HB 4086: VEH CD-SOS-ACCIDENT RECORDS

Amends the Illinois Vehicle Code. Provides that, beginning on January 1, 2005, the Secretary of State shall keep a separate annual record of all motor vehicle accidents in which a vehicle backed into or over a pedestrian and a separate annual record of all accidents in which a person was injured by the power window of a vehicle. Provides that the Secretary shall analyze these records and shall submit a report of his or her findings to the Governor and the General Assembly no later than March 31, 2006 and no later than March 31 of each succeeding calendar year.

HB 2953: TAXES-TAXPAYER RIGHTS

Amends the Taxpayers' Bill of Rights Act. Allows a taxpayer to sue the Department of Revenue if the Department negligently (now intentionally or recklessly) disregards tax laws or regulations in collecting taxes. Creates a certified public accountant-client or public accountant-client privilege for non-criminal proceedings before the Department. Provides that in the case of a taxpayer receiving a protestable notice, a bill, a claim denial, or a reduction of a refund regarding any tax, the taxpayer's position shall be presumed to be the correct position and the burden of proof shall be on the Department to prove otherwise. Amends the Illinois Income Tax Act, the Use Tax Act, the Service Use Tax Act, the Service Occupation Tax Act, the Retailers' Occupation Tax Act, the Cigarette Tax Act, the Cigarette Use Tax Act, the Hotel Operators' Occupation Tax Act, the Motor Fuel Tax Law, the Coin-Operated Amusement Device and Redemption Machine Tax Act, the Cannabis and Controlled Substances Tax Act, the Messages Tax Act, the Gas Revenue Tax Act, the Public Utilities Revenue Act, the Water Company Invested Capital Tax Act, the Telecommunications Excise Tax Act, and the Uniform Penalty and Interest Act to make corresponding changes. Amends the Illinois Income Tax Act to create a civil action against the Department for the knowing or negligent disclosure of confidential information. Provides penalties. Amends the Illinois Public Accounting Act to make changes regarding confidentiality. Effective immediately.

HB 6797: STUDENT LAPTOP INITIATIVE

Creates the Illinois Student Laptop Computer Initiative for 21st Century Education Act. Established the Illinois Student Laptop Computer Commission to (i) ensure that every elementary student in the State is given a personal laptop computer by the beginning of the 6th grade year and to make grants to local school districts for various purposes and (ii) publish an annual plan for the purchase and distribution of educational technology. Provides that only certain public schools are eligible for assistance from the Commission. Authorizes the Commission to obtain the services of personnel and to enter into contracts and memoranda of understanding with private parties and with State agencies. Provides that all moneys deposited into the Illinois Student Laptop Computer Fund shall be distributed, subject to appropriation, to the Illinois Student Laptop Commission for the purposes of the Act. Provides that money from both public and private sources may be deposited into the Fund. Amends the State Finance Act. Creates the Illinois Student Laptop Fund, a special fund in the State treasury. Effective January 1, 2005.

SB 2161: MUNI CD-DEVELOPER DONATIONS

Amends the Illinois Municipal Code. Authorizes the corporate authorities of any municipality to create a schedule for and to collect developer donation fees for certain impacts specifically and uniquely attributable to the development of any subdivision or resubdivision of land within the municipality. Effective immediately.

HB 3828: EPA-NO NPDES DISCHARGE FEES

HB 3601: PROPERTY TAX-SCAVENGER SALE

Amends the Property Tax Code. Provides that, to be eligible to bid or receive a certificate of purchase at a scavenger sale, a person's application for certificate of purchase must affirm that the person has not either directly or through an agent twice during any previous sale in the last 3 calendar years (now, during the same sale) failed to complete a purchase by the immediate payment of the minimum bid or the payment of the balance of a bid within the required time. Effective immediately.

HB 7325: PENCD-IMRF-TAX LEVY APPROVAL

Amends the IMRF Article of the Illinois Pension Code. Provides that, at any time, the Board may require a municipality to submit to the Board (i) a certified copy of the ordinance for that tax levy, (ii) a certified copy of the ordinance for the appropriation for municipality contributions, and (iii) if the levy exceeds the contribution, a statement of the reason for the additional amount. Provides that the tax collecting authority may not extend a levy for an amount greater than the amount appropriated for municipality contributions unless the additional amount is authorized for a school district or has been approved by the Board. Provides that, as a condition of approval, the Board may require the tax collecting authority to pay the revenue derived from the tax levy directly to the Fund rather than to the treasurer of the municipality levying the tax. Provides that the provisions of this amendatory Act of the 93rd General Assembly do not apply to a municipality that is a county with more than 500,000 inhabitants or is located, in whole or in part, in such a county. Effective immediately.
