This joint resolution proposes a constitutional amendment prohibiting total outlays for a fiscal year from exceeding total receipts for that fiscal year unless Congress authorizes the excess by a two-thirds vote of each chamber. The prohibition excludes outlays for repayment of debt principal and receipts derived from borrowing. The amendment prohibits total outlays for any fiscal year from exceeding 18% of the gross domestic product of the United States, unless two-thirds of each chamber of Congress provides for a specific increase above this amount. The amendment requires a two-thirds vote of each chamber of Congress to impose a new tax, increase the statutory rate of any tax, or increase the aggregate amount of revenue. It requires a three-fifths vote of each chamber to increase the limit on the debt of the United States. The President must submit an annual budget in which total outlays do not exceed total receipts and 18% of the gross domestic product of the United States. The amendment prohibits a court from ordering a revenue increase to enforce the requirements. Congress may waive specified requirements when a declaration of war is in effect or the United States is engaged in a military conflict that causes an imminent and serious military threat to national security.
This resolution urges the President not to return the United States to the Joint Comprehensive Plan of Action—commonly known as the Iran nuclear deal—unless the agreement is revised and Iran meets specified conditions. Further, the resolution recommends that U.S. sanctions against Iran remain in place until Iran has complied with all elements of a revised agreement.
Put Students First Act of 2021 This bill prohibits the Department of Education (ED) from providing certain FY2021 education funds or COVID-19 (i.e., coronavirus disease 2019) relief funds to an elementary or secondary school that does not offer in-person instruction by April 30, 2021. A school must forfeit or return these funds if it does not offer in-person instruction by that date. Additionally, the bill outlines the use of forfeited and returned funds. A state may regain eligibility for these funds if it submits an implementation plan to ED that provides students with school choice options. If a state does not submit an implementation plan, then the funds must be provided as grants to states with the highest percentage of schools offering in-person instruction.
Child and Animal Abuse Detection and Reporting Act This bill requires the Children’s Bureau of the Administration for Children and Families to disseminate information through the National Clearinghouse on Child Abuse and Neglect Information about the incidence of cases of child abuse that involve abuse to animals.
Fair Access to Credit Scores Act of 2021 This bill requires certain consumer reporting agencies to disclose, upon request, as part of a consumer's free annual disclosure (1) the consumer's current credit score, (2) other information in the consumer's file regarding risk scores or predictors, and (3) any other consumer information the Consumer Financial Protection Bureau considers appropriate with respect to consumer financial education. Consumer reporting agencies must maintain these scores or predictors in a consumer's file for at least one year after the data is generated.
Medical Debt Relief Act of 2021 This bill modifies requirements related to the reporting of medical debt. Specifically, a consumer reporting agency is prohibited from adding medical debt information to a consumer credit report if the debt was fully paid or settled, or is less than a year old. Additionally, a debt collector must notify the consumer prior to reporting medical debt to a consumer reporting agency.
Keep Our Promise to America's Children and Teachers Act or the Keep Our PACT Act This bill provides funding through FY2031 for grant programs operated by local educational agencies to provide supplementary educational and related services to low-achieving students and other students who attend elementary and secondary schools with relatively high concentrations of students from low-income families. Additionally, the bill permanently reauthorizes the grant program to assist states and outlying areas in providing special education and related services to children with disabilities.
Taking Account of Institutions with Low Operation Risk Act or the TAILOR Act This bill requires federal financial regulatory agencies to (1) tailor any regulatory actions so as to limit burdens on the institutions involved, with consideration of the risk profiles and business models of those institutions; and (2) report to Congress on specific actions taken to do so, as well as on other related issues. The bill's tailoring requirement applies not only to future regulatory actions but also to regulations adopted within the last seven years.
Reciprocity Ensures Streamlined Use of Lifesaving Treatments Act of 2021 This bill establishes a reciprocal marketing approval process that allows for the sale of a drug, biological product, or medical device that has not been approved by the Food and Drug Administration (FDA) if the product is approved for sale in another country and there is an unmet need. Specifically, the bill requires the product's sponsor to demonstrate, among other things, that (1) the product has been approved in one of the specified countries, (2) neither the FDA nor any of the specified countries have withdrawn approval for the product because of safety or effectiveness concerns, and (3) there is a public health or unmet medical need for the product. The FDA may decline approval if the FDA determines that the product is not safe or effective. The FDA may condition reciprocal approval on the conduct of postmarket studies. The FDA must issue a decision on whether to grant a request for reciprocal marketing approval within 30 days of receiving the request. Congress may pass a joint resolution to grant reciprocal marketing approval of a product that the FDA declines to approve through the reciprocal process.
Unconscionable Pricing Act This bill makes it unlawful for any person to sell, rent, or lease an emergency supply at an unconscionable price during a federally-declared emergency. A price is unconscionable if (1) it exceeds 10% of the average price for the same or similar emergency supply during the 30 days before the emergency was declared, and (2) such price increase is not related to the reasonable costs incurred to sell or rent the supply. The bill provides authority for the Federal Trade Commission and state attorneys general to enforce the requirements of this bill.
Temporary Reciprocity to Ensure Access to Treatment Act or the TREAT Act This bill temporarily authorizes the interstate provision of in-person and telehealth services. This authorization applies during, and for at least 180 days after, the COVID-19 (i.e., coronavirus disease 2019) emergency. Specifically, subject to scope of practice and other requirements, a health care professional may provide health services in any U.S. jurisdiction based on that individual's authorization to practice in any one state or territory. The bill also provides certain related powers to health care professional regulatory bodies, such as medical boards. Specifically, a regulatory body may investigate and take disciplinary actions against a professional who provides services pursuant to this bill to a patient in that body's jurisdiction.
COVID-19 Testing, Reaching, And Contacting Everyone (TRACE) Act This bill authorizes the Centers for Disease Control and Prevention to award grants for testing, contact tracing, monitoring, and other activities to address COVID-19 (i.e., coronavirus disease 2019). Entities eligible for these grants include certain clinics and hospitals, nonprofits, and schools.
