Protecting Life and Taxpayers Act of 2021 This bill requires federally funded entities to certify that they will not, subject to certain exceptions, perform abortions or provide funding to other entities that perform abortions. The bill provides exceptions for abortions (1) in cases of rape or incest; or (2) when the life of the woman is in danger due to a physical disorder, injury, or illness.
Amputation Reduction and Compassion Act of 2021 or the ARC Act of 2021 This bill provides for coverage of peripheral artery disease screening tests without cost-sharing under Medicare, Medicaid, and private health insurance for certain at-risk individuals, and requires the development of certain educational programs and Medicare quality measures to reduce amputations relating to such disease.
Microloan Improvement Act of 2021 This bill revises the microloan program through which the Small Business Administration (SBA) provides, through designated intermediaries, certain financial assistance to small businesses. Specifically, the bill authorizes an intermediary to offer a line of credit to a small business, and it increases the average amount for loans from an intermediary to participating small businesses that makes the intermediary eligible for a reduced interest rate on SBA loans. The bill also places limits on the repayment term for a microloan, and it prohibits the SBA from imposing any additional limitation on the term for repayment of a microloan. Further, the SBA must (1) reserve 15% of new loan funds that are made available for disbursement as microloans to designated underutilized states and make the remaining 85% available for any state, (2) establish a process for an intermediary to provide the major credit reporting agencies with information about a borrower that is relevant to credit reporting, and (3) include information regarding equitable distribution of loan funds in its annual report.
504 Modernization and Small Manufacturer Enhancement Act of 2021 This bill modifies the Small Business Administration (SBA) 504 Loan Program, which provides a small business with SBA financing—through a certified development company (CDC) intermediary—for expansion or modernization. Specifically, the bill adds policy goals, at least one of which a CDC must demonstrate to be eligible for assistance. These include (1) enhancing the ability of a small business to reduce costs by using energy efficient products and generating renewable energy, and (2) aiding the revitalization of any area for which a disaster has been declared or determined. The bill also authorizes a CDC to take specified actions to facilitate the closing of a 504 loan, such as correcting borrower or lender information on loan documents or reallocating up to 10% of the cost of a project. For small manufacturers, the bill (1) increases the maximum loan amount from $5.5 million to $6.5 million, (2) reduces the amount that they must contribute to project costs, (3) increases job retention requirements, and (4) revises collateral requirements and debt refinancing considerations. Further, each SBA district office must partner with a resource partner to provide certain training for small manufacturers.
Workplace Violence Prevention for Health Care and Social Service Workers Act This bill requires the Department of Labor to address workplace violence in health care, social service, and other sectors. Specifically, Labor must issue an interim occupational safety and health standard that requires certain employers to take actions to protect workers and other personnel from workplace violence. The standard applies to employers in the health care sector, in the social service sector, and in sectors that conduct activities similar to those in the health care and social service sectors. In addition, Labor must promulgate a final standard within a specified time line.
Protecting Seniors from Emergency Scams Act This bill requires the Federal Trade Commission to report on, and increase awareness regarding, scams targeting older adults. Specifically, the commission must report on the number and type of scams that target older adults and provide policy recommendations to prevent such scams; revise the commission's web portal with current information about such scams, including contact information for law enforcement and adult protective services agencies; and coordinate with media outlets and law enforcement to disseminate such information.
COVID-19 Safe Birthing Act This bill expands coverage of maternal health care under Medicare, Medicaid, the Children's Health Insurance Program (CHIP), and private health insurance. The bill specifically provides for Medicare and Medicaid coverage of maternal health services that are furnished via telehealth. It also requires Medicaid, CHIP, and private health insurance to cover prenatal services and one year of postpartum care without cost-sharing. The bill also requires short-term, limited-duration health insurance plans, association health plans, and health care sharing ministries to cover COVID-19 testing without cost-sharing. It also requires state Medicaid programs to provide coverage of COVID-19 testing for pregnant individuals who are uninsured. Additionally, as a condition of Medicare participation, hospitals must permit pregnant individuals to be accompanied by someone of their choosing (in addition to a doula or other health care worker) during labor, delivery, and recovery, and may not implement any discriminatory policies that restrict hospital access or birthing options for pregnant individuals.
Ensuring Seniors Access to Local Pharmacies Act of 2021 This bill establishes several requirements for prescription drug plans under the Medicare prescription drug benefit. Specifically, the bill requires prescription drug plans to allow any pharmacy located in a health professional shortage area, a medically underserved area, or a rural area to be included as an in-network pharmacy if the plan already has other in-network pharmacies in the same area. The bill also establishes certain standards for prescription drug plans regarding pharmacy reimbursements and related disclosures. Among other things, the bill prohibits prescription drug plans from reimbursing a pharmacy in an amount that is less than the amount the pharmacy benefits manager (PBM) reimburses an affiliated pharmacy (i.e., a pharmacy that has a shared ownership interest with the PBM) for the same services.
Truth in Buffalo Labeling Act This bill prohibits the sale of food that contains water buffalo and is labeled as buffalo unless the specific term used in the labeling is water buffalo .
FDA Modernization Act of 2021 This bill allows an applicant for market approval for a new drug to use methods other than animal testing to establish the drug's safety and effectiveness. Under this bill, these alternative methods may include cell-based assays, organ chips and microphysiological systems, sophisticated computer modeling, and other human biology-based test methods.
Traveling Parents Screening Consistency Act of 20 21 This bill directs the Government Accountability Office to review implementation of requirements regarding screening by the Transportation Security Administration (TSA) of baby formula, breast milk, purified deionized water for infants, and juice on airlines. Specifically, the review must consider whether the TSA effectively manages consistency of screening protocol applications for formula, breast milk, purified deionized water for infants, and juice; evaluate the need for the TSA to update and revise procedures for such screening; assess whether the TSA effectively tracks passenger complaints related to such screening to monitor trends and identify inconsistencies; evaluate the TSA's communications and information sharing practices for passengers, air carriers, and airports relating to screening protocols for such screening; evaluate the TSA's policies regarding the screening of passengers with nursing products; and make recommendations for improving the TSA's overall screening practices relating to such screening.
Careful Resumption Under Improved Safety Enhancements Act or the CRUISE Act This bill requires various activities to mitigate the impact of COVID-19 on the operation of cruise ships. Specifically, the bill establishes a working group comprised of specified federal departments and industry stakeholders to develop recommendations for resuming cruise ship operations. In addition, the Centers for Disease Control and Prevention (CDC) must issue (within 30 days) separate recommendations on mitigating the introduction, transmission, and spread of COVID-19 onboard cruise ships and to communities onshore. The CDC must consult with the working group on these recommendations. Furthermore, the Department of Health and Human Services must revoke by July 4, 2021, its order issued on November 4, 2020, which restricts the operation of cruise ships in U.S. waters.
