Amends the Education for Homeless Children Act. Allows a school district to provide for an extended motel stay for a child who is homeless or at risk of becoming homeless. Effective immediately.
Amends the Public Utilities Act. In provisions concerning nondiscrimination, provides that the Commission is authorized to approve a low-income discount rate for residential electric and natural gas customers that applies to the entirety of a qualifying customer's bill, including, but not limited to, a qualifying customer's delivery service charges and energy supply charges. Provides that an electric or natural gas utility may fund low-income discount rates through a surcharge on customers' electric and natural gas bills. Provides that the changes to the Act apply retroactively on and after January 1, 2023. Amends the Energy Assistance Act. In provisions concerning eligibility under the Act, provides that, in setting the annual eligibility level for the use of State funds from the Supplemental Low-Income Energy Assistance Fund, the Department of Commerce and Economic Opportunity shall consider the amount of available funding and may not set a limit higher than 300% of the federal nonfarm poverty level. In provisions concerning the Supplemental Low-Income Energy Assistance Fund, provides that the yearly administrative expenses of the Fund may not exceed 15% (rather than 13%) of the amount collected during that year, except when unspent funds from the Fund are reallocated from a previous year. Provides that any unspent balance of the 15% administrative allowance may be utilized for administrative expenses in the year they are reallocated. Provides that, of the 15% administrative allowance, no less than 9% (rather than 8%) shall be provided to Local Administrative Agencies for administrative expenses. Provides that, beginning January 1, 2027, the Base Energy Assistance Charge shall be $0.80 per month for each utility that is required by the Illinois Commerce Commission to implement a low-income discount rate and shall be $0.40 per month for each utility that is not required to implement a low-income discount rate and that contributes to the Supplemental Low-Income Energy Assistance Fund. Makes other changes.
Amends the Landlord and Tenant Act. Requires landlords to disclose all non-optional fees in a clear and conspicuous manner in the listing and on the first page of the lease. Requires landlords to disclose if any utility bills are non-optional fees in the listing and the first page of the lease. Provides that if a landlord failed to comply with this disclosure, the landlord may not collect the non-optional fee. Prohibits a landlord from charging a bundled services fee that combines optional and non-optional fees. Prohibits a landlord from charging a tenant with a fee or fine that includes, but is not limited to, an application fee that includes a background check of more than $50, an after-hours request for maintenance service, or pest abatement or removal in which the tenant has not contributed to the infestation. Prohibits a landlord from charging a tenant more than one of the following: (i) a security deposit, (ii) a move-in fee, or (iii) a move-out fee. Exempts leases in owner-occupied buildings containing 6 or fewer units and to nonresidential tenancies. Defines terms. Creates a civil cause of action for violation of the Act by a landlord. Makes other changes. Limits home rule.
Amends the Fair Patient Billing Act. In provisions concerning hospitals and their agents pursuing collection actions, provides that, for any legal action initiated against a patient for unpaid medical debt, a hospital may not file for or be granted a lien upon that patient's primary residence or on any other real property owned by the patient. Effective January 1, 2027.
This bill proposes the nomination of Daniel Keith Hayes to serve as a Member of the Illinois Housing Development Authority. This action would appoint Mr. Hayes to a role within the state agency responsible for housing development initiatives.
This bill proposes the nomination of Phyllis B. Mitzen. If approved, she would become a member of the Illinois Affordable Housing Advisory Commission.
Amends the Affordable Housing Planning and Appeal Act. In provisions requiring the Illinois Housing Development Authority to determine which local governments are exempt from the requirements of the Act, requires the Authority to collect data on owner-occupied and rental units for each local government as follows: (1) by totaling the number of owner-occupied housing units in each local government that are affordable to households with a gross household income that is less than 80% of the median household income and is between 80% and 140% of the median household income within the county or primary metropolitan statistical area; and (2) by totaling the number of rental units in each local government that are affordable to households with a gross household income that is less than 60% of the median household income and is between 80% and 140% of the median household income within the county or primary metropolitan statistical area. Provides that data collected for the 80% AMI to 140% AMI households is to be used for informational purposes and shall not factor into the determination of exempt local governments.
Creates the Community Land Trust Home Ownership Act. Provides that the Illinois Housing Development Authority's homeownership programs, including loan products, grants, and other types of assistance, shall be made available to home buyers and owners seeking to purchase or maintain housing where a leasehold interest in real property is held by a community land trust or other 501(c)(3) organization for the purposes of promoting long-term affordability, preservation of affordable housing, or community revitalization efforts. Provides that any other type of seller, including for-profit or private sellers of homes, through leasehold agreements, such as installment contracts, contract for deeds, or any other type of purchase or ownership structure, shall not be eligible under the amendatory Act. Requires the Illinois Housing Development Authority, within 90 days after the effective date of the Act, to propose new or amended administrative rules that will make the Authority's homeownership programs consistent with the purposes of the Act. Effective immediately.
Creates the Hospitals and Homelessness Support Act. Requires the Office to Prevent and End Homelessness within the Department of Human Services to maintain on its publicly accessible website information on how a hospital or healthcare system may connect a patient experiencing homelessness or otherwise in a vulnerable housing situation with shelter and homeless support services for each continuum of care in the State. Requires the Department to ensure that the information required includes, for each continuum of care, any phone number, email address, physical address, primary agencies, or any other information that may be necessary for a person in that continuum of care territory to begin accessing shelter or other homelessness services. Requires the Department to include, where possible, a specific phone number that a hospital or health care facility may call and specific language to use. Requires the Department to also include on its website a way for the hospital or healthcare system to determine which continuum of care applies based on the physical location of the hospital or healthcare system. Requires other information, all of which must be added to the Department's website by October 31, 2025. Contains provisions concerning annual audits.
Amends the Eviction Article of the Code of Civil Procedure. Requires dismissal of a complaint in its entirety against all defendants if the complaint names a defendant who is a minor at the time of filing or was a minor at the time that the lease agreement at issue was entered. Provides that such an action shall be immediately sealed. Provides that, in addition to any other remedies available to the minor, a minor named as a defendant in violation of the Act is entitled to reasonable attorney's fees, actual damages, and liquidated damages in the amount of $1,000. Provides that nothing in the Act prohibits a party from refiling an action against any defendants who otherwise may be properly named. Provides that, upon dismissing the case, the court may not waive any fees associated with refiling the action against defendants otherwise properly named.
