilities to implement the stated U.S. policy of working internationally to promote an open, interoperable, and secure internet governed by a multi-stakeholder model that (1) promotes human rights, democracy, and rule of law; and (2) respects privacy and guards against deception, fraud, and theft. The President must devise a strategy for U.S. engagement with foreign governments on international norms related to responsible state behavior in cyberspace. Further, the President is encouraged to enter into executive arrangements with foreign governments that support U.S. cyberspace policy. In addition, annual country reports on human rights practices must include assessments of freedom of expression in each country with respect to electronic information, and the Government Accountability Office must report on U.S. diplomatic processes and other efforts with foreign countries to advance U.S. interests in cyberspace.
Department of Homeland Security Morale, Recognition, Learning and Engagement Act of 2021 or the DHS MORALE Act This bill addresses workforce morale at the Department of Homeland Security (DHS). The bill expands the duties of the Chief Human Capital Officer to address morale, including through leader development and employee engagement, maintaining a catalogue of available employee development opportunities, and issuing a DHS-wide employee engagement action plan. DHS (1) must establish an employee engagement steering committee, and (2) may establish an annual employee award program. DHS shall report to the congressional homeland security committees regarding the impacts of the lapse in appropriations between December 22, 2018, and January 25, 2019, on (1) DHS human resources operations; (2) DHS's ability to meet hiring benchmarks; and (3) retention, attrition, and morale of DHS personnel.
Transit Security Grant Program Flexibility Act This bill establishes periods of performance for the use of public transportation security assistance grant funds. Funds provided pursuant to such a grant for a specified authorized use, including for tunnel protection systems and surveillance equipment, shall remain available for use by a grant recipient for at least 36 months. However, any such funds used for security improvements for public transportation systems or security improvements for stations and other public transportation infrastructure, including those owned by state or local governments, shall remain available for at least 55 months. The Government Accountability Office shall conduct a review of the public transportation security assistance grant program, including an assessment of the manner in which projects under the program address threats to public transportation infrastructure.
