Temporary Reciprocity to Ensure Access to Treatment Act or the TREAT Act This bill temporarily authorizes the interstate provision of in-person and telehealth services. This authorization applies during, and for at least 180 days after, the COVID-19 (i.e., coronavirus disease 2019) emergency. Specifically, subject to scope of practice and other requirements, a health care professional may provide health services in any U.S. jurisdiction based on that individual's authorization to practice in any one state or territory. The bill also provides certain related powers to health care professional regulatory bodies, such as medical boards. Specifically, a regulatory body may investigate and take disciplinary actions against a professional who provides services pursuant to this bill to a patient in that body's jurisdiction.
This resolution expresses support for a National Day of Mourning for the lives lost as a result of COVID-19 (i.e., coronavirus disease 2019).
Stopping the Mental Health Pandemic Act This bill requires the Substance Abuse and Mental Health Services Administration to award grants to states, tribal nations, local governments, behavioral health and primary care providers, and community organizations to support behavioral health treatment and services during the COVID-19 (i.e., coronavirus disease 2019) pandemic.
COVID HCBS Relief Act of 2021 This bill temporarily increases the applicable Federal Medical Assistance Percentage (i.e., federal matching rate) under Medicaid for certain approved home- and community-based services that are provided between October 1, 2020, and September 30, 2022. As a condition for receiving the increased rate, a state must agree to undertake activities to improve the delivery of such services during and after the public health emergency relating to COVID-19 (i.e., coronavirus disease 2019), such as by providing additional benefits to home health workers and by helping individuals who were relocated to nursing facilities during the emergency move back to their homes.
Reopen Schools Act This bill requires a local educational agency (LEA) to reopen its elementary and secondary schools as a condition for receiving certain supplemental education emergency relief funding. Specifically, an LEA must provide in-person instruction to at least 50% of its students in order to receive the full funding. An LEA that provides in-person instruction to at least some of its students shall have its funding reduced on a pro rata basis.
Essential Pay for Essential Workers Act This bill requires employers to pay essential health care employees a premium amount in addition to their regular rate of pay during an emergency period. It also allows employers a payroll tax credit for the payment of such enhanced wages to essential employees.
Apprenticeship Futures for All Act This bill requires the Office of Apprenticeship (OA) within the Department of Labor to award grants, contracts, or cooperative agreements to eligible entities if the eligible entity is a qualified intermediary to (1) support national industry and equity intermediaries in establishing or expanding sector-based partnerships to support the delivery or expansion of programs under the national apprenticeship system to significant scale in the United States, or (2) serve programs under the national apprenticeship system in a local or regional setting. The delivery or expansion of programs under the national apprenticeship system shall be (1) in key sectors, including manufacturing, information technology, cyber security, health care, insurance and finance, energy, hospitality, retail, construction, and other sectors identified by the OA as targeted for expansion under the national apprenticeship system; or (2) for nontraditional apprenticeship populations, women, minorities, individuals with disabilities, and individuals impacted by the criminal or juvenile justice system.
USPS Fairness Act This bill repeals the requirement that the U.S. Postal Service annually prepay future retirement health benefits.
Coronavirus Unemployment Benefits Tax Relief Act This bill excludes from gross income, for income tax purposes, up to $10,200 of unemployment compensation received by an individual in a taxable year beginning in 2020.
Anti-Racism in Public Health Act of 2021 This bill establishes within the Centers for Disease Control and Prevention (CDC) a National Center on Antiracism and Health and a law enforcement violence prevention program. Among other activities, the new center must declare racism a public health crisis, collect and analyze data, and administer research and grant programs to address racism and its impact on health and well-being. Additionally, the bill specifically directs the CDC's National Center for Injury Prevention and Control, in coordination with the Department of Justice and other relevant stakeholders, to carry out the law enforcement violence prevention program by conducting research and supporting other activities pertaining to law enforcement violence and public health.
Public Health Emergency Privacy Act This bill imposes privacy, confidentiality, and security requirements on the use and disclosure of COVID-19 (i.e., coronavirus disease 2019) emergency health data. This is data that is linked to an individual or device, such as test results. The requirements apply to organizations that collect, use, or disclose emergency health data electronically or that manage websites or applications for contact tracing and other COVID-19 response activities. These organizations must provide notice of privacy and other policies. They must also ensure the accuracy of, prevent discrimination based on, and limit disclosure of the data. If an organization collects data from at least 100,000 individuals, it must publicly report additional information about how it uses and discloses the data. Furthermore, the bill prohibits the use of emergency health data for commercial advertising or in ways that restrict access to opportunities, services, and other accommodations. It also prohibits government entities and organizations from using this data to infringe on the right to vote. The Department of Health and Human Services must report on the civil rights impact of the collection, use, and disclosure of health data. The bill provides for enforcement by the Federal Trade Commission, states, and a private right of action. It further specifies that certain dispute resolution mechanisms, such as arbitration, are unenforceable with respect to disputes arising under the bill.
COVID–19 Price Gouging Prevention Act This bill makes it unlawful for any person to sell or offer for sale a consumer good or service during a public health emergency resulting from COVID-19 (i.e., coronavirus disease 2019) at a price that (1) is unconscionably excessive, and (2) indicates that the seller is using the circumstances related to the public health emergency to increase prices unreasonably. The bill provides authority for the Federal Trade Commission and state attorneys general to enforce the requirements of this bill.
