This bill (S 6971) sets new documentation requirements for lenders seeking to foreclose on residential mortgages in New York. It requires lenders to prove ownership of the mortgage note, provide a complete payment history from loan origination, and document the physical location and chain of custody of the original note. These rules apply specifically to foreclosures on one- to four-family residential properties. The bill also clarifies that defendants can raise statute of limitations or "lack of standing" defenses at any time during the case, not just in initial pleadings.

S 8313 authorizes the transfer of a specific state-owned parcel at 39 Sullivan Road in North Salem and Lewisboro, Westchester County, to The Arc Westchester New York, a nonprofit supporting adults with disabilities, for $1 and additional considerations. The land must be used solely for a group home serving adults with disabilities, with a reverter clause requiring the property to return to the state if that purpose ends. The transfer requires The Arc to submit a formal resolution within one year of the bill's effective date, approved by its managing board, to secure the conveyance. The bill expires two years after enactment.
This bill would prevent mortgage lenders from penalizing borrowers who don't set high enough rental rates on properties covered by their mortgages. It voids any mortgage clause requiring minimum rents or punishing low rents, applying to all mortgages regardless of when they were created, renewed, or modified. The law directly affects property owners with mortgages who might face fees or default penalties for not meeting arbitrary rent minimums. This policy change ensures lenders cannot enforce such clauses as against public policy.
