S 5117: Medicare & You Handbook Improvement Act of 2022

Medicare & You Handbook Improvement Act of 2022 This bill specifically requires the Centers for Medicare & Medicaid Services to describe the types of prior authorization requirements and other utilization management requirements that may apply under Medicare in the Medicare & You handbook, including how to inquire about requirements under Medicare Advantage (MA) or prescription drug plans. It also requires the handbook to include a description of the network sizes of MA plans and an illustrative example showing the impact of switching from an MA plan to Medicare on the ability to purchase Medigap supplemental policies.

S 5: A bill to amend title XVIII of the Social Security Act to ensure appropriate supervision requirements for outpatient physical therapy and outpatient occupational therapy.

This bill prohibits the supervision requirements for physical therapy assistants and occupational therapy assistants for covered outpatient services under Medicare from being different from supervision requirements under state law.

HR 1283: CONTRACT Act of 2021

Continuity for Operators with Necessary Training Required for ATC Contract Towers Act of 2021 or the CONTRACT Act of 2021 This bill exempts certain air traffic controllers from a required reduction in their retirement annuity payment on account of earnings from certain work performed while entitled to such annuity. Under current law, retired Federal Aviation Administration air traffic controllers receive an annuity payment during the period between the mandatory retirement age of 56 and the Social Security minimum age of 62. Such annuity payment is required to be reduced by a certain percentage of any excess earnings during this period. The bill exempts from such reduction in annuity payments an air traffic controller who participates in the Air Traffic Control Contract Program (a public-private partnership for air traffic control services) following mandatory retirement.

S 5104: NACIE Improvement Act

National Advisory Council on Indian Education Improvement Act or the NACIE Improvement Act This bill revises the membership and duties of the National Advisory Council on Indian Education. Specifically, the bill requires the council to (1) include at least one member who is the president of a tribal college or university, and (2) submit its annual report to the Department of Education (ED) and the Department of the Interior. ED and Interior must consider the council's report when preparing their budget materials.

HR 9306: States Handling Access to Reciprocity for Employment Act

States Handling Access to Reciprocity for Employment Act or the SHARE Act This bill requires the Federal Bureau of Investigation to make available criminal history record information to a state occupational or professional licensing authority for background checks of individuals seeking a license under an interstate compact. A state licensing authority may not share criminal history record information with the compact's commission, any other state entity or licensing authority, or the public, but may inform the compact's commission of completion of a background check.

HR 2512: Chisholm National Historic Trail and Western National Historic Trail Designation Act

Chisholm National Historic Trail and Western National Historic Trail Designation Act This bill designates (1) the Chisholm National Historic Trail, and (2) the Western National Historic Trail. The Department of the Interior shall administer any portion of these trails that is located on nonfederal land only (1) with the voluntary consent of the owner of the nonfederal land, and (2) if the portion qualifies for certification as a component of the applicable trail. The approval by an owner of applicable nonfederal land of a certification agreement shall satisfy the voluntary consent requirement. A certification agreement may be terminated at any time. The establishment of these trails does not authorize any person to enter private property without the consent of the private property's owner. Interior may accept a donation of land or an interest in land for these trails, with specified exceptions. Land or an interest in land may not be acquired for these trails by eminent domain or condemnation.

SJRES 64: A joint resolution disapproving of the rule submitted by the Department of Homeland Security relating to "Public Charge Ground of Inadmissibility".

This joint resolution nullifies the final rule submitted by the Department of Homeland Security titled Public Charge Ground of Inadmissibility and published on September 9, 2022. The 2022 final rule nullified an August 14, 2019, final rule. The 2019 final rule made it more likely that a non-U.S. national ( alien under federal law) would be denied admission or lawful permanent resident status because that individual is likely to become a public charge (i.e., receive certain public benefits). This joint resolution restores into effect the nullified 2019 final rule.

S 5076: Service-Disabled Veteran Opportunities in Small Business Act

Service-Disabled Veteran Opportunities in Small Business Act This bill requires the Small Business Administration to provide training to relevant employees at any federal agency that awards in a fiscal year less than 3% of its prime contracts and subcontracts to small businesses owned by service-disabled veterans.

S 1009: HOPR Act

Homeland Procurement Reform Act or the HOPR Act This bill directs the Department of Homeland Security (DHS) to ensure that procurement of certain items, such as body armor and other protective gear, meets specified requirements, including that a fraction of procurement funds be used for items manufactured by U.S. small businesses. The bill sets forth requirements for waivers of such requirements based on a national emergency or a major disaster. DHS shall (1) ensure that covered items are purchased at a fair and reasonable price, and (2) study the adequacy of uniform allowances provided to employees of frontline operational components (i.e., Customs and Border Protection and other listed agencies and entities). Further, DHS must report to Congress recommendations on how it can procure additional items from domestic sources and bolster the domestic supply chain for items related to national security.
