Finish the Wall Act This bill requires the Department of Homeland Security (DHS) to resume activities related to the construction of a barrier system along the U.S.-Mexico border and addresses other border-related issues. DHS must resume all such construction activities that were planned or underway prior to January 20, 2021. DHS must also expend all funds appropriated or explicitly obligated since October 1, 2016, for construction of this barrier system. DHS may not cancel contracts for activities related to such construction entered into on or before January 20, 2021. Furthermore, within 14 days of this bill's enactment, DHS must certify to Congress that U.S. Customs and Border Protection facilities that process adults taken into custody at the border are fully compliant with certain laws related to the collection of DNA. (Among other things, these laws allow for the collection of DNA samples from non-U.S. persons detained under U.S. authority.)
Time to Rescue United States Trusts Act of 2021 or the TRUST Act of 2021 This bill establishes congressional rescue committees to develop recommendations and legislation to improve critical social contract programs. A critical social contract program is a federal program for which a federal trust fund is established (e.g., Social Security, Medicare, and federal highway programs), with outlays of at least $20 billion during the year preceding the year in which this bill is enacted, and for which the amount of dedicated federal funds and federal trust fund balances will be inadequate to meet the total amount of outlays of the program that would otherwise be made. Each rescue committee may develop recommendations and legislation to improve the program for which it was established, including by (1) increasing the duration of positive balances of the federal trust fund established for the program, and (2) providing for the solvency of the federal trust fund established for the program during a 75-year period. Congress must use specified expedited legislative procedures to consider legislation that is approved and submitted by the rescue committees.
Remote and Mobile Worker Relief Act of 2021 This bill prohibits the wages or other remuneration earned by an employee who is a resident of a taxing jurisdiction (i.e., states, localities, the District of Columbia, territories or possessions) and performs employment duties in more than one taxing jurisdiction from being subject to income tax in any other taxing jurisdiction other than (1) the taxing jurisdiction of the employee's residence, and (2) the taxing jurisdiction within which the employee is present and performing employment duties for more than 30 days during the calendar year in which the wages or remuneration are earned. The 30-day requirement is extended to 90 days in 2020 and 2021 for employees performing duties outside the taxing jurisdiction of their residence during the COVID-19 pandemic. The bill exempts employers from income tax withholding and information reporting requirements for employees not subject to income tax in the taxing jurisdiction. For purposes of determining penalties related to withholding and information reporting requirements, an employer may rely on an employee's annual determination of the time expected to be spent in the taxing jurisdiction in the absence of the employer's actual knowledge of fraud or collusion between the employer and employee to evade tax. For the purposes of this bill, the term employee excludes professional athletes, professional entertainers, production employees who perform services in connection with certain film, television, or other commercial video productions, and public figures who are persons of prominence who perform services for wages or other remuneration on a per-event basis. The bill also sets forth a rule for the classification of wages earned by employees working remotely.
Bank Service Company Examination Coordination Act of 2021 This bill requires the coordination of state banking agencies with federal banking agencies in regulating and examining the activities of bank service companies. It also allows for the sharing of information related to examinations and regulations between federal and state agencies.
AI Scholarship-for-Service Act This bill establishes a federal artificial intelligence (AI) scholarship-for-service program to recruit and train AI professionals to lead and support AI in federal, state, local, and tribal governments. Specifically, the National Science Foundation must establish criteria to designate qualified institutions of higher education (IHEs) as eligible to participate in the program. Such criteria must include (1) measures of an IHE's demonstrated excellence in the education of students in AI; and (2) measures of an IHE's ability to attract and retain a diverse and nontraditional student population in science, technology, engineering, and mathematics. Further, the program must (1) provide scholarships through qualified IHEs to students who are enrolled in programs of study related to AI, (2) provide scholarship recipients with internship opportunities, (3) prioritize the employment placement of scholarship recipients in executive agencies, (4) identify opportunities to promote multidisciplinary programs of study that integrate basic or advanced AI training with other fields of study, and (5) support education research programs to train AI researchers and practitioners. Additionally, the post-award employment obligations of a scholarship recipient must include three years of work for an executive agency; Congress; an interstate agency; a state, local, or tribal government; or a government-affiliated nonprofit that is considered to be critical infrastructure. A scholarship recipient who completes less than the required three years of service must repay the scholarship, or the scholarship must be treated as a Federal Direct Unsubsidized Stafford Loan that is subject to repayment.
Withstanding Attempts to Encroach on our Resources Act of 2021 or the WATER Act This bill specifies which bodies of water fall under the scope of the Clean Water Act and are thereby under federal jurisdiction. Specifically, the bill provides statutory authority for the definition of waters of the United States , commonly known as WOTUS, included in the 2020 Navigable Waters Protection Rule: Definition of "Waters of the United States." The 2020 rule replaced a 2015 rule that included a more expansive definition of WOTUS.
Chiropractic Medicare Coverage Modernization Act of 2021 This bill expands Medicare coverage of chiropractic services to include all services provided by chiropractors, rather than only subluxation corrections through manual manipulation of the spine.
Protecting Investors' Personally Identifiable Information Act This bill prohibits the Securities and Exchange Commission (SEC) from requiring a national securities exchange, association, or a member of either to provide a market participant's personally identifiable information to satisfy the reporting requirements of the Consolidated Audit Trail (which tracks market activity). However, this information must be provided to the SEC upon request. The SEC must destroy the information not later than one day after the conclusion of the matter for which this information was required.
PUA Eligibility Clarification Act of 2021 This bill revokes the authority of the Department of Labor to establish additional eligibility criteria for COVID-19 pandemic unemployment assistance with respect to self-certification by individuals who are directly affected by the COVID-19 public health emergency. Labor must rescind the guidance titled Expanded Eligibility Provisions for the Pandemic Unemployment Assistance (PUA) Program , issued on February 25, 2021. The guidance makes individuals eligible to receive regular unemployment compensation and COVID-19 PUA if they (1) refuse an offer to work or return to work because of certain safety concerns, (2) provide services to educational institutions or educational service agencies, and (3) experience a reduction of hours or a temporary or permanent layoff. A recipient of such PUA before enactment of this bill is not required to repay it. However, this requirement excludes individuals who, as of such enactment, were approved for PUA but have not received it.
Iran Nuclear Deal Advice and Consent Act of 2021 This bill prohibits the use of federal funds to rejoin the Joint Comprehensive Plan of Action—commonly known as the Iran nuclear deal—unless the President commits to submit any successor agreement to the Senate for advice and consent as a treaty.
This resolution expresses the sense of the House of Representatives that (1) clean water is a national priority, and (2) the 2020 final rule titled The Navigable Waters Protection Rule: Definition of "Waters of the United States" should not be withdrawn or vacated.
Quantum Network Infrastructure and Workforce Development Act of 2021 This bill supports research in quantum networking and communications. The Quantum Networking Working Group within the Subcommittee on Quantum Information Science of the National Science and Technology Council shall submit to Congress a report that has a plan for the advancement of quantum networking and communications technology in the United States. The National Institute of Standards and Technology shall carry out research to facilitate the development and standardization of quantum networking and communications technologies and applications. The Department of Energy shall supplement the Energy Sciences Network User Facility with dedicated quantum network infrastructure to advance development of quantum networking and communications technology. The National Science Foundation (NSF) shall enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to study ways of supporting the next generation of quantum leaders. The NSF shall prioritize the better integration of quantum information science and engineering into the science, technology, engineering, and mathematics (STEM) curriculum for each grade level from kindergarten through grade 12. The NSF shall carry out the Next Generation Quantum Leaders Pilot Program to provide funding for the education and training of the next generation of students in the fundamental principles of quantum mechanics.
