S 2166: RETAIN GPS and Satellite Communications Act of 2021

Recognizing and Ensuring Taxpayer Access to Infrastructure Necessary for GPS and Satellite Communications Act of 2021 or the RETAIN GPS and Satellite Communications Act of 2021 This bill places conditions on entities that deploy commercial terrestrial operations in the 1525-1559 megahertz (MHz) band or the 1626.5-1660.6 MHz band of the electromagnetic spectrum. These frequency bands are traditionally used for satellite operations, including the global positioning system (GPS). On April 19, 2020, the Federal Communications Commission approved an application for a low-power 5G wireless network in such bands despite concerns about the network interfering with GPS and other operations on adjacent bands. In its application, the entity committed to update, repair, or replace federal devices, platforms, or systems affected by its operations. This bill requires an entity (including the previously approved entity) that deploys terrestrial operations in the designated bands to reimburse a federal agency or a person for certain costs if the entity's operations interfere with or otherwise affect the operations of the agency or person. These costs may include necessary upgrades, repairs, or replacements to satellite communication devices and related equipment, as well as expenses for engineering studies and labor. Reimbursable costs owed by the entity transfer to any assignee, successor, or purchaser of its license to deploy terrestrial operations in the designated bands. The bill also expressly authorizes federal agencies to directly accept from the entity reimbursements for incurred costs.

HR 3999: Metropolitan Statistical Area Preservation Act

Metropolitan Statistical Area Preservation Act This bill prohibits the Office of Management and Budget (OMB) from establishing, for purposes of designating areas as metropolitan statistical areas (MSAs), a minimum population for the urban area of such MSA that is more than 50,000. The OMB may, for statistical purposes only, establish other statistical area designations with higher minimum population requirements for such urban areas.

S 2072: Unsubscribe Act of 2021

Unsubscribe Act of 20 21 This bill requires that certain consumer protections are included in negative option agreements (an agreement under which a consumer's failure to take an affirmative action is considered approval to be charged for goods or services). These agreements are prohibited unless the agreement discloses all material terms; a consumer provides express informed consent before the consumer is charged for a product or the agreement is automatically renewed; and the agreement provides the consumer with a way to cancel the agreement, in the same manner by which the agreement was entered, before incurring further or increased charges. Further, under free-to-pay conversion contracts (a type of negative option agreement where a consumer is charged a nominal introductory rate and an increased rate after the introductory period ends), before charging a consumer the provider of the good or service must obtain the consumer's informed consent, provide the terms of the contract, and provide information about how to cancel the contract. The bill also requires that certain notifications are provided to consumers in the context of other forms of negative option agreements online, such as notice between two and seven days before an automatic renewal. The bill provides for enforcement of these requirements by the Federal Trade Commission and state attorneys general.

S 2076: PASTEUR Act of 2021

The Pioneering Antimicrobial Subscriptions To End Up surging Resistance Act of 2021 or the PASTEUR Act of 2021 This bill authorizes the Department of Health and Human Services (HHS) to enter into subscription contracts for critical-need antimicrobial drugs, provides $11 billion in appropriations for activities under the bill, and contains other related provisions. A manufacturer of a Food and Drug Administration-approved antimicrobial drug may apply to HHS to have the drug designated as a critical-need antimicrobial, and HHS may enter into a subscription contract for such a critical-need antimicrobial. The bill imposes certain requirements related to such contracts, including a mechanism to lower payments under the contract in certain instances to limit the manufacturer's revenue from the drug. Furthermore, HHS and the Centers for Disease Control and Prevention (CDC) shall award grants to support efforts to encourage the appropriate use of antimicrobial drugs and efforts to combat antimicrobial resistance. The CDC shall also track and assess data relating to antibacterial resistance and human antibiotic use and make such data publicly available. HHS shall also establish a Committee on Critical Need Antimicrobials. The committee shall develop a list of prioritized infections for which new antimicrobial drug development is needed, among other duties. Within six years of the bill's enactment, the Government Accountability Office shall report to Congress a study on the bill's effectiveness in developing priority antimicrobial drugs.

S 2061: Telemental Health Care Access Act of 2021

Telemental Health Care Access Act of 2021 This bill eliminates certain restrictions relating to Medicare coverage of mental health services that are provided through telehealth. Current law allows for coverage of such services regardless of the geographic location of the originating site (i.e., the location of the beneficiary) after the end of the COVID-19 public health emergency, as long as the beneficiary previously received in-person services and continues to receive in-person services at specified intervals. The bill eliminates these in-person requirements.

HR 2639: Trillion Trees Act

Trillion Trees Act This bills establishes a variety of requirements and incentives to plant trees and conduct other land management practices for the purposes of capturing and storing carbon in domestic and international trees and forests. Additionally, the bill provides incentives to research or develop other carbon sequestration tools. Specifically, the bill directs the Department of Agriculture (USDA) to set targets to increase forest carbon stock through January 1, 2100, for the purposes of sequestering and storing carbon in U.S. forests. It also establishes and provides funding for the Trillion Trees Challenge Fund to provide grants to nonfederal entities for activities related to reforestation efforts on public or private lands. In addition, it raises the cap on the Reforestation Trust Fund to enhance forest health in the National Forest System and requires the USDA to establish a Tree City USA Grant Program. The bill also allows the U.S. Agency for International Development to enter into an agreement with a nonprofit organization to establish an International Forest Foundation to promote reforestation and prevent deforestation. Additionally, it establishes requirements and incentives to address seedling shortages and support nurseries. Finally, the bill provides market incentives to research or develop other carbon sequestration tools relating to biochar, sustainable building practices, biochemical and bioplastic products, and biomass energy.

HR 2585: FIRE Act of 2021

Forestry Improvements to Restore the Environment Act of 2021 or the FIRE Act of 2021 This bill provides for salvage activities after a wildfire is contained on certain National Forest System lands. No later than 60 days after a wildfire is contained on such lands (1) the Forest Service, to the maximum extent practicable, shall complete a survey of the lands that were impacted by such wildfire; and (2) the Department of Agriculture (USDA) shall convert the timber sales applicable to such lands that were impacted by such wildfire to salvage sales. The bill designates a categorical exclusion for forest management activities where the primary purpose of the activity is for roadside salvage activities that allow for the removal of hazard trees that are within 200 feet of a roadway center line. Activities carried out pursuant to this bill shall be subject to judicial review in the same manner as authorized hazardous fuels reduction projects. A court may not order a preliminary injunction enjoining the USDA from proceeding with timber sales authorized under this bill.

HR 2244: Flexible Financing for Rural America Act

Flexible Financing for Rural America Act This bill allows rural utility service providers to submit to the Department of Agriculture (USDA) a request to adjust the interest rate or modify the terms of certain loans. The request shall include a report summarizing how the adjustment or modification will assist the borrower in providing critical utility services to a rural community. Specifically, on receipt of a request, USDA or the Department of the Treasury (in the case of a loan owned by the Federal Financing Bank) must adjust the interest rate on the loan to match certain interest rates for obligations of comparable maturity to the term remaining on the loan (or a higher rate requested by the borrower), and make modifications to the loan terms as necessary to address changes in the financial position of the borrower due to the COVID-19 public health emergency and to promote the financial sustainability of the borrower. In carrying out the adjustments or modifications, USDA or Treasury shall not impose or collect any fee from, or impose any penalty on, a borrower. The bill also provides funding to implement the adjustments and modifications and for the liquidation of residual intragovernmental amounts owed by the Federal Financing Bank in connection with certain loans.
