Amends the Counties Code. Provides that any purchase by a county with fewer than 2,000,000 inhabitants, or an elected official in a county with fewer than 2,000,000 inhabitants, including an elected official with control of the internal operations of the office, of services, materials, equipment, or supplies in excess of $60,000 (rather than $30,000), other than professional services, shall be contracted (1) by a contract let to the lowest responsible bidder after advertising for bids in a newspaper published within the county or, if no newspaper is published within the county, then a newspaper having general circulation within the county; (2) by a contract let without advertising for bids in the case of an emergency if authorized by the county board; or (3) by a contract let without advertising for bids in the case of the expedited replacement of a disabled, inoperable, or damaged patrol vehicle of the sheriff's department if authorized by the county board.
Amends the Sports Wagering Act. Provides that applicants for a master sports wagering license shall pay an application fee of $250,000 and a license fee of $15,000,000. Removes provisions concerning the number of master sports wagering licenses to online sports wagering operators and public notice requirements. Provides that a master sports wagering licensee may conduct sports wagering over the Internet or through a mobile application. Removes provisions concerning eligibility requirements for a master sports wagering license, the duty of disclosure for an applicant, and outreach requirements for the Department of Commerce and Economic Opportunity and the Illinois Gaming Board. Makes a conforming change. Effective immediately.
Amends the Consumer Fraud and Deceptive Business Practices Act. Provides that a consumer may opt out of the processing of personal data for the purpose of targeted advertising by submitting a request using the methods specified in a data processing controller's privacy notice. Sets forth the requirements of a controller's privacy notice. Provides that, if a controller processes personal data for purposes of targeted advertising or sells personal data to third parties for targeted advertising, the controller shall disclose the processing or sale in a privacy notice and provide access to a clear and conspicuous method outside the privacy notice for a consumer to opt out of the processing or sale. Makes other changes. Effective January 1, 2028.
Amends the Election Code. Provides that only voting machines or voting systems approved by the State Board of Elections, as allowed under this Code, may be used by an election authority. Repeals the Direct Recording Electronic Voting Systems Article. Makes conforming changes. Provides that a "voting machine", "voting system", or "electronic voting system" does not mean a direct recording electronic voting machine or system or a machine or system that uses a computer as the marking device to mark a ballot sheet. Effective January 1, 2027.
Creates the Artificial Intelligence Safety Measures Act. Defines "frontier model", "frontier developer", and "large frontier developer". Requires large frontier developers to adopt and publish a frontier AI framework addressing catastrophic risk management, transparency, and cybersecurity. Mandates reporting of critical safety incidents to the Illinois Emergency Management Agency and Office of Homeland Security and establishes civil penalties for noncompliance. Directs the Department of Innovation and Technology to review and recommend updates to definitions and standards. Creates a consortium to develop ILCompute, a public cloud computing resource. Exempts specified information under the Freedom of Information Act. Makes conforming changes to the Freedom of Information Act.
Creates the Online Safety Act. Provides that, no later than January 1, 2027, an owner of a social media platform shall: (1) incorporate an online safety center into the social media platform that provides consumers with specified educational resources; and (2) establish a cyberbullying policy for the social media platform. Provides for restrictions on personal data processors that offers any online service, product, or feature to minors. Provides that a violation of the Act constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change. Effective January 1, 2027.
Amends the Election Code. Provides that, in addition to required vote centers, election authorities may establish additional vote centers under a specified model. Sets forth provisions concerning the number and location of additional vote centers. Provides that, in jurisdictions where in-precinct counting equipment is used, the election authority shall retabulate the total number of votes cast on 5% of the election day equipment used within the election jurisdiction (rather than votes cast in 5% of precincts within the election jurisdiction). Provides that the precincts and voting devices to be retabulated shall be selected after election day on a random basis by the State Board of Elections so that every device used in early voting and all equipment used on election day in the election jurisdiction has an equal mathematical chance of being selected (rather than providing that every precinct and every device used in early voting shall have an equal mathematical chance of being selected for retabulated).
Amends the Election Code. Provides that the campaign free zone at any polling place located within any forest preserve district or conservation district shall extend 100 horizontal feet from each entrance to the room used by voters to engage in voting and shall also extend 500 horizontal feet from each entrance to the room used by voters to engage in voting to the boundaries of the district.
Amends the Firearm Owners Identification Card Act. Provides that a person who has had the person's Firearm Owner's Identification Card revoked or denied under certain provisions because the person was a patient in a mental health facility shall not be permitted to obtain a Firearm Owner's Identification Card, after the 5-year period has lapsed, unless the person has received a mental health evaluation by a licensed clinical mental health professional (rather than a physician, clinical psychologist, or qualified examiner as those terms are defined in the Mental Health and Developmental Disabilities Code). Provides that the person receiving a mental health evaluation shall share all collateral records with the licensed clinical mental health professional making the certification and shall attest that all collateral records have been provided before the evaluation. Provides that the licensed clinical mental health professional shall attest that the licensed clinical mental health professional has requested, received, reviewed, and considered all of the person's collateral records in making the licensed clinical mental health professional's determination that the person is not a clear and present danger to self or others. Provides that the licensed clinical mental health professional shall identify the types of collateral records received. Requires the licensed clinical mental health professional to make all reasonable attempts to obtain collateral records, and, if no collateral records are obtained, requires the licensed clinical mental health professional to document the efforts used to obtain such collateral records. Provides that the results of the mental health evaluations that are performed on or after the effective date of the amendatory Act shall be transmitted to the Illinois State Police. Defines terms.
Creates the Artificial Intelligence Data Privacy Act. Prohibits a deployer from training an artificial intelligence on a user's data and retaining the training data indefinitely unless specified conditions are satisfied. Sets forth provisions concerning a private right of action. Provides that a violation of the Act constitutes an unlawful practice under the Consumer Fraud and Deceptive Business Practices Act. Amends the Consumer Fraud and Deceptive Business Practices Act to make a conforming change. Effective January 1, 2027.
Amends the Firearm Concealed Carry Act. Provides that a non-resident may carry a handgun under the Act if the non-resident is 21 years of age or older, has a license or permit in a state whose training requirements are substantially similar to those under the Act or to residents of contiguous states if a reciprocal agreement has been entered into, the license or permit holder is not a resident of Illinois, and the license or permit holder is a legal resident of the United States. Provides that a non-resident is subject to the same laws and restrictions as a license holder under the Act. Provides that if a resident of another state who is permitted to carry under this provision establishes legal residence in this State, the license or permit shall be valid in this State for 90 days following the date on which the holder of the license or permit establishes legal residence in this State. Effective immediately.
Creates the Artificial Intelligence Product Liability Act. Sets forth provisions concerning product liability actions brought against a developer of an artificial intelligence system for defective design, failure to contain adequate instructions or warnings, and failure to conform to an express warranty. Provides that a deployer of an artificial intelligence system shall be deemed to be liable as a developer for harm caused by a product if: (1) the deployer makes material and substantial change to the product or (2) the deployer intentionally misuses the product contrary to the express warranty and that use was the proximate cause of harm to the plaintiff. Sets forth provisions concerning applicability and enforcement.
