Amends the Department of Public Health Powers and Duties Law of the Civil Administrative Code of Illinois. Defines "covered facility" as any long-term care facility, assisted living establishment or shared housing establishment, supportive living facility, ID/DD facility, MC/DD facility, community living facility, community-integrated living arrangement, or Alzheimer's disease management center alternative health care model licensed under the Alternative Health Care Delivery Act. Provides that the Department of Public Health shall establish rules requiring a covered facility to notify a resident or the resident's power of attorney or representative whenever the covered facility determines that a vaccination recommended by the Department cannot be administered to the resident within the time frame established by the Department.
Amends the Hospital Licensing Act. Removes provisions requiring the Department on Aging to adopt rules to address instances when a case coordination unit is unable to complete an assessment in a hospital prior to the discharge of a patient 60 years or older to a nursing home to ensure that the patient is able to access nursing home care, the nursing home is not penalized for accepting the admission, and the patient's timely discharge from the hospital is not delayed, to the extent permitted under federal law or regulation.
Amends the Nursing Home Care Act. In provisions concerning required posting of information, provides that the posting of information is not required if staffing was at 90% staffing of the minimum staffing requirements or if a facility has corrected the minimum staffing requirements before the posting deadline.
Amends the Nursing Home Care Act. In provisions concerning monetary penalties for noncompliance with minimum staffing standards, provides that monetary penalties shall be established based on a formula that calculates on a quarterly basis (instead of a daily basis). Provides that the monetary penalty may not be waived, except where there is no more than a 10% deviation from the staffing requirements, in which case the facility shall not receive a penalty. Makes changes regarding the notice that a facility that has received a notice of violation for a violation of the minimum staffing requirements shall display. Effective immediately.
