Limits restrictions on portable cooling devices in residences by landlords, homeowners associations, condominium associations and local governments. Directs Oregon Health Authority to create program to acquire air conditioners and air filters for distribution on emergency basis to eligible individuals. Appropriates moneys for program. Requires that Housing and Community Services Department website contain list of dates where counties experienced extreme heat events and contain information for landlords regarding state programs and services that may help tenants meet cooling needs. Requires new residential dwelling units to provide adequate cooling facilities. Requires rented spaces in facilities to provide adequate electrical service for tenant's reasonable heating and cooling uses for new manufactured dwellings and floating homes and for updated electrical connections. Establishes Heat Pump Deployment Program within State Department of Energy to provide grants to entities to support purchase and installation of heat pumps and related upgrades. Establishes Heat Pump Deployment Advisory Council. Establishes Heat Pump Deployment Fund. Appropriates moneys for fund. Authorizes State Department of Energy to make available for rental housing grants for upgrades to support cooling facilities and rebates for heat pump purchases and installations. Establishes Residential Heat Pump Fund. Requires department to provide grants to entity to assist landlords with creating or operating community cooling centers. Requires department to study cooling facilities for certain residential dwellings. Requires department to report on programs to interim committee of Legislative Assembly no later than September 15, 2023. Appropriates moneys to department for fund and programs. Sunsets fund and programs on January 2, 2025. Expands Department of Human Services grant program for clean air shelters ] spaces that provide cleaner air to include spaces that provide warming and cooling shelters and facilities ]. Appropriates moneys to department. Adds Indian health center and manufactured dwelling park nonprofit cooperative to participants eligible for Healthy Homes Program grants. Directs Department of Consumer and Business Services , Employment Department and Oregon Health Authority to enter into intergovernmental agreement for disclosure of data related to outbreak of COVID-19 in workplaces ] sharing of information to enable Department of Consumer and Business Services to inform beneficiaries of their rights to workers' compensation death benefits. Restricts Oregon Health Authority to sharing information regarding deaths from COVID-19 associated with workplace outbreaks published by authority. Declares emergency, effective on passage.
Requires Department of Human Services to establish certification process for direct care providers of home or community-based services and implement online registry of direct care providers of home or community-based services. Specifies requirements for certification and information to be displayed on online registry. Requires department to work with stakeholder groups to design certification requirements, explore ways to improve skill level and training of caregivers and improve caregivers' pathways to continued education and advancement. Sunsets January 2, 2024. Requires department to report to Joint Interim Committee on Ways and Means on work with stakeholders and on implementation of certification process and registry. Authorizes high school teachers who are employed by education service districts to serve as members of Transfer Council. Directs public universities and community colleges to charge eligible veterans in-state tuition for certain distance education courses. Expands eligibility for in-state tuition to include individuals who are granted humanitarian parole, asylum, conditional permanent residency or temporary protected status by any federal agency, provided that individual has not previously established residence in any state or territory of United States or District of Columbia. Requires graduate student employees at public university to sign form allowing university to release specified contact information. Requires school districts and public charter schools to accept credits earned by students in specified educational programs and to apply those credits to high school graduation requirements. Provides that appropriate education for children enrolled in educational program under Youth Corrections Education Program or Juvenile Detention Education Program includes transition services. Allows for modifications to or exemptions from requirements related to provision of menstrual products in certain student bathrooms. Requires provision of menstrual products in alternate location when public education provider does not have control of student bathrooms. Allows high school equivalency student, homeschooled student or student who attends public charter school to meet academic eligibility requirements for participation in interscholastic activities after student demonstrates that student meets specified academic standards and specified amount of time has passed. Expands protections of right to participate in interscholastic athletics to students of all high school equivalency programs. Directs Department of Corrections to develop plan and to provide online access to educational programs for adults in custody at Coffee Creek Correctional Facility and Snake River Correctional Institution. Modifies eligibility requirements and award amounts for Oregon Promise program. Allows Superintendent of Public Instruction to grant waiver of physical education requirements if school district or public charter school is unable to meet requirements because of human-created disaster or natural disaster. Prohibits marijuana retailer or medical marijuana dispensary from being located within 1,000 feet of building where public prekindergarten or kindergarten program is provided by school district or education service district. Modifies calculation of salary paid to active member of Public Employees Retirement System if member is public charter school employee, member was informed in writing that member was eligible to participate in system and public charter school made contributions to system on member's behalf. Modifies determination of eligibility for part-time faculty member of public institution of higher education for purpose of health care benefits. Declares emergency, effective on passage.
Allows volunteer qualified health care providers to administer health care services in this state during health care emergency. ] Allows Public Health Director to direct and deploy volunteer emergency health care providers during health care emergency ] under specified circumstances . Requires Oregon Health Authority to provide workers' compensation coverage for volunteer emergency health care providers. Defines "health care emergency. ] Requires individual and group health insurance policies, health care service contractors and multiple employer welfare arrangements to provide reimbursement for at least three primary care visits annually in addition to one annual preventive primary care visit covered without cost-sharing. Exempts commercial plans offered to public employees by Public Employees' Benefit Board and Oregon Educators Benefit Board. Requires enrollee in individual or group policy or certificate of health insurance and member of coordinated care organizations to be assigned by insurer or coordinated care organization to primary care provider if enrollee has not selected primary care provider within specified timelines. Allows enrollee or member to select different primary care provider at any time. Prohibits individual and group health insurance policies, health care service contractors, multiple employer welfare arrangements and, beginning January 1, 2024, state medical assistance program from denying coverage for services provided by behavioral health home and patient centered primary care home because services were provided on same day or in same facility. Limits copayments for services provided by behavioral health home and patient centered primary care home on same day or in same facility. Prohibits individual and group health insurance policies, health care service contractors, multiple employer welfare arrangements and, beginning January 1, 2024, state medical assistance program from requiring prior authorization for specialty behavioral health services provided at behavioral health home or patient centered primary care home. Clarifies that certain contracts between pharmacies or pharmacists and pharmacy benefits managers are subject to specified requirements. Declares emergency, effective on passage.

Creates income or corporate excise tax credit allowed to small forestland owner that elects to observe riparian timber harvest restriction applicable to large forestland owner, in lieu of using harvest option available to small forestland owner. Includes no-harvest dry channel portion of small nonfish perennial stream in forest conservation area eligible for tax credit. Prohibits transfer of credit to successor forestland owner. Provides for allowance of credit and retention of harvest restrictions for 50 years. Applies to all tax years beginning on or after January 1, 2023. Allows credit to be used against estate tax, in the alternative to use as income tax credit. Applies to estates of decedents dying on or after January 1, 2023. Takes effect on 91st day following adjournment sine die.
Extends definition of "education employer" for purposes of statutory public service loan forgiveness program responsibilities to include community colleges and public universities. Alters method of calculating who is considered full-time faculty member at community college or public university for purpose of program to include any faculty member who engages in 30 or more full-time equivalent work hours per week, with each hour of lecture time or classroom time constituting 4.35 full-time equivalent work hours. Authorizes community college or public university to alter multiplier used to calculate full-time faculty member through collective bargaining. Makes changes to statutory public service loan forgiveness program responsibilities retroactive to date faculty member began employment at community college or public university September 25, 2021 ]. Alters eligibility requirements for subcommittees established by Transfer Council. Extends date by which Higher Education Coordinating Commission must submit report to Legislative Assembly relating to additional legislation or funding required to develop electronic system for dissemination of information regarding foundational curricula and unified statewide transfer agreements from December 15, 2021, to December 15, 2022. Declares emergency, effective on passage.
Requires Department of Human Services to allow specified individuals receiving in-home services and supports to receive agency with choice services to perform employment-related functions with respect to direct support professionals employed by individuals to provide in-home services and supports. Specifies criteria for agencies to be certified by department to provide agency with choice services. Includes persons providing agency with choice services as mandatory reporters of abuse. Requires department to adopt rules to ensure fiscal transparency in, and high quality of, services provided to individuals with intellectual or developmental disabilities and specifies minimum requirements for rules. Prohibits department and Oregon Health Authority from requiring single-family dwellings used for residential training homes or adult foster homes to have sprinkler systems if dwelling has been operated as residential training home or adult foster home pursuant to license issued prior to July 1, 2024, and operator meets other specified criteria. Sunsets January 2, 2026. Requires department to submit various reports to certain committees of Legislative Assembly regarding options for community-based services, licensing fees and civil penalties. Extends deadline for recall petition to be filed from 100th day after filing prospective petition to 120th day. Extends deadline for filing officer to verify recall petition signatures from 10 days to 30 days. Extends deadline by which Secretary of State or Attorney General must notify subjects that complaint has been filed from 48 hours to three business days. Extends deadline for when recount demand and supplemental demand must be filed to align with current statute. Extends deadline for individuals nominated or elected by write-in votes to respond to nomination or election to align with current statute. Allows filing officers to send notice to write-in candidates by electronic mail only. Extends deadlines for precinct committeeperson elections to align with current statute. Updates term of office of precinct committeeperson to align with current statute. Requires Secretary of State to ensure that county election officials conduct election recounts in manner that is consistent, transparent, accurate and pursuant to all applicable laws in recounts conducted in statewide ballot measures or involving nomination or election of listed public offices. Requires county clerk to provide notice to Secretary of State of date, time and location of recount and information regarding all aspects of recount process. Requires Secretary of State to ensure consistency in recount processes across counties involved in recount to extent practicable and to be responsible for certification of results of election or nomination. Reduces number of electors who must be registered as member of minor political party in order for minor political party to retain political party status from one-half of one percent to one-quarter of one percent of total number of registered electors in state. Makes public education providers and federally recognized Indian tribes in Oregon eligible for certain grants related to cleaner air spaces and smoke filtration systems. Instructs Department of Human Services to provide support to public education providers and federally recognized Indian tribes in Oregon that take lead roles in operating and planning cleaner air spaces. Increases minimum age for participation in Oregon Conservation Corps Program from 13 years of age to 16 years of age. Instructs Department of Land Conservation and Development to identify recommended changes to statewide land use planning program and local comprehensive plans and zoning codes related to wildfire risk, and to report to Legislative Assembly, State Wildfire Programs Director and Wildfire Programs Advisory Council on recommended changes on or before October 1, 2022. Provides that accessory dwelling units must comply with applicable requirements related to defensible space. Takes effect on 91st day following adjournment sine die.
