HB 5277: FILING FEES-CLERK-GAC FUND

Amends the Clerks of the Courts Act. Increases the filing fee and appearance fee in civil actions. Requires $5 of those fees to be deposited into the Guardianship and Advocacy Fund. Provides that no fee may be charged for accounts filed for guardianships established for minors under the Minors Article of the Probate Act of 1975 or for disabled adults of the Probate Act of 1975. Provides that no fee may be charged for a commitment petition or petition for discharge under the Mental Health and Developmental Disabilities Code. Repeals the provisions imposing the guardianship and advocacy operations fee.

SB 3566: VEH CD-ELECTRIC VEHICLES

Amends the Illinois Vehicle Code. Provides that, beginning July 1, 2027, an electric vehicle owner may register an electric vehicle with any qualifying registration, and an additional $320 surcharge shall be collected in addition to the applicable registration fee. Provides that, beginning July 1, 2028, the Secretary shall annually adjust the electric vehicle registration surcharge by an amount equal to the percentage increase, if any, in the Consumer Price Index for the 12 months ending in March of the year in which the increase takes place. Establishes the Road Usage Charge Program to be implemented by Secretary of State to be used in lieu of the fees levied for electric vehicle owners. Requires the Secretary to adopt rules to implement the Program. Allows the Secretary to impose a penalty for failure to timely pay a road usage charge according to the terms of the Program or tampering with a device necessary for the Program. Provides that if enrolled in the Program, the owner of an electric vehicle shall: report mileage driven; pay the road usage fee for each payment period; and comply with all other provisions and other requirements of the Program. Provides that beginning July 1, 2027, the road usage charge rate is 1.5 cent per mile and the road usage charge cap is $320 for an annual registration. Requires the Secretary to annually adjust the road usage charge rate and the road usage charge cap by an amount equal to the percentage increase, if any, in the Consumer Price Index for the 12 months ending in March of the year in which the increase takes place. Provides that revenue generated by the Program and relevant penalties shall be distributed in the same manner revenue from the motor fuel tax is distributed after covering the costs to administer the Program.

HB 4929: CARBON CAPTURE DEVICE REBATE

Creates the Privately-Owned Carbon Capture Device Rebate Act. Establishes a rebate program administered by the Environmental Protection Agency for eligible purchasers of privately-owned carbon capture devices that use biological processes, including microalgae photosynthesis, for residential use. Lists eligibility criteria for applicants and devices. Provides rebate amounts and timelines, prioritizing low-income applicants. Requires ownership and residency conditions and sets limits on rebate frequency. Authorizes auditing and reimbursement for noncompliance. Imposes a 5% user fee on device sales to fund rebates. HB 4785: DHS-BEHAVIORAL HLTH SURCHARGE

Creates the Preventing Crisis Cost Shifting to Medicaid Act. Provides that the General Assembly finds that (i) behavioral health crisis services, including crisis call centers, mobile crisis response, and crisis stabilization and receiving services, function as essential public health infrastructure and must be available statewide without regard to insurance status; and (ii) commercial health insurance policies issued or administered in the State generally do not provide comprehensive coverage for the full continuum of behavioral health crisis services, resulting in the cost of such services being disproportionately borne by Medicaid, local governments, and taxpayers. Requires specified entities (surcharge payors) that are authorized to issue or administer a policy or contract of accident and health insurance or a health maintenance organization contract in the State to pay a behavioral health crisis assessment to the Department of Human Services for deposit into the Statewide 9-8-8 Trust Fund. Exempts Medicaid managed care organizations from paying the behavioral health crisis assessment. Permits the Department to update the total behavioral health crisis assessment amount as necessary to ensure the continued availability, quality, or geographic equity of the statewide behavioral health crisis system. Requires the Department to establish an appropriate mechanism for enforcing a surcharge payor's liability, which may include accrued interest on unpaid liabilities at a rate not to exceed 18% per annum and late fees or penalties at a rate not to exceed 5% per month. Provides that the enforcement mechanism may also include notification to the Department of Healthcare and Family Services to offset payments on the surcharge payor's claims. Provides that the Department of Human Services shall not direct the Department of Healthcare and Family Services to offset claims payments unless the surcharge payor has maintained an outstanding liability to the Statewide 9-8-8 Trust Fund for a period longer than 45 days and has received proper notice of pending enforcement.

HB 4232: VETERAN REGISTRATION FEES

Amends the Illinois Vehicle Code. Provides that, beginning with the 2026 registration year, the standard registration fee for passenger motor vehicles of the first division and motor vehicles of the second division weighing not more than 8,000 pounds shall be $100 for any Illinois vehicle owner who has been issued a drivers license with a veteran's designation. Effective immediately.

HB 4617: COMMON INTEREST COMMUNITY REG

Creates the Office of Common Interest Community Registration Act. Creates the Office of Common Interest Community Registration within the Division of Real Estate in the Department of Financial and Professional Regulation. Provides that the Office shall require a common interest community association to register with the Office, which shall require an association to: (1) pay a registration fee of $3 per number of units in the common interest community; (2) provide any bylaws, articles of incorporation, or covenants established by the association; (3) provide the names and contact information of all board of managers or board of directors; and (4) provide a list of any management company contracted to assist with the management of an association. Provides that if a unit owner alleges that the board of managers or board of directors has violated the Act, the Office shall investigate the complaint within 60 days. Allows the Office to issue a fine against a board of managers, board of directors, or individual board member for violating the Act or any of the bylaws, articles of incorporation, or covenants established for the board of managers', board of directors', or individual board member's respective association. Allows the Office to refer any criminal activity to the State's Attorney or refer any violation of the Americans with Disabilities Act of 1990 or any civil rights violation to the Attorney General. Authorizes the Office to adopt any rules necessary to implement the Act. Creates the Community Interest Community Registration Fund in the State treasury. Repeals the Condominium and Common Interest Community Ombudsperson Act. Makes conforming changes.

SB 1938: METRO & REGIONAL TRANSIT AUTH

Creates the Road Usage Charge Act. Establishes the Road Usage Charge Advisory Committee to guide the development and evaluation of the road usage charge pilot program and to assess the potential for mileage-based revenue as an alternative to the current system of taxing highway use through motor fuel taxes. Sets forth the membership and duties of the committee. Requires the Department of Transportation, in consultation with the Secretary of State and based on the recommendations of the Committee, to implement a statewide pilot program by January 1, 2026 to assess a user fee on owners of motor vehicles that is based on the number of miles traveled on public roadways in this State by those vehicles. Amends the Metropolitan Transit Authority Act. Provides that, on and after February 1, 2026, the Chicago Transit Board shall have 8 members (currently 7 members). Makes changes to the number of affirmative votes by Directors required to issue bonds. Amends the Regional Transportation Authority Act. Provides that the Annual Budget and 2-Year Financial Plan must show that the aggregate of all projected fare revenues from fares and charges for mass transportation provided by, or under grant or purchase of service contracts of, the Service Boards received in fiscal years 2026 and 2027 shall equal at least 25%, and in fiscal years 2028 and 2029 and every year thereafter at least 15%, of the aggregate cost of providing such public transportation in those fiscal years. Provides that, beginning July 1, 2026, the Regional Transportation Authority shall be the sole agency responsible for the management and oversight of the fare collection systems used on all public transportation provided by the Service Boards. Makes changes to the membership of the Suburban Bus Board and the Commuter Rail Board. Makes changes to the number of affirmative votes required by the Directors of the Authority to approve decisions regarding the strategic plan, coordination of fares and service, appointment of officers and employees, paratransit services, powers of the Commuter Rail Board, labor, budget, taxes, distribution of revenues, issuing and pledging bonds and notes, budget review powers, the annual capital improvement plan, and rate protection contracts. Makes other changes. Effective January 1, 2026.

HB 1325: SOUTH SUBURBAN TRAUMA CENTER

Amends the Illinois Health Facilities Planning Act. Creates the South Suburban Trauma Center Fund as a special fund in the State treasury. Specifies that certain toll surcharges are to be deposited in the Fund and used for a suburban trauma center to be situated on the border between Calumet City and the Village of Dolton. SB 1896: PEN CD-STATE SYS-FUNDING

Amends the Illinois Pension Code. Creates the State-Funded Retirement Systems Council to appoint and oversee the Pension Funding Trustee and to monitor and verify State funding to the State-Funded Retirement Systems. Creates the Office of Pension Trustee. Sets forth duties of the Council and Trustee. Provides that the State pledges that the State will not limit or alter certain rights of the Council, the State-Funded Retirement Systems, the Pension Funding Trustee, or the Auditor General under the amendatory Act; alter the method of calculating the minimum required contribution by the State to any State-Funded Retirement System in such a manner as results in a diminution in the contribution amount to a State-Funded Retirement System before the total assets of that System are equal to 100% of the total actuarial liabilities of that System; or use the proceeds of certain income tax surcharges for anything other than certain purposes. Waives sovereign immunity for purposes of the State-Funded Retirement Systems Council. Beginning State Fiscal Year 2026, sets forth a minimum contribution formula for the State-funded retirement systems equal to the sum of the Base Contribution plus the Benefit Change Contribution Amount. Makes conforming and other changes. Provides for transfers from the Budget Stabilization Act from the proceeds of the income tax surcharge under the amendatory Act. Amends the Illinois Income Tax Act. Establishes a surcharge for taxable years 2026 through 2034 for all individuals, trusts, and estates equal to 0.5% of the taxpayer's net income and 0.7% of the net income of all corporations. Makes conforming changes in the Court of Claims Act. Effective immediately.
