SB 3687: $DHS-EVICTION RESOLUTION

Appropriates $5,000,000 from the General Revenue Fund to the Department of Human Services for grants to counties with court-based eviction early resolution programs and associated legal assistance, mediation, and other services. Effective July 1, 2026.

SB 3813: HOME ILLINOIS PROGRAM

Amends the Department of Human Services Act. Provides that, if a municipality with a population of 500,000 or more that receives grant funding from the Department of Human Services for emergency and transitional housing fails to achieve compliance with federal and State disability discrimination laws by July 1, 2027, the Department of Human Services shall require 30% of funds allocated for emergency and transitional housing to go toward improving accessibility and achieving compliance with federal and State disability discrimination laws.

HB 5626: MUNI CD-ACCESSORY DWELLINGS

Amends the Illinois Municipal Code. Provides that, 8 months after the effective date of the amendatory Act, a municipality shall, on any lot located in a residential zoning district that permits single-family dwellings, allow (1) on an area of not more than 2,500 square feet, at least one detached single-family dwelling unit; (2) on any lot with an area of more than 2,500 square feet and not more than 5,000 square feet, up to 4 dwelling units; (3) on any lot with an area of more than 5,000 square feet and not more than 7,500 square feet, up to 6 dwelling units; and (4) on any lot with an area of more than 7,500 square feet, up to 8 dwelling units, including cottage clusters. Provides that each municipality shall permit accessory dwelling units in all zoning districts that permit single-family dwellings without additional requirements for lot size, setbacks, aesthetic requirements, design review requirements, frontage, space limitations, or other controls beyond those required for single-family dwelling units without an accessory dwelling unit. Provides that, if a municipality fails to complete its plan review within the deadlines established under the provisions, then the applicant may retain a qualified third-party plan reviewer. Provides that, if a municipality fails to conduct a required inspection within 2 business days, then the applicant may retain a qualified third-party inspector. Provides that municipalities authorized to levy impact fees must calculate fees using the statewide formula structure issued by the Department of Commerce and Economic Opportunity. Provides that, beginning January 1, 2027, the corporate authorities of a municipality shall not establish minimum automobile parking requirements for (A) residential dwellings of less than 1,500 square feet; (B) affordable housing projects under the Illinois Affordable Housing Act; (C) assisted living establishments; (D) ground level nonresidential spaces in mixed-use buildings; or (E) buildings undergoing a change of use from nonresidential to residential. Amends the Counties Code. Provides that, beginning January 1, 2027, no building code adopted by a county or municipality may prohibit residential buildings from having a single stairway serving as an exit for all units if the building satisfies specified requirements. Limits home rule powers. Makes other changes.

SB 4060: MUNI CD-MIDDLE HOUSING

Amends the Illinois Municipal Code. Provides that a municipality shall provide for at least one residential zoning district in which detached single-family dwellings are permitted on lots with an area of not more than 2,500 square feet. Provides that a municipality may not require a minimum lot area of more than 2,500 square feet for detached single-family dwellings in any residential zoning district that permits detached single-family dwellings. Provides that, 8 months after the effective date of the amendatory Act, a municipality shall, on any lot located in a residential zoning district that permits single-family dwellings, allow (1) on an area of not more than 2,500 square feet, at least one detached single-family dwelling unit; (2) on any lot with an area of more than 2,500 square feet and not more than 5,000 square feet, up to 4 dwelling units; (3) on any lot with an area of more than 5,000 square feet and not more than 7,500 square feet, up to 6 dwelling units; and (4) on any lot with an area of more than 7,500 square feet, up to 8 dwelling units, including cottage clusters. Provides that a municipality must allow an existing principal residential structure to be converted to any middle-housing type if (1) the structure is not expanded by more than 50% of its existing floor area or more than 1,200 square feet, whichever is greater; and (2) the conversion complies with applicable building codes and preservation or landmark laws. Provides that municipalities may not adopt or enforce standards for bulk, lot area, yards, height, automobile parking, density, floor-area ratio, lot coverage, access, unit size, building separation, and design that (1) impose requirements on middle housing that are more restrictive than those applicable to detached single-family dwellings; (2) require automobile parking mandates for residential dwellings of less than 1,500 square feet and require automobile parking mandates no greater than specified requirements; and (3) require any form of discretionary review, unless the same review is required for detached single-family dwellings. Limits home rule powers.

SB 3475: HUMAN RIGHTS-LANDLORD-TENANT

Amends the Illinois Human Rights Act. Makes it a violation of the Real Estate Transactions Article of the Act to unlawfully discriminate using credit score and history, including insufficient credit history. Limits these provisions to landlord and tenant agreements only in which a tenant or prospective tenant is seeking to use a rental subsidy.

HB 5198: AFFORDABLE HOUSING-CILAS

Amends the Affordable Housing Planning and Appeal Act. Requires non-exempt local governments to provide residents with notice and the opportunity for comment at a public hearing prior to adopting an affordable housing plan. Requires a non-exempt local government to provide proof of its compliance with the notice and public hearing requirements when it submits a copy of its affordable housing plan to the Illinois Housing Development Authority. Expands the list of information that must be provided in the affordable housing plan to include, (i) an identification of "specific lands" (rather than "lands") within the jurisdiction that are most appropriate for the construction of affordable housing, (ii) proposed timelines to commence "specific actions and deadlines" (rather than "actions") to implement the components of the affordable housing plan, and (iii) incentives, including certain measures to address the need for affordable housing, that the local government may provide for the purpose of attracting affordable housing. In a provision permitting certain persons to appeal a local government's denial of a proposed affordable housing plan, expands the list to include a service provider that is under contract to provide services for potential residents of a proposed supportive housing project or community-integrated living arrangement that is included in the proposed affordable housing plan. Contains provisions concerning final actions or decisions by the governing body of the local government on the proposed affordable housing plans; appeal procedures and timelines; and other matters. Expands the Illinois Housing Development Authority's rulemaking authority to include the adoption of rules and regulations concerning the substance of affordable housing plans consistent with the changes made in the amendatory Act.

SB 3678: BAN PRICE COORDINATION-RENT

Amends the Landlord and Tenant Act. Prohibits a person from entering into an agreement with any other person to not compete in rental pricing, fees, or any other rental term for residential rental units in the State. Prohibits a person from engaging in price coordination for residential rental units in the State. Prohibits a person from facilitating an agreement between 2 or more persons to not compete with respect to rental pricing, fees, or any other rental term for residential rental units in the State. Prohibits a person from using, subscribing to, contracting for, or paying for the services involving price coordination or otherwise encouraging or facilitating an agreement with other persons to not compete with respect to any rental term for residential rental units in the State. Allows an aggrieved person to bring a civil action seeking damages and makes a violation of the Act a violation of the Consumer Fraud and Deceptive Practices Act.

SB 3763: LANDLORD-TENANT FEES

Amends the Landlord and Tenant Act. Requires landlords to disclose all non-optional fees in a clear and conspicuous manner in the listing and on the first page of the lease. Requires landlords to disclose if any utility bills are non-optional fees in the listing and the first page of the lease. Provides that if a landlord failed to comply with this disclosure, the landlord may not collect the non-optional fee. Prohibits a landlord from charging a bundled services fee that combines optional and non-optional fees. Prohibits a landlord from charging a tenant with a fee or fine that includes, but is not limited to, an application fee that includes a background check of more than $50, an after-hours request for maintenance service, or pest abatement or removal in which the tenant has not contributed to the infestation. Prohibits a landlord from charging a tenant more than one of the following: (i) a security deposit, (ii) a move-in fee, or (iii) a move-out fee. Exempts leases in owner-occupied buildings containing 6 or fewer units and to nonresidential tenancies. Defines terms. Creates a civil cause of action for violation of the Act by a landlord. Makes other changes. Limits home rule.

SB 3931: REVENUE-REINTEGRATION FUND

Amends the State Finance Act. Creates the Community Housing Reintegration Fund. Provides that moneys in the Fund may be used to provide housing-related costs for eligible persons who are either (i) transitioning out of congregate long-term care settings into less restrictive independent and community-based housing or (ii) facing impending placement in a congregate long-term care facility due to lack of affordable accessible housing. Amends the Property Tax Code. Increases the real estate transfer tax from $0.50 per $500 of valuation to $0.75 per $500 in valuation. Provides that a portion of the proceeds from the real estate transfer tax shall be deposited into the Community Housing Reintegration Fund. Effective immediately.
