Environmental Justice Mapping and Data Collection Act of 2021 This bill establishes an interagency Environmental Justice Mapping Committee that must create a tool to identify environmental justice communities. Environmental justice communities are communities with significant representation of communities of color, low-income communities, or tribal and indigenous communities that experience, or are at risk of experiencing, higher or more adverse human health or environmental effects, as compared to other communities. The Environmental Protection Agency (EPA) must establish an environmental justice data repository to maintain the data collected by the committee. The EPA must make the repository available to regional, state, local, and tribal governments.
Support And Value Expectant Moms and Babies Act of 2021 or the SAVE Moms and Babies Act of 2021 This bill prohibits the Food and Drug Administration (FDA) from approving any new drug (either as a brand-name drug or a generic) intended to terminate a pregnancy and imposes additional restrictions on such drugs that are already approved. Under the bill, an already-approved drug intended to terminate a pregnancy may be dispensed to a patient only with a prescription. Furthermore, the FDA may not approve any labeling change that would authorize (1) using the drug after 70 days of gestation, or (2) dispensing the drug by any means other than in-person administration by the prescribing health care practitioner. The FDA must also impose additional restrictions on such already-approved drugs, including by (1) requiring the prescribing health care practitioner to receive a special certification, (2) prohibiting the practitioner to also act as the dispensing pharmacist, and (3) requiring the practitioner to have the ability to provide surgical intervention to the patient. The bill also rescinds any investigational use exemption already granted to such a drug if the bill would have prohibited the FDA from granting the exemption. (Currently, the FDA may grant an exemption to certain market approval requirements if a drug is intended solely for use in safety and effectiveness investigations.)
Energy Resilient Communities Act This bill requires the Department of Energy to establish a program that awards grants to make critical energy infrastructure more resilient to climate change hazards, such as grants for developing clean energy microgrids that support critical community infrastructure or customers of electric utilities with special energy needs due to medical conditions.
Protecting Americans from Unnecessary Spread upon Entry from COVID-19 Act of 2021 or the PAUSE Act of 2021 This bill maintains immigration restrictions put in place under public health emergency authorities to prevent the introduction of COVID-19 (i.e., coronavirus disease 2019) from foreign countries. Specifically, the bill prohibits the Department of Health and Human Services from rescinding or reducing the stringency of the restrictions. It also prohibits the Department of Homeland Security from stopping or reducing enforcement of the restrictions. These prohibitions remain in effect until (1) federal and state COVID-19 emergency orders are lifted, and (2) the risk of introducing COVID-19 in or from Canada and Mexico is minimal.
Ally's Act This bill requires private health insurance plans to cover certain hearing devices and systems (e.g., bone-anchored auditory implants) and related items and services. The bill also imposes limits on cost sharing.
Medicare Economic Security Solutions Act This bill modifies provisions relating to enrollment periods for Medicare medical services. Among other things, the bill establishes a late enrollment penalty of 15% of monthly premiums and applies the penalty for a period equal to twice the number of months in each 12-month period during which the individual was not enrolled. Currently, the late enrollment penalty is 10% of monthly premiums for each 12-month period during which the individual was not enrolled, and the penalty continues to apply for as long as the individual is enrolled in Medicare medical services. The bill also expands the special enrollment periods to individuals who have health insurance coverage other than through their employer.
Comprehensive Breast Reconstruction Act of 2021 This bill provides for Medicare, Medicaid, and private health insurance coverage of certain tattooing services in connection with post-mastectomy breast reconstruction, and aligns the scope of Medicare and Medicaid coverage of such breast reconstruction with that of private health insurance. Specifically, the bill provides for coverage of reconstructive tattooing services that are performed by a health care practitioner or state-licensed tattoo artist pursuant to a physician prescription, and expands Medicare and Medicaid coverage to include all stages of reconstruction, surgery to produce a symmetrical appearance, and prostheses and physical complications of mastectomies (e.g., lymphedemas).
Mental Health Access Improvement Act of 2021 This bill provides for coverage of marriage and family therapist services and mental health counselor services under Medicare. It also excludes such services from the skilled nursing facility prospective payment system, and authorizes marriage and family therapists and mental health counselors to develop discharge plans for post-hospital services.
Improving Social Determinants of Health Act of 2021 This bill requires the Centers for Disease Control and Prevention (CDC) to establish a program to improve health outcomes and reduce health inequities by, for example, coordinating activities across the CDC. As part of the program, the CDC must award grants to eligible organizations to build capacity to address social determinants of health. The CDC shall provide for an independent evaluation of certain grants and report findings to Congress.
This bill reauthorizes through FY2026 and revises the Energy Efficiency and Conservation Block Grant Program. Under the program, the Department of Energy provides grants to local governments, states, and Indian tribes for energy efficiency and conservation projects and programs. This bill expands the allowable uses of grant funds to include the deployment of energy distribution technologies that significantly expand access to alternative fuels.
Jobs to Fight COVID-19 Act of 2021 This bill requires the Department of Labor to award grants to states and other governmental and native American entities to (1) support the recruitment, placement, and training of—and provide employment to—certain individuals seeking employment in COVID-19 (i.e., coronavirus disease 2019) contact tracing and pandemic response positions; and (2) assist with the transition to new employment or education and training of these individuals in preparation for and upon termination of such employment. The employees must be paid at least the required prevailing wage and fringe benefit rates. In addition, the Centers for Disease Control and Prevention (CDC), in coordination with the Department of Health and Human Services and state, local, tribal, and territorial health departments, must establish and implement a national evidence-based system for COVID-19 testing, contact tracing, surveillance, containment, and mitigation. The CDC shall also award grants or contracts to these entities for such activities and to public entities to implement multilingual and culturally appropriate COVID-19 awareness campaigns.
Protecting Access to Post-COVID-19 Telehealth Act of 2021 This bill makes permanent several telehealth flexibilities that were initially authorized during the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019), particularly with respect to Medicare coverage of telehealth services. For example, the bill permanently allows federally qualified health centers and rural health clinics to serve as the distant site (i.e., the location of the health care practitioner) for telehealth services under Medicare. Payment must be made in the same manner as for non-telehealth services, rather than in accordance with a separate methodology determined by the Centers for Medicare & Medicaid Services (CMS). The bill also permanently allows beneficiaries to receive Medicare telehealth services at any site, regardless of type or location, and grants the CMS general authority to waive any other requirements during any emergency period.
