Enacts the building up immigrant legal defense or BUILD act to provide competitive workforce development and capacity building grants to eligible entities that are seeking to expand access to representation for individuals facing deportation by increasing the workforce and strengthening the legal services infrastructure needed to provide such representation.
Establishes the New York state ICE-free zones act to prohibit the use of state or municipal property for civil immigration enforcement activity; requires signage to be posted at the entrance to state or municipal property or other areas that are accessible to the public stating that civil immigration enforcement activity is not allowed; provides an exception that civil immigration activity may be conducted on such property pursuant to a valid judicial warrant specifying that such activity may be conducted on such property for a specified purpose.
Prohibits public entities from contracting with airlines that transport individuals who have been detained by U.S. immigration and customs enforcement without being afforded due process rights; prohibits certain sales and use tax exemptions on fuel sold to an airline that transports individuals who have been detained by U.S. immigration and customs enforcement without being afforded due process rights.
Prohibits governmental entities from entering into agreements to house individuals in immigration detention facilities; requires governmental entities to terminate existing contracts for the detention of individuals in immigration detention facilities.
Prohibits and regulates the discovery and disclosure of immigration status; prohibits police officers, peace officers, school resource officers, probation agencies, state entities, state employees, and municipal corporations from questioning individuals regarding their citizenship or immigration status; regulates the disclosure of information relating to immigration status; prohibits an educational agency, higher education agency, school employee, school safety personnel, or third-party contractor from collecting information about a person's citizenship, immigration status, nationality, or country of origin, unless required by law or necessary to administer a public program or benefit sought by such person.
Requires the court to advise a defendant that if such defendant is a noncitizen resident and is convicted of a crime, whether by plea or trial, such conviction may result in such defendant's deportation; allows a withdrawal of a plea of guilty by a noncitizen resident if such noncitizen resident is threatened with deportation and such noncitizen resident is not so advised of such threat of deportation.
Prohibits immigration enforcement in school settings; prohibits all public and charter schools from allowing law enforcement officials inside school property to access a student, except to address an imminent safety situation or if they have an appropriate judicial warrant or judicial order.
Relates to permitting an incarcerated individual who has had a final order of deportation issued against such incarcerated individual, has not been convicted of an A-1 felony and who is eligible for early release to receive a conditional release.
Requires police and peace officers receive a lawful order before assisting with immigration enforcement; requires federal agents identify themselves at the request of public officers, police officers or peace officers; establishes penalties for federal agents who fail to identify themselves.
