Treat and Reduce Obesity Act of 2021 This bill expands Medicare coverage of intensive behavioral therapy for obesity. Specifically, the bill allows coverage for therapy that is provided by (1) a physician who is not a primary care physician; or (2) other health care providers (e.g., physician assistants and nurse practitioners) and approved counseling programs, if provided upon a referral from, and in coordination with, a physician or primary care practitioner. Currently, such therapy is covered only if provided by a primary care practitioner. The bill also allows coverage under Medicare's prescription drug benefit of drugs used for the treatment of obesity or for weight loss management for individuals who are overweight.
Non-Opioids Prevent Addiction In the Nation Act or the NOPAIN Act This bill temporarily establishes separate payments for certain non-opioid treatments under the Medicare prospective payment system for hospital outpatient department services and the payment system for ambulatory surgical center services. The bill applies to pain management treatments that are able to replace or reduce opioid consumption, as shown through clinical trials or data.
This resolution requests that the President transmit to the Senate documents related to the amount of funding that was provided in specified laws regarding COVID-19 (i.e., coronavirus disease 2019) and is currently unspent. The specified laws include the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020; the Families First Coronavirus Response Act; the Coronavirus Aid, Relief, and Economic Security Act (CARES Act); the Paycheck Protection Program and Health Care Enhancement Act; and Division N of the Consolidated Appropriations Act, 2021.
Protecting the Right to Organized, Transparent Elections through a Constitutionally Trustworthy Electoral College Act (PROTECT Electoral College Act) This bill temporarily suspends federal election security grants and conditions receipt of future grants on certain state certifications. The bill also requires a study on the 2020 presidential election. Specifically, the bill suspends through July 1, 2022, election security grants. During this time period, new grants may not be awarded and previous grant funds may not be expended. Further, the bill conditions receipt of future election security grants on a state legislature certifying certain matters, including that the state's mail-in voter verification procedures are specifically established in statute. The state legislature must also certify that unless there is a statute that specifically authorizes the practice, the state (1) does not provide mail-in ballots to voters unless a voter specifically requests a ballot; and (2) does not permit third parties, except for a voter's family member or caregiver, to return a voter's completed ballot. The bill prohibits election assistance funds from being used to further an election procedure that is not expressly set forth in state statute. Additionally, the Government Accountability Office must study and report on the administration of the 2020 presidential election. The report must analyze specific matters for each state that received election security grants, including an analysis of a state's use of these grants and any subsequent actions taken by its state legislature.
Modern Worker Empowerment Act This bill requires the use of common law rules for defining an employee under the Fair Labor Standards Act of 1938. Generally, an individual is an employee under common law rules when an employer controls what work will be done and how it will be done, among other factors.
Railroad Employee Equity and Fairness Act or the REEF Act This bill permanently exempts payments made from the Railroad Unemployment Insurance Account from sequestration. Sequestration is a process of automatic, usually across-the-board spending reductions under which budgetary resources are permanently cancelled to enforce specific budget policy goals. Currently, this exemption ends 30 days after the termination of the COVID-19 national emergency period.
This resolution expresses the sense of the House of Representatives that the United States should support, and not limit access to, all domestic sources of energy development in an effort to achieve full energy security, including by expanding use of renewable and alternative energy sources, and increasing domestic oil production.
Protecting American Energy Production Act This bill prohibits the President from declaring a moratorium on the use of hydraulic fracturing unless Congress authorizes the moratorium. The bill also expresses the sense of Congress that states should maintain primacy for the regulation of hydraulic fracturing for oil and natural gas production on state and private lands.
Hearing Protection Act This bill removes silencers from the definition of firearms for purposes of the National Firearms Act. It also treats persons acquiring or possessing a firearm silencer as meeting any registration and licensing requirements of such Act. The Department of Justice must destroy certain records relating to the registration, transfer, or making of a silencer. The bill also revises the definitions of firearm silencer and firearm muffler under the federal criminal code and includes such items in the 10% excise tax category.
Concealed Carry Reciprocity Act This bill establishes a federal statutory framework to regulate the carry or possession of concealed firearms across state lines. Specifically, an individual who is eligible to carry a concealed firearm in one state may carry or possess a concealed handgun (other than a machine gun or destructive device) in another state that allows its residents to carry concealed firearms. It sets forth requirements for the lawful concealed carry across state lines. The bill preempts most state and local laws related to concealed carry and establishes a private right of action for a person adversely affected by interference with a concealed-carry right established by this bill.
This concurrent resolution expresses the sense of Congress that school administrators should safely reopen schools for in-person instruction as soon as possible.
This resolution supports the designation of National Tribal Colleges and Universities Week.
